1. CALL TO ORDER:
The meeting was called to order at 5:30 p.m. by Mayor Avila.
2. ROLL CALL – CITY CLERK:

A. Presentation - Halifax Health/UF Medical Center of Deltona - Medical
Center of Deltona Program Updates presented by Rafael Ramirez,
Marketing Development Specialist-Physician & Corporate Relations.
Mr. Rafael Ramirez introduced Vice President of Physician Services Matthew Petkus
who gave a brief Medical Center of Deltona (MCD) program update and program
opportunities.
B. Discussion regarding Chapter 110 - Zoning, Article VIII., Section 110-806,
Fences, Walls and Hedges of the City’s Code of Ordinances - Requested
by Commissioner JodyLee.
The Commission, City Manager and staff discussed fence permits, height requirements, the
Code, surveys, property lines, corner lots, flood plains, emergency status, dumpster
enclosures, garbage cans, private property and residential rights, waterfront and golf course
lots, privacy fences, material definition and opacity, home owner associations (HOAs), St.
Johns River Water Management District (SJRWMD), State and Federal Code, old
ordinances and making new ordinances.
Resident Jason addressed the City Commission.

C. Discussion regarding Chapter 14 - Animals, Article VIII., Section
14-281-284 - Requested by Commissioner McCool.
The Commission, City Manager, staff and resident Mr. Pescha discussed the community
garden, lot sizes, property rights, the chicken permits, coops, selling eggs, regulations and
liability, breeding, BTR (Business Tax Receipt), noise and diseases, number of chickens,
strays, agriculture permit, complaints and the ordinance language.
The Mayor asked for a consensus on the number of chickens to 10 and to revisit the
ordinance again in two years and the Commission concurred.
Jim Pescha and Elbert Bryan addressed the City Commission.
Motion by Vice Mayor Bradford, seconded by Commissioner McCool, to
extend the meeting an additional 15 minutes. The motion carried by the
following vote:
For: 6 - Mayor Avila, Vice Mayor Bradford, Commissioner
Avila-Vazquez, Commissioner Colwell, Commissioner
JodyLee, and Commissioner McCool
D. Planning & Development Services Department and Building and Code
Compliance Reports
Assistant to the City Manager, Suzette Cameron introduced the new building official who
gave a brief PowerPoint Presentation on Code Compliance, Local Ordinances, Abatements,
Solid Waste, Animal Cruelty, TNR/Breed, Animals at Large and Wildlife.
The Commission and staff discussed the permitting process, single family residences, plan
review, resources, apps and time management, paperwork and occupational trades, forms,
cross-training, Code Compliance, violations, Special Magistrate, testimony/evidence, being
reactive vs. proactive, and audits.
Motion by Vice Mayor Bradford, seconded by Commissioner McCool, to
extend the meeting an additional 15 minutes. The motion carried by the
following vote:
For: 6 - Mayor Avila, Vice Mayor Bradford, Commissioner
Avila-Vazquez, Commissioner Colwell, Commissioner
JodyLee, and Commissioner McCool
The Commission and staff discussed status of the permitting department, Special
Magistrate, representation of code cases, and State Statute.
