CALL TO ORDER: The meeting was called to order at 5:30 by Mayor John Masiarczyk. 2. ROLL CALL: Present 6 - Commissioner Brian Soukup, Commissioner Diane J. Smith, Commissioner Gary Mitch Honaker, Commissioner Heidi Herzberg, Vice Chair Nancy Schleicher, and Mayor John C. Masiarczyk Sr. Excused 1 - Commissioner Chris Nabicht 3. PLEDGE TO THE FLAG: The City Commission and staff said the pledge to the flag. 4. PUBLIC COMMENTS: Mayor Masiarczyk opened the meeting for public comment. Michael Putkowski, 2736 Courtland Drive, Deltona, stated that there is a garbage issue and to renew a contract with Waste Pro would be outrageous due to the lack of service residents are receiving and that there are many missing sidewalks around Friendship Elementary School. The City Manager asked that public comments on items on the agenda wait until the item comes up for discussion. Mayor Masiarczyk closed the meeting for public comment. 5. BUSINESS: A. Discussion re: Utility Relocation Bill and Discussion with Deltona’s Lobbyist. The Commission, State Representative Santiago, and staff discussed the State Bill for utility right-of-way relocation, road enhancements, the definition of transportation, the effect the State Bill would have on utility installation, the communication services tax (CST), franchise fees, incentives and the wording of the State Bill. City of Deltona Page 1 Printed on 10/5/2015 City Commission Workshop Minutes August 24, 2015 The Commission, State Representative Santiago, Capitol Insight consultant ’s Kirk Pepper and Joseph Salzverg, and staff discussed the State Bill for utility right -of-way relocation, the last legislative session, the State Senate maps, septic tank mandates, CST, unfunded mandates, enterprise zones, I-4 catchment areas, water projects, transportation, the brownfield tax credit program, Representative Matt Gaetz, the 2016 legislative session, Sunrail extension to Deltona, firework agricultural exemption, sidewalks, Capitol Insight reports and the Delegation Meeting on October 16, 2015. After discussion, the Commission concurred to have a workshop to discuss items for the Delegation Meeting on October 16, 2015. Mr. Pepper introduced Mr. Salzverg who stated he was looking forward to working with the City of Deltona; he gave a brief biography of himself and his previous work experience. The Commission discussed having more of a presence in Tallahassee. Mike Williams, 2889 Cottageville Street, Deltona, asked the Commission to go after the money for enterprise zones. B. Discussion re: Waste Pro contract and implementing franchise fee on commercial solid waste - Dale Baker, Deputy City Manager (386) 878-8852. Mr. Tim Dolan with Waste Pro explained the Waste Pro Contract, solid waste collection, waste containers, recycling collection, yard waste collection, bulk waste collection, compliance, customer complaints and the Trac EZ System. The Commission and staff discussed customer complaints, the Trac EZ System, the supervisor analyzing yard waste, yard waste, the number of complaints the City receives, the code pertaining to garbage cans, the image of the City, educating the public of the rules, enforcing the rules, the trash bill for residents, the rules for trash pickup, the tracking of garbage carts, changing the parameters from the contract, the requirements of the contract, beautifying the City, bulk waste pickup and employees picking up trash. After discussion, the Commission concurred to give the City Manager the authority to look into bulk waste pickup and enforce the rules of the Waste Pro contract. The Commission and staff discussed the city code and commercial franchise fees. After discussion, the Commission concurred to have the Deltona Business Alliance Committee discuss commercial franchise fees. The Commission discussed St. Petka Serbian Orthodox Church in Longwood using the City’s facilities for a soccer tournament, an email the Mayor received with false information about how the Campbell Park property got its name and whether it is a City of Deltona Page 2 Printed on 10/5/2015 City Commission Workshop Minutes August 24, 2015 private or public park and Former Commissioner Carbonell wanting to remind the Commission of the Deltona High School vs. University High School football game on Friday. Commissioner Soukup asked the Commission for permission to use the City logo on t-shirts to pass out at Deltona High School games and that the Commissioners would wear to the game. The Commission discussed “Deltona” High School being the only high school to represent the City, the number of shirts, having all the Deltona high schools listed on the shirts and the request being for the use of the logo only, that the City Manager would decide what to do with the request to have t-shirts printed. The City Manager stated that she would need a vote from the Commission to authorize the use of the City logo. The Commission went around the table and voted on authorizing the use of the City logo for t-shirts and the Commission voted unanimously in favor of it. Mayor Masiarczyk clarified that the City owns the City logo and can use it on anything it chooses, however, a third party would need to submit a written request to the Commission for the use of the City logo. The Commission and the City Manager continued the discussion to include the City not paying for Commissioner’s t-shirts, the cost being around $500, the t-shirts marketing Deltona and showing support for the schools, the number of t-shirts to purchase, if there were marketing funds that could be used, what the policy is for future organizations, what organizations the Commission had turned down in the past, supporting all three (3) Deltona high schools, looking at the City as a whole, Deltona High coming forward wanting a partnership with the City, this being a policy issue and not a money issue, to do anything that would promote community spirit, there being many other municipalities who have partnerships between the municipality and the schools, limiting which schools would qualify for the t-shirts, the policy being for public high schools within the City ’s boundaries, this being a bad idea which will open up the gates to other organizations, the Commission being notorious for doing things at the last minute, printing the t -shirts so they can be used at other events, setting a new president, having students send selfies wearing the t-shirts to be posted on the City’s website , having no names on the t-shirts with the exception of the Commissioners, other marketing items provided by the City, avoiding backlash from other schools, limiting requests to high schools and having a policy, the policy being up to $500 for special events that support education and community events in the City, the requests would go directly to the City Manager, and the policy being on a case by case basis for marketing, advertising and creating a policy. Larry Kent, 235 River Village Drive, DeBary, asked the Commission for clarification on public participation. He stated that he tried to discuss commercial franchise fees and that he was shut down, that he believes that businesses are treated like low hanging fruit and that the Commission makes Ordinances without talking to the business community. City of Deltona Page 3 Printed on 10/5/2015 City Commission Workshop Minutes August 24, 2015 The Commission and staff discussed how the public comment portion of meetings should take place and it being an oversight that the floor was not opened up to the public immediately following Commission discussion on Item 5-B, placing public comment before and after the topic, the public being able to speak after presentations, and the agenda reflecting public comments after each item, removing public comment from Commission workshop agendas, workshops being for the Commission to discuss items and direct staff as necessary and removing “additions and deletions” from the Regular Commission Meeting agenda. 6.
