RESULT: Carried MOVER: Christopher Mosley SECONDER: Lindsay Dearduff Page 2 of 6 Page 4 of 17 AYES: Greg Anderson, Jennifer Brown, Lindsay Dearduff, KJ Jeffery, and Christopher Mosley ABSENT: Jason Weber d) Development Manager Report BACKGROUND: Current Period Year to Date Previous YTD March - April Derby Business Requests for 28 66 63 Assistance New Business and other 36 35 16 Requests for Assistance Development Highlights: • 557 businesses are currently registered for 2020; 35 businesses are currently pending renewal. • Discussed business development plans and expansion ideas with 2 prospects. • Worked with the Assistant City Planner on 2 vacation requests. o City Council approved a request for vacation of an alley located in the West End, at the April 28 council meeting. ▪ The alley vacated is between Madison Ave. and Market St., west of Water St. and east of River St. ▪ The vacation was necessary to facilitate expansion of BG Products. o Staff is working to facilitate vacation of a second alley also in the West End. • Provided demographic and west end development investment information to a real estate property management company. • Provided COVID-19 correspondence to businesses. • Attended Go-To-Meeting for quarterly Economic Development Officers meeting. • Worked with staff to develop a proposal to waive or reduce fees associated with redevelopment in existing areas developed prior to 1996. o In 2015, following adoption of the West End Development Plan, the City Council reduced several development fees for projects in the West End and Buckner Business District. o The changes, passed unanimously by the Council on April 28th, expand both the type of fees being waived/reduced and the geographical area to which the reductions apply. o Planning approvals such as zone changes and variances are common in redevelopment and the fees result in up front costs prior to the availability of construction funding. A comprehensive list of the waived/reduced fees is included in the attached council Page 3 of 6 Page 5 of 17 action report. • Recognizing the impacts of COVID-19 on local businesses, the City Council also voted to waive business registration fees for 2021, due in December of 2020. o Businesses will still be required to register, which provides the City with important emergency contact information, but the registration fee ($20) will be waived. o Staff is also working with its permitting software vendor (Energov) to allow businesses to register and pay online. This effort is a direct result of feedback from local businesses. Marcia Hartman, Development Manager presented the Development Manager report. Chris Mosley, Board Chair asked about local businesses wanting to expand and if those businesses can be identified in the report. Hartman explained that the report will indicate when there are prospects inquiring about development and expansion but the report will not identify who the prospect is, whether local or non-local. Mosley asked how businesses will be notified about the waived and reduced fees that Council approved at their meeting April 28, 2020. Hartman replied that several methods will be used. One process will include creating a new brochure to advertise the waived & reduced fees that promote reinvestment and redevelopment; another method will be to notify registered businesses through the monthly news update email. In addition, business and property owners who submit applications for redevelopment who would normally incur those fees will be advised of changes to the fee resolution at that time. Mosley asked how much response was received from businesses needing help with navigating all the resources made available to assist with the COVID- 19 pandemic. Hartman replied that she initially received a high volume of phone calls and emails from small business owners asking for additional assistance with navigating the SBA and Department of Commerce websites. As more updates became available businesses were able to get the answers they needed. Hartman added that businesses continue to reach out to her daily for assistance but the volume was not as high. K.J. Jeffery, Board member added that banks incurred multiple challenges in processing applications. He said they struggled with changes made to the applications and that it created issues for customers. There were many questions about how the loans would be forgiven and many other questions posed that still needed to be addressed. He indicated that there continued to be challenges, however the second round of loan applications went smoother than the first round. Jeffery said the average loan size dropped dramatically but said many businesses who were unable to receive funds in the first round were trying to apply for loans offered in the second round of funding. e) CDAB Orientation Manual BACKGROUND: • City staff prepares orientation manuals to support the efforts of individuals who serve on the community’s many boards. Page 4 of 6 Page 6 of 17 • The board orientation manual is intended to help board members better understand their role in the organization. • The orientation manual provides information regarding the purpose of the board, general responsibilities and operating procedures, attendance, communications and open meetings law. It also serves to build a working relationship among board members that promotes ongoing support and comes to an agreement on how they will carry out their work. • The intent of the orientation manual is to get board members up to speed on the information they need to know so they can do the best job they can while serving. Marcia Hartman, Development Manager reviewed the CDAB orientation manual with members. She explained that the manual was created to assist board members in understanding the purpose of the Community Development Advisory Board, general responsibilities, confidentiality provisions, the role of the staff liaison and open meetings law. Hartman stated that compliance with the Kansas Open Meetings Act (KOMA) was an important aspect of board meetings. She asked members if they had any questions. Chris Mosley, Board Chair asked if the board could request a special meeting to discuss CDAB appropriate items needing to be addressed. Hartman replied yes. Jennifer Brown, Board member asked if the Community Development Advisory Board had met since the May 2019 meeting. Hartman replied no and said that the CDAB meets on the scheduled board meeting dates when there is an agenda item to discuss. There were no agenda items for the remainder of the 2019-2020 schedule. Agenda items that are scheduled for meetings include such things as reviewing economic development incentive requests and updating the Economic Development Plan. The current 2019-2021 Economic Development Plan was approved in December 2018 and will be reviewed again next year. Mosley mentioned his participation on the Derby Vision 2040 Steering Committee and the work they are doing to update the City's Comprehensive Plan. The Comp Plan is a mechanism that looks at the future direction for Derby and guides the City's decision-making and land use over 10-20 years. He explained that the Economic Development Plan correlates to the Comp Plan through some of these decision-making processes. Hartman added that the Planning staff is finalizing work with RDG Planning & Design and the plan steering committee and may have a completion date by the end of summer. 5 ANNOUNCEMENTS Chris Mosley, Board Chair asked if there were any announcements. The KOMA statutes state that "a representative government is dependent upon an informed electorate." o The general rules found in KOMA are not absolute; practical exceptions are incorporated into the laws. • Compliance with these laws is necessary to avoid legal challenges to official actions. • The City Attorney will attend the meeting to introduce and review open meetings laws with CDAB members. Page 11 of 17 Page 12 of 17 New Business Item Subject: Economic Development Plan Review Meeting: Community Development Advisory Board - 04 Nov 2020 Presented by: Marcia Hartman, Development Manager BACKGROUND: • Every three years, the City Council adopts an Economic Development Plan, which is used to guide and accomplish economic development efforts. • Part of the Community Development Advisory Board's (CDAB) mission is to monitor and maintain the plan. • The current plan was developed for use from 2019 to 2021. • Throughout 2021, staff will begin to draft a new plan and present updates to CDAB at meetings, with a final draft anticipated to be presented at the November meeting. • CDAB's recommendation for the 2022-2024 Economic Development plan will be scheduled for Council consideration in December 2021. POLICY IMPLICATIONS: • CDAB members should review the plan and provide staff with feedback for use in updating the plan. RECOMMENDED MOTION: • Direct staff to begin work to update the City's Economic Development Plan and present recommendations and a draft plan to the CDAB for consideration. The six-member board meets quarterly. Five members serve a two-year term.
