WORKSHOP DISCUSSION 3.A. Cody Bird, City Planner provided background information regarding a recent U.S. Supreme Court ruling from June 2015 that impacts Derby’s current sign regulations. He explained that the Court’s decision in Reed v. Town of Gilbert, AZ ruled that governmental regulations could not impose content- based speech restrictions. Bird explained the distinction between content- neutral restrictions and content-based restrictions and provided some examples. Commissioners asked for specifics involved in the Reed decision. Bird explained that the Reed case involved a sign code which defined “political signs,” “ideological signs” and “direction signs” and treated the sign types differently with regard to the number, size and placement. The Court’s decision said that a sign regulation is content-based if an official has to read the sign in order to enforce the regulations.
