After determining that a quorum is present, the Public Utilities Board of the City of Denton, Texas will
convene in a meeting on Monday, September 12, 2016 at 9:00 a.m. in the Service Center Training
Room at the City of Denton Service Center, 901-A Texas Street, Denton, Texas at which the following
items will be considered:
The Public Utilities Board (PUB) will convene in a Closed Meeting to consider specific items when
these items are listed below under the Closed Meeting section of this agenda. When items for
consideration are not listed under the Closed Meeting section of the agenda, the PUB will not conduct a
Closed Meeting and will immediately convene its open meeting. The PUB reserves the right to
adjourn into a Closed Meeting on any item on its open meeting agenda consistent with Chapter 551 of
the Texas Government Code, as amended, or as otherwise allowed by law.
CLOSED MEETING
A. PUB16-171 Deliberations Regarding Certain Public Power Utilities: Competitive Matters -
Under Texas Government Code Section 551.086.
Receive a presentation from Denton Municipal Electric staff (“DME”) regarding
public power competitive and financial matters pertaining to plans, strategies,
opportunities, and developments for generation improvements to the DME system;
discuss and deliberate strategies regarding same; discuss and deliberate
opportunities and strategies for the City to acquire purchased power and enter into
agreements regarding the same, in order to meet its future energy needs. Discuss,
deliberate and provide Staff with direction.
B. PUB16-188 Certain Public Power Utilities: Competitive Matters - Under Texas Government
Code Sec. 551.086.
Receive competitive public power electric information, including financial
information from staff pertaining to Denton Municipal Electric (“DME”) electric
service rate issues and strategies, including without limitation, the Energy Cost
Adjustment (“ECA”), Renewable Cost Adjustment (“RCA”), and Transmission
Cost Recovery Factor (TCRF) rates and other related matters; and discuss,
deliberate, provide Staff with direction, consider, and determine policy regarding
such matters.
C. PUB16-196 Deliberations Regarding Certain Public Power Utilities: Competitive Matters -
Under Texas Government Code Section 551.086.
Receive competitive public power information and competitive financial
information from staff regarding an amendment to the operating budget for Denton
Municipal Electric (“DME”) for FY 2015-2016, including without limitation,

revenues, expenses, and commodity volumes; and discuss, deliberate, provide staff
with direction regarding such matters, consider, and make a recommendation to City
Council regarding approval of the amendment to the FY 2015-2016 DME operating
budget.
ANY FINAL ACTION, DECISION, OR VOTE ON A MATTER DELIBERATED IN A CLOSED
MEETING WILL ONLY BE TAKEN IN AN OPEN MEETING THAT IS HELD IN COMPLIANCE
WITH TEXAS GOVERNMENT CODE, CHAPTER 551, EXCEPT TO THE EXTENT SUCH FINAL
ACTION, DECISION, OR VOTE IS TAKEN IN THE CLOSED MEETING IN ACCORDANCE
WITH THE PROVISIONS OF §551.086 OF THE TEXAS GOVERNMENT CODE (THE ‘PUBLIC
POWER EXCEPTION’). THE PUBLIC UTILITIES BOARD RESERVES THE RIGHT TO
ADJOURN INTO A CLOSED MEETING OR EXECUTIVE SESSION AS AUTHORIZED BY TEX.
GOV’T. CODE, §551.001, ET SEQ. (THE TEXAS OPEN MEETINGS ACT) ON ANY ITEM ON ITS
OPEN MEETING AGENDA OR TO RECONVENE IN A CONTINUATION OF THE CLOSED
MEETING ON THE CLOSED MEETING ITEMS NOTED ABOVE, IN ACCORDANCE WITH THE
TEXAS OPEN MEETINGS ACT, INCLUDING, WITHOUT LIMITATION §551.071-551.086 OF
THE TEXAS OPEN MEETINGS ACT.
REGULAR MEETING
Following the completion of the Closed Meeting, the Public Utilities Board will convene in a Regular
Meeting at which the following items will be considered:
CONSENT AGENDA
Each of these items is recommended by the Staff and approval thereof will be strictly on the basis of
the Staff recommendations. Approval of the Consent Agenda authorizes the Assistant City Manager
of Utilities or his designee to implement each item in accordance with the Staff recommendations.
The Public Utilities Board has received background information and has had an opportunity to raise
questions regarding these items prior to consideration.
Listed below are bids, purchase orders, contracts, and other items to be approved for payment of
other action under the Consent Agenda (Agenda Items A – I). This listing is provided on the Consent
Agenda to allow Public Utilities Board Members to discuss or withdraw an item prior to approval of
the Consent Agenda. If no items are pulled, Consent Agenda Items A – I below will be approved
with one motion. If items are pulled for separate discussion, they may be considered as the first items
following approval of the Consent Agenda.
A. PUB16-199 Consider recommending approval of a Standard Utility Agreement U14818, an
Advance Funding Agreement for Voluntary Utility Relocation and related
documents for IH-35E, between Mayhill Rd. and Loop 288 (CSJ No. 0196-01-106),
between the City of Denton and the Texas Department of Transportation (TxDOT),
for the relocation and betterment of a City water line along the I-35E right-of-way
near Brinker Rd. and to include the water line relocation construction in TxDOT’s
roadway project contract.

B. PUB16-201 Consider recommending adoption of an ordinance approving a Pipeline Crossing
contract by and between the City of Denton, Texas and the Kansas City Southern
Railway Company relating to the location of a water pipeline within railroad
right-of-way, located at mile post D-105.10, Alliance Subdivision within the County

C. PUB16-202 Consider recommending approval of a Professional Services Agreement (PSA) with
Solutient GeoSciences, Inc., of Tyler, Texas, for hydrogeological and analytical
consulting services regarding the City's landfill monitoring and reporting
requirements for a three year period, in a total amount not to exceed $304,961 (PSA
6231).

D. PUB16-203 Consider a recommendation that the City Council adopt an ordinance of the City of
Denton, Texas authorizing the City Manager to execute a Third Supplement to a
Professional Services Agreement by and between the City of Denton, Texas and the
law firm of Cole Schotz, P.C., Dallas, Texas for legal services relating to
transactional and regulatory work pertaining to the Texas Municipal Power Agency;
providing for additional expenditure agency of not-to-exceed $400,000; providing
an effective date. (File 5380 in the additional amount not-to-exceed $400,000,
aggregating a total not-to-exceed $799,500).

E. PUB16-204 Consider recommending approval of awarding a Software Perpetual Licensing
Agreement that allows Denton Municipal Electric to provide an Online Customer
Dashboard for all customers to PicoTera Systems, based on proposal evaluation
criteria, as provided for in the Request for Proposal #6067 in the amount not to
exceed $225,000 over a three year term.

F. PUB16-205 Consider recommending the City Council adopt an ordinance of the City of Denton
authorizing the City Manager or his designee to execute a contract through the
National IPA Purchasing Network for the acquisition of one (1) 2014 CAT model
MH3037 material handler for the City of Denton Solid Waste Department; and
providing an effective date (File 6224-awarded to Holt CAT in the amount of
$455,584.49).

G. PUB16-206 Consider recommending the City Council adopt an ordinance of the City of Denton
authorizing the City Manager or his designee to execute a contract through the
Buyboard Cooperative Purchasing Network for the acquisition of one (1) 2014
Elgin model Broom Badger street sweeper for the City of Denton Solid Waste
Department; and providing an effective date (File 6225-awarded to Kinloch
Equipment & Supply, Inc. in the amount of $169,000).

dry pit submersible pumps for the Raw Sewage Pump Station Number 2 at the
