CALL TO ORDER: The meeting was called to order at 2:00 p.m. by Special Magistrate Reischmann. 2. ROLL CALL: Special Magistrate William E. Reischmann Jr. present. Reischmann Jr. Mr. Reischmann has taken Judicial Notice of all City of Deltona Ordinances, State Statutes, Florida Building and Fire Codes and the International Property Maintenance Code. 5. DISCLOSURE OF EX PARTE COMMUNICATIONS: None. 6. SWEARING IN OF OFFICERS AND WITNESSES: Special Magistrate William E. Reischmann swore in all that were present to testify. 7. APPEAL OF DANGEROUS DOG CLASSIFICATION: A. ANML21-0908 Appeal of Dangerous Dog Classification Animal Owner: Tonia La Faye Edwards Address: 1411 Ambassador Avenue, Deltona, Florida 32725 Parcel No.: 813030170110 City of Deltona Page 1 Printed on 10/28/2021 Special Magistrate Minutes June 7, 2021 Violation: Florida State Statute 767.11, Section 767.12 and City of Deltona Code of Ordinances Section 14-166 (d) (Dangerous Dog) - Officer Steve Braukhoff. Special Magistrate found that based on the testimony given by Animal Control staff, witnesses, and by the dog owner, Tonia La Faye Edwards, there is insufficient cause to classify the small-medium size brown dog as dangerous and therefore overturns the initial Determination made by the Animal Control Authority. The appeal is sustained. Tonia La Faye Edwards, Byron Prey and Breanna Bentley were present. 8. DISCUSSION: 9.
