CALL TO ORDER: The meeting was called to order at 5:30 p.m. by Mayor Herzberg. 2. ROLL CALL – CITY CLERK: Present: 9 - Mayor Herzberg Vice Mayor Bradford Commissioner Avila-Vazquez Commissioner King Commissioner McCool Commissioner Ramos Commissioner Sosa City Attorney Acting City Manager 3. PLEDGE TO THE FLAG: Commissioner King led everyone in the pledge to the flag. 4. BUSINESS: A. Discussion and review on Food Truck Review. Planning and Development Services Director Ron Paradise discussed food trucks, iterant merchants, temporary mobile merchants, itinerant merchant activity, rules and guidelines, Article 6 Chapter 22, regulating and managing street vendors, commercially zoned property, vacant commercial lots, houses of worship, the 2020 Legislative Session, recent changes to State law, Chapter 22 Section 6, and licensing. The Commission and staff discussed not being provided any back-up material, neither the current or new draft ordinance, there is nothing to look at, and staff just looking for dialog and direction. Mayor Herzberg stated to move to the next item until someone prints out for the Commission the current ordinance, the draft ordinance and what the legislation has presented to the City. Vice Mayor Bradford stated the Commission does not have adequate time to review the documentation that is going to be passed out. B. Discussion regarding $15 an hour wage. Vice Mayor Bradford stated the Commission was just given the $15 minimum wage packets and again, the Commission is receiving this information on the dais which is unacceptable to her. The Commission needs to have this information prior to the meeting to look at and review so that if the Commission has questions they can adequately write those questions down to present them. Receiving something on the dais, to her, is totally unacceptable. Acting City Manager Peters stated the Commission has received what he calls the thin version and the thick version. The thick version is the rank and file employees and the thin version has to do with the Fire Department under the collective bargaining agreement. He went over the thick version first which is easier to understand and then went over the thin version. The Commission and Acting City Manager discussed the firefighters retroactive pay, rates being variable by employee, 31 employees under $15 an hour, reoccurring costs, doing gradual adjustments, hiring issues at a higher pay, the Archer Study, needing to be at $15 an hour by law, unemployment, health insurance and retirement costs, total number of employees including firefighters, long term staffing needed, customer service shortages, number of vacant positions, attractive pay is $17-$18 an hour, training and certifications, the permitting department, Deltona’s compensation vs. other cities, addressing compression, adjusting pay grades, internal adjustments, competing with the private sector, and turnover rate. Mayor Herzberg asked what the manager needed from the Commission and Acting City Manager Peters replied a general consensus from the Commission. The plan right now is during the budget review process staff will ask the Commission to rollover a sufficient amount of money from the current payroll lines for the General Fund, Stormwater and Deltona Water to cover the $15 an hour pay for next year. That money will be transferred into the budget for October 1, 2021. The Commission and Acting City Manager discussed the cap on pay, future increases, future salary studies, adjusting pay scales every 3-5 years, 3% is based on economy, looking at cost of living and being competitive, employees topped out, and adjustments to the midpoint. Planning and Development Services Director Ron Paradise discussed the proposed ordinance, definitions, licensing requirements, stationary and roving vehicles, private property, notarized authorization of owner, the impact to traffic, parking and ingress and egress, requiring a site plan, safety issues, commercial uses, business planned unit developments (BPUD), industrial planned unit developments, complying with all requirements, fire safety requirements, combustible materials, fire lanes, LP (Liquefied Petroleum) gas, unsafe or hazardous materials, hours of operation, property size, temporary signs, food truck bazars or events, and a possible pilot program. Staff is looking for some consensus that it is going in the right direction on this and to continue to move forward with these teams to advance an ordinance change to the City Commission. The Commission, Acting City Manager, City Attorney and staff discussed sign waving and sign-spinners, requirements for brick and mortar businesses, residents’ safety, lighting, site plan, permits, State and local regulations, zoning regulations, signs, itinerant merchants, houses of worship, the number of food trucks, legislation, special events, fines, having a database, food borne illnesses, the landowners’ responsibility, food truck locations, traffic problem, the Occupational Freedom & Opportunity Act, DBPR (Department of Business and Professional Regulations), inspection requirements, previous events, liability insurance, site requirements, violations, storage, compliance, verifying documentation, the number of events, cost to the vendor, developed and undeveloped acreage, safety issues, Article 6 Street vendors, permits for the sale of food, the City of Ormond Beach, and existing site plans. Mayor Herzberg stated the meeting is running over and she asked if Commission was okay with extending the meeting 15 minutes and there was no objection. The Commission and City Attorney discussed City of Holly Hill, roving health inspectors, and trespassing. 5. PUBLIC COMMENTS: Time permitted, public comments shall be limited to items on the agenda and shall not exceed two minutes. Please be courteous and respectful of the views of others. Personal attacks on Commission members, City staff or members of the public are not allowed, and will be ruled out of order by the Mayor. Elbert Bryan, Deltona, spoke about receiving messages, CBA (Collective Bargaining Agreement), firefighters deserving 3%, food truck flags, and temporary signs. Lisa Hager, Deltona United Church of Christ, Deltona, spoke about food trucks and events, permits and the cost, being compliant, insurance and licenses. 6. CITY MANAGER COMMENTS: Mayor Herzberg asked the Acting City Manager if he was good with tonight's discussion and if he needed anything else from the Commission. The Acting City Manager replied he thinks staff has gotten good direction, however, he would like to ask just to confirm that the City of Deltona Page 3 Printed on 10/22/2021 City Commission Workshop Minutes August 9, 2021 Commission is okay with using City Hall for a food truck bizarre a couple nights a week. Mayor Herzberg stated if the City is good with liability insurance and all of that, nothing falls back on the City, then she is fine with it and the Commission concurred. 7.
