1. CALL TO ORDER:
The meeting was called to order at 6:00 pm.
2. ROLL CALL:

3. APPROVAL OF MINUTES & AGENDA:
A. Minutes of November 2022
Minutes to be filed as presented, per Chair Northey.
4. PRESENTATIONS/AWARDS/REPORTS:
None.
5. PUBLIC FORUM: Time permitted, public comments shall be limited to items
on the agenda and shall not exceed two minutes. Please be courteous and
respectful of the views of others. Personal attacks on Committee/Board
members, City staff or members of the public are not allowed and will be ruled
out of order by the Chair.
Chair Northey opened and closed public forum as there was none.

7. NEW BUSINESS:
A. Resolution No. 2023-04 - A Resolution of City of Deltona, Florida;
granting a Conditional Use to permit a child care center within an
R1,Single-Family District for the property located at 2300 Howland
Boulevard.
Ms. Suazo presented a PowerPoint presentation on Resolution No. 2023-04 for a Child
Care Center to be located at 2300 Howland Boulevard. She showed the Board the
location, background, and details of the application. She explained the internal
circulation to ensure traffic would flow and not back-up, and showed the Board the
location of the new dumpster.
Ms. Corkins explained she is a resident in Deltona and has operated a daycare for over
17 years. She stated this is an opportunity for the community because there is a lack of
daycares in Deltona.
Discussion occurred regarding the Conditional Use application process and the history
of the building.
Motion by Eric Alexander, seconded by Ruben Munoz, to recommend the
City Commission approved Resolution No. 2023-04 granting a
Conditional Use to permit a child care center within an R1, Single-Family
District for the property located at 2300 Howland Boulevard with the five
(5) conditions stated before. The motion carried by the following vote:
For: 6 - Chair Northey, Member Alexander, Member Berk, Member
Munoz, Alternate Cardo and Chair Gonzalez
B. Resolution No. 2023-01 - A resolution of City of Deltona, Florida; granting
a Conditional Use to permit a private school within the Professional
Business (PB) for a property located at 689 Deltona Boulevard.
Mr. Ruiz gave a PowerPoint presentation on Conditional Use request application
CU22-0006, Resolution No. 2023-01, for a repurpose of the site located at 689 Deltona
Boulevard. He explained the applicant is requesting permission to use the site at 689
Deltona Boulevard as a private school within the Professional Business (PB) Zoning
District, which requires a Conditional Use application.
Mr. Ruiz explained this is an existing non-conforming structure within the PB zoning
which requires a 50-foot setback from all property lines for private school uses. This
property only affords a 15-foot side and rear setbacks. Staff supports the waiving of this
requirement, which would be done with the approval of the Resolution.
Mr. Ruiz spoke regarding the daily trips, internal circulation, off-street parking, and the
dumpster enclosure.

Mr. Ruiz stated staff recommends the Planning and Zoning Board recommend the City
Commission approve Resolution No. 2023-01, granting a Conditional Use for the private
school use to be located at 689 Deltona Boulevard with the following added conditions:
1. A maximum occupancy of 50 students with 10 staff has been approved. If the
occupancy load proposes to exceed 50 students with 10 staff, a new
Conditional Use application shall be submitted to the Planning and
Development Services Department for determination of an expansion to the
Conditional Use by the DRC, to ensure there is adequate parking for the
occupancy increase, prior to processing a new Conditional Use application.
2. The private school must meet all applicable Florida Statute requirements.
3. A new Business Tax Receipt is required for 689 Deltona Boulevard.
4. The site shall conform to the approved Site Plan Construction Drawings,
Development Order, and other related documents for this project.
5. A Change of Use permit application is required for the new educational
occupancy use.
Member Munoz asked about the connection on Lullwater Street. Mr. Ruiz explained the
circulation around the neighborhood.
Alternate Member Cardo asked what improvements would be made to the parking lot.
She asked if the applicant would be required to add a fence to the east property line to
separate from the residents.
Mr. Ruiz stated the applicant would add curbs, a new access point to the north, ADA
spaces, a dumpster enclosure, drop off area, and landscaping buffers.
Mr. Posey spoke regarding the application.
Discussion occurred regarding the dumpster location.
John MacDonald, owns building to the south, but lives in Deland, explained he has a
concerns of stacking traffic on Hazel Crest Street. Mr. Paradise explained the circulation
is done to ensure this does not happen. Mr. MacDonald asked if there would be
adequate parking to ensure there will never be stacking on his property.
Mr. Posey explained parking in the right of way is not allowed, per the City's Land
Development Code.
Motion by Susan Berk, seconded by Member Gonzalez, to recommend
the City Commission approve Resolution No. 2023-01 granting a
Conditional Use to permit a private school within the Professional
Business (PB) for a property located at 689 Deltona Boulevard with the
conditions stated and to include a fence along the rear boundary of the
property. The motion carried by the following vote:

8. STAFF COMMENTS:
Chair Berk thanks both Commissioners JodyLee and Burbank for coming in and for their
past service on the Planning and Zoning Board.
She asked for an update on the moratorium.
9. BOARD/COMMITTEE MEMBERS COMMENTS:
Member Berk thanked Mr. Paradise for all of his work.
10. ADJOURNMENT:
