A. In an effort to reduce the possibility of exposure of residents to the
COVID-19 (Coronavirus) we are allowing limited public access into the
Commission Chambers and practicing social distancing with the Planning
and Zoning Board Members, staff, and residents.
Background: ***NOTE***
The Planning and Zoning Board is dedicated to working hard and keeping
our City moving forward, and a top priority during the COVID-19 pandemic
is to help maintain the health of our employees and residents. Another top
priority is being able to maintain public participation in our City meetings.
Following CDC Guidelines, we are allowing limited public access into the
Commission Chambers and practicing social distancing with the Planning
and Zoning Members, staff, and residents. Though there are restrictions
when it comes to public gatherings, we are dedicated to making sure those
who would like to make their voice heard are able to.
Please note your public comments can be submitted via one of the
following mediums no later than 12 Noon, December 14, 2020 to ensure
they are available for the Commissioners to review prior to the meeting.

1. CALL TO ORDER:
The meeting was called to order at 6:05 pm.
2. ROLL CALL:

3. APPROVAL OF MINUTES & AGENDA:
A. Minutes of November 18, 2020.
Motion by Jody Lee Storozuk, seconded by Michael Bowman, to accept
the Minutes of November 18, 2020. The motion carried by the following
vote:
For: 7 - Chair Putkowski, Secretary Storozuk, Member Bowman,

4. PRESENTATIONS/AWARDS/REPORTS:
A. Presentation - General overview of City's Land Development Process
Mr. Liu and Ms. Merced presented to the Board a PowerPoint presentation on the land
development review process. They spoke regarding the pre-application meeting with
Development Review Committee (DRC), land development requirements, review process,
fees, and the Development Order recordation process. Ms. Merced discussed the
inspection, building, and engineering permit process.

5. PUBLIC FORUM: Time permitted, public comment shall be permitted at the end of
agenda items only and shall not exceed two minutes.

A. Ordinance No. 06-2020 - Amending the official Zoning Map to rezone
±110.43 acres of land located south side of Enterprise Osteen Road from
County Prime Agriculture (A-1) to City of Deltona Residential Planned Unit
Development (RPUD). Project No. RZ20-0003.
Chairperson Putkowski noted this meeting is a Quasi-judicial hearing and asked if any of
the members had any ex-parte communication.
Member Northey stated she drove around the site and spoke to Wanda Van Dam. Member
Bowman stated he drove past the site on Sunday. Secretary Storozuk stated he walked
around the site. Chairperson Putkowski stated he drives by the property occasionally.
Member Munoz, Alternate Trombetta, and Alternate Rodriguez stated they did not have any
ex-parte communication.
Chairperson Putkowski read Ordinance No. 06-2020 and asked City Attorney
Segal-George to swear in everyone.
City Attorney Segal-George swore in members of the public and staff wanting to speak on
the project.
Mr. Paradise spoke regarding the previous annexation of the subject properties into the
City in 2006 and 2019. He explained the County zoning and future land use map
designation did not change. He stated in September 2020, the City Commission did
transmit and approve the first reading, a future land designation amendment application for
Low Density Residential. The amendment was transmitted to the Florida Department of
Economic opportunity and the Volusia Growth Management Commission. He noted neither
entity has brought forth any objections. The adoption and final reading is scheduled for the
January 19, 2021, City Commission meeting.
Mr. Paradise stated the property is forested and not developed. The property contains
about three (3) acres of wetlands and has approximately 30 acres of open water. The
property is associated with Little Lake. The goal of this request is to develop the property
with a single family subdivision featuring 221 units. There is a proposed text amendment to
the City's Future Land Use Element that limits the density on this property to 226 units,
although the rezone request is for 221. Lot sizes will range vary, but most will be between
6,000 and 8,000 square feet.
He stated the project is forecasted to generate about 2,200 trips on the City's roadway

network. He spoke regarding required turn lanes on Enterprise Osteen Rd. and a warranted
signal on SR415 and Enterprise Osteen Rd. The Development Agreement has the
stipulation of having this signal up and operational before the final plat is advanced to the
City Commission for approval. He spoke regarding a pioneer agreement to provide central
water and sewer services to the property and about residential vehicle parking. The
applicant's proposed entrance signs, which would be maintained by the homeowners
association (HOA) was also mentioned.
Mr. Paradise stated the rezoning is consistent with the City's Comprehensive Plan and
recommends the Planning and Zoning Board recommend the City Commission approve
Ordinance 06-2020 with the suggested staff changes. He stated 46 acres of this property is
located in the 100-year floodplain and about 30 acres of that is open water. As proposed
on the Master Development Plan (MDP), there are 24 lots located entirely or almost entirely
within the 100-year floodplain. Staff is suggesting the subdivision be redesigned to remove
all of the lots out of the floodplain or if the lots within the floodplain, the lost must be
designed to ensure there is ample room to build a house and non-water dependent
accessory structures outside of the floodplain. The goal is to maintain the 100-year
floodplain in a natural state.
The Board asked for further information about the subdivision redesign, Mr. Paradise
stated the floodplain affects 24 properties and will not result in a loss all of 24 lots.
Discussion occurred on the Traffic Impact Analysis (TIA). Mr. Paradise spoke regarding the
gravity model and how there are certain land uses like Wal-Mart that will attract traffic.
Secretary Storozuk asked about the Transportation Planning Organization (TPO) and the
need to expand Doyle Rd. Mr. Paradise stated the TPO would be a logical partner to help
with some of the work needed and explained it is difficult to fund capacity projects through
the TPO.
The Board stated they wanted to see the redesign with the 24 lots being moved out of the
floodplain.
Mark Watts, Cobb Cole, 231 Woodland Blvd., Deland, presented a PowerPoint
presentation on Ordinance No. 06-2020. He displayed data on previously approved
subdivisions with small lots and the density at Kove Estates. Mr. Watts spoke regarding the
Osteen Joint Planning Agreement (JPA) and having to readjust the adjacent property to the
west to come back with the density required by the County and the requirements of the JPA.
He spoke about the floodplain requirements within the Land Development Code and
Comprehensive Plan. He stated the redesign with the 24 lots being moved out of the
floodplain is agreeable.
Secretary Storozuk asked about the pioneer agreement and who would pay for the
extension of the utilities to this area. Mr. Watts explained the first user of the utility
infrastructure would be responsible for installation, but when other users connect, they would
be required to reimburse the first user.

Discussion occurred between Secretary Storozuk, Mr. Paradise, and Mr. Watts about
capacity, if the City's water treatment plants could handle this type of growth, and the review
process. Mr. Paradise stated capacity is available.
Secretary Storozuk voiced concerns regarding the Planning and Zoning votes on the
Comprehensive Plan Amendment and how the City Commission voted afterward. He and
Mr. Watts spoke about the disconnect between the two bodies, volunteering time, and
hearing the resident's concerns.
Member Munoz asked about the options given in the staff report to recommend approval of
the submitted project and the approval of the redesigned project.
Mr. Watts spoke regarding the warranted traffic signal at the intersection of SR415 and
Enterprise Osteen Road. He spoke on changing the deadline for traffic light requirements
due to a shortage of supplies because of COVID. He explained taking the lots out of the
floodplain would be feasible.
Member Northey applauded Mr. Paradise for the well written staff report. She spoke
regarding the Board previously denying the Comprehensive Plan Amendment because it
was an inappropriate change. Member Northey stated putting 221 units in a rural residential
area is changing the character of the neighborhood and it is not appropriate to put this in a
rural residential area.
Mr. Watts spoke regarding the density in the area. He spoke about the high intensity plan
that is in the Comprehensive Plan, and how this project would allow a transition between
rural and high intensity/density planned for the SR415 corridor.
Chairperson Putkowski opened the public forum.
Carl J. Hopf Jr., Enterprise, retired law enforcement officer, has lived in Enterprise for 33
years and moved away from Altamonte Springs to get away from development. He believes
the project to be over-development. He expressed concerns regarding traffic.
Bob Sayre, 1840 Turtle Hill Rd., Enterprise, stated he moved from Orlando to get away from
subdivisions like this. He stated he just received the Florida Department of Transportations
Economic Assessment of the River Lakes Quarter final report prepared by the Florida
Department of Transportation District 5. Mr. Sayre stated the report was produced under
contract by the Florida Research Center at the University of Florida. He spoke about the
areas of interest presented in the report.
City Attorney Segal-George was asked by the Chairperson to swear in Mr. Yeagle since he
wasn't present before.
Jim Yeagle, 308 Lake View Dr., Kove Estates, spoke regarding the TIA and presented the
number of accidents and deaths cited from the Florida Highway Patrol and Volusia County

Sheriffs Office. He stated there have been 136 accidents and 90 accidents with injuries
involved. Mr. Yeagle asked for an accident model to be done to see the impact of the
project on public safety. He spoke about the destruction of the wetlands, forest, woods,
wildlife habitat, and ecosystem.
Chairperson Putkowski stated the Board is a recommendation Board and the City
Commission is the deciding body.
Glenda Ross, 80 Bethel Loop Cir., Enterprise, stated there are policies to development
within the floodplain area. She stated the rezoning is not consistent with City policy, stating
half of the property is in the floodplain. She spoke about the current character of the area is
rural, and she obtained 800 signatures, who are against this change. She spoke regarding
new homes being built on Doyle Road.
Janice Graves, 500 Lemon Bluff Rd., Osteen, spoke in opposition because there are
environmental inconsistencies. She continued regarding the future housing needs and the
homes currently being built. She spoke regarding population projection versus what's
entitled and under review. She spoke about Thalita Terrace, Enrico Ridge, and Eloah
Estates being multifamily projects by developer, D32, which the final site plan has been
submitted or a Development Order has been issued.
Member Storozuk expressed concerns about the public forum being limited to two (2)
minutes.
Wanda Van Dam, 932 Indian Hammock Dr., Osteen, stated adding 200 homes to this
property is not a good idea. She stated the residents live there, and drive the road daily so
it's their responsibility to try to convey to the Board why the residents feel this way. She
asked the Board to look at the current development pattern and realize the area has
maintained a large lot, acreage oriented, residential plots for agricultural uses. She stated
the County Urban Low Intensity future land use designation was assigned to this area in
1990. She asked the Board to look at the two components that are mentioned multiple
times in the Future Land Use Element, compatibility, and character.
Chairperson Putkowski closed the public forum. He asked to get the time extended for
citizens to speak, to mirror the City Commission public forum.
Mr. Watts stated, as recommended in the staff report, there will be required improvements
to the road system. He spoke regarding preserving natural vegetation, having large buffers,
and the conservation area to the south. He stated it is appropriate to make this a
transitional area for the more intense use of the adjacent property, which could have up to
eight (8) units an acre. He spoke on property rights, population growth, and the existing JPA
density.
Alternate Trombetta and Mr. Watts discussed the average sale prices of the homes and
urban sprawl.

Secretary Storozuk and Mr. Watts discussed traffic, surrounding neighbors, and jobs
available in Deltona.
Alternate Rodriguez spoke about the resident's concerns and the developer's rights.
Motion by Ruben Munoz, seconded by Manuel Rodriguez, to
recommend the City Commission approve Ordinance No. 06-2020 -
Amending the official Zoning Map to rezone ±110.43 acres of land
located on the south side of Enterprise Osteen Road from County Prime
Agriculture (A-1) to City of Deltona Residential Planned Unit
Development (RPUD) with conditions. The motion failed by the
following vote:
For: 2 - Member Munoz and Alternate Rodriguez
Against: 5 - Chair Putkowski, Secretary Storozuk, Member Bowman,
Member Northey and Alternate Trombetta
Motion by Jody Lee Storozuk, seconded by Michael Putkowski, to
recommend the City Commission deny Ordinance No. 06-2020 -
Amending the official Zoning Map to rezone ±110.43 acres of land

applicant bring back on paper, what the new development would look
like with the 24 lots redesigned. The motion carried the following vote:

Mr. Paradise wished everyone to have a great holiday.
9. BOARD/COMMITTEE MEMBERS COMMENTS:
Member Northey attended the Volusia County meeting about the Osteen local plan and
stated Volusia County wants the City to participate in a planning exercise.
Member Trombetta stated it seems like the plan was not done and it was tabled due to this.
Member Munoz expressed concern about the public forum time limit.
