• North-south alley between Washington Ave. and Kay St., west of Buckner
St., and east of Water St. (location map attached).
Applicant:
• City of Derby
Reason for Request:
• Vacate unused alley right-of-way in order to facilitate more efficient land
development by aggregating lots, as recommended in the West End
Development Plan.
Background Information:
• One recommendation of the West End Development Plan is to vacate
undeveloped and unutilized alleys to allow for lots to be aggregated into
larger lots. One of the alleys the plan recommended for vacation is the
alley between Washington Ave and Kay St., west of Buckner St. and east
of Water St.
o The 20 ft. wide alley right-of-way was platted with the original Town
Plat of El Paso in 1871. It is currently not utilized as an alley.
o City staff notified adjacent property owners that the alley was being
considered for vacation in March 2021 and requested feedback.
The original intent was to vacate the entire alley from Washington
St. south to its end (south of Kay St.). Property owners expressed
concern that vacating the alley south of Kay St. would eliminate
access to some properties. Property owners were supportive of
vacating the portion of the alley between Washington Ave. and Kay
St.
o City staff re-notified owners that the City planned to proceed with
the vacation of the alley between Washington Ave. and Kay St. but
not vacate the alley south of Kay St., in order to preserve access to
those properties.
o City staff also coordinated with private utility agencies to determine
which alleys are utilized to provide utility service. Based on the
feedback provided by AT&T, Cox Communications, Evergy, and
Kansas Gas Service, the alleys proposed for vacation do not
include any existing utility lines.
• KSA 12-506 requires vacated right-of-way to revert to the properties from
which it was originally platted.
o Properties to the east and west of the alley are part of the original
town plat of El Paso, from which the alley was originally platted. If
the vacation is approved, each property owner will acquire one-half
(10 ft.) of the alley right-of-way adjacent to their property.
o A map (attached) was sent to owners of property within the
notification area showing the properties to which ownership of the
alley will revert if the vacation is approved.
LEGAL CONSIDERATIONS:
• KSA 12-505 requires the Planning Commission to consider specific
findings of fact which serve as the basis for the Commission's
recommendation to the City Council. These findings are as follows:
o Notice of petition to vacate and notice of the public hearing has
been given in accordance with State law;

o No private rights will be injured or endangered if the vacation is
granted;
o The Public will suffer no loss or inconvenience if the vacation is
granted; and
o In justice to the petitioner, the vacation should be granted.
• At the conclusion of the public hearing, the Planning Commission should
adopt a resolution stating its recommendation, with or without conditions,
and announce the date upon which the City Council will consider the
vacation.
o A draft resolution has been prepared by staff based upon staff's
review of the vacation request.
o The Planning Commission may instruct staff to modify the
resolution as necessary to reflect the decision of the Commission.
FINDINGS OF FACT:
1. Notice of petition to vacate and notice of public hearing has been given in
accordance with State law:
o Notice was published in the City's official newspaper on June 9,
2021.
o Official notice was mailed to property owners within the required
notification area on June 4, 2021.
o Signs advertising the public hearing were placed on each end of the
subject alley right-of-ways on June 4, 2021.
2. No private rights will be injured or inconvenienced if the vacation is
granted:
o Private utility agencies were notified prior to and during the formal
vacation process. Because there are no existing utility lines in the
subject alley right-of-ways, no easement dedications are required.
o Owners of property abutting the alleys will not be injured or
inconvenienced if the vacation is granted. The right-of-ways are not
developed as functioning alleys, lacking pavement or a traversable
surface. Abutting properties have legal access to adjacent public
streets and do not take access from the alleys.
3. The Public will suffer no loss or inconvenience if the vacation is granted:
o There are no public sanitary sewer, water, or stormwater sewer
lines in the alleys.
o Derby Fire and Rescue does not object to the vacation.
o Staff has not received any additional inquiries or comments after
mailing of the public hearing notification. The Commission will need
to consider any testimony provided during the public hearing.
4. In justice to the petitioner, the vacation should be granted:
o Vacating the alley will allow greater use of the area.
o There are no conflicts with private or public utilities.
POLICY IMPLICATIONS:
• The vacation is consistent with the goals of the the West End
Development Plan and allows properties to be combined to facilitate
development and redevelopment.

PUBLIC HEARING OPEN
Commissioner Adams opened the public hearing and determined that a quorum
was present. Adams asked if proper notice had been given.
Everett Haynes, Assistant City Planner announced that proper notice had
been given in accordance with State law.
Adams asked commissioners to report any ex parte communications. There
were no ex parte communications reported.
Haynes introduced the agenda item.
Adams asked if anyone had signed up to speak at the public hearing. Seeing
none, the public hearing was closed.

Adams asked staff to present the Findings of Fact.
Haynes presented the Findings of Fact provided in the written staff report.

items: a vacation of a platted building setback and presentation of the Capital
Improvements Plan.
Adams asked if any Commissioners anticipated being absent from the July 15

General Location:

Applicant/Agent:
• Applicant: BG Real Estate Inc.

Reason for Request:
• Vacate a 20 ft. platted building setback to facilitate the expansion of BG Products.
Background Information:
• The applicant is requesting vacation of a 20 ft. wide platted building setback along the east
property line to facilitate the expansion of the building and business operations (vacation
exhibit and application statement attached). The expansion project requires several approvals
including two vacations, site plan review, and building plan review.
o The platted setback is identified on the Derby Industrial Park plat. The property was
originally platted in 1980.
o The setback was originally platted adjacent to an alley. The alley right-of-way was
vacated in April 2020. As the proposed building expansion would encroach into the
setback, the setback must also be vacated.
o The setback was not vacated with the alley because the alley vacation was initiated by
the City and the property owner must request vacation of the setback.
o Site plan review and building plan review will follow the requested vacation.
LEGAL CONSIDERATIONS:

▪ AT&T has indicated there is an existing fiber service line that serves BG's
machine shop within the building setback. AT&T does not object to the proposed
vacation but has indicated that any relocation of this fiber service line will be at
the expense of the applicant.
3. The Public will suffer no loss or inconvenience if the vacation is granted:
o There are no public sanitary sewer, water, or stormwater sewer lines in the setback.
o Derby Fire and Rescue does not object to the vacation.
o Staff has not received any inquiries or comments from the public or adjacent property
owners regarding the vacation. The Planning Commission will need to consider any
testimony provided during the public hearing.
4. In justice to the petitioner, the vacation should be granted:
o Vacating the setback will allow greater use of the property by permitting the expansion
of the existing facility.
o There are no conflicts with private or public utilities.
o The vacation is consistent with the goals of the West End Development Plan by
supporting the expansion of an existing business and redevelopment of the area.
RECOMMENDED MOTION:
• Adopt a resolution recommending vacation of a platted 20 ft. building setback along the east
property line of Part of Lot 1, Block A, Derby Industrial Park and forward the resolution to the
City Council for consideration at its regular meeting on August 24, 2021.

Purpose:
The purpose of our request is to vacate the 20 foot building setback along the
east property line of Lot 1, Block A, Derby Industrial Park Addition to allow for expansion
of the existing facility.
Private Rights:
There will be no private rights infringed upon with this vacation as the final
development will still comply with the zoning regulations of the M1 District.
Public Loss:
The proposed vacation will not create a loss to the public as it does not impact
any public entity and the zoning regulations will still be followed with this development.
Hardship:
Supporting local business is critical for continued community growth and
success. If this vacation case is denied then the owner will have to consider
reconfiguration or relocation for their expansion which will cost additional time and
money. Expansions of this nature are encouraged in the City's adopted West End
Study.

A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF DERBY, KANSAS RECOMMENDING THAT THE GOVERNING
BODY OF THE CITY OF DERBY GRANT A REQUEST FOR VACATION
OF A PLATTED 20-FOOT-WIDE BUILDING SETBACK ALONG THE
EAST LINE OF PART OF LOT 1, BLOCK A, DERBY INDUSTRIAL PARK,
DERBY, SEDGWICK COUNTY, KANSAS.
WHEREAS, K.S.A., 12-504, et seq., provides a procedure for the City’s Planning
Commission to consider the vacation of certain plats, streets, easements or reservations; and
WHEREAS, the Applicant has initiated vacation of the following described platted building
setback:
The East 20 feet of a piece of property described in the Warranty Deed recorded on Film
2960 Page 1700 as: Part of Lot 1, Block A, Derby Industrial Park, an Addition to Derby,
Sedgwick County, Kansas described as: Commencing at the Southwest corner thereof;
thence Northerly along the West line of said Lot 1, 306.06 feet for a place of beginning;
thence continuing Northerly along the West line of said Lot 1, 276.77 feet; thence East
parallel with the South line of said Lot 1; 272.60 feet to the East line of said Lot 1; thence
South along the East line of said Lot 1, 275 feet; thence West 244.28 feet to the point of
beginning.
WHEREAS, vacating platted building setbacks requires a public hearing process for the
City to consider whether said vacation request is acceptable; and
WHEREAS, on July 15, 2021 and in compliance with K.S.A. 12-504, et seq., the Derby
Planning Commission held a public hearing to consider the above-described request to vacate the
platted building setback; and
WHEREAS, K.S.A. 12-505 provides that no vacation shall be granted if a written objection
thereto is filed with the City Clerk, at the time of the hearing, by any owner or adjoining owner who
would be a proper party to the petition but has not joined therein; and
WHEREAS, no such written objections to the vacation were filed with the City Clerk at the
time of or before the required hearing on July 15, 2021; and
WHEREAS, K.S.A. 12-505 provides that the Planning Commission shall make a
recommendation regarding the vacation and submit such recommendation to the Governing Body;
and
WHEREAS, the City of Derby Planning Commission voted to recommend approval of the
vacation to the Governing Body.
NOW THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Derby, Kansas that:

Section 4. Severability. Should any section, clause, sentence, or phrase of this
resolution be found to be unconstitutional or is otherwise held invalid by any court of competent
jurisdiction, such invalidity shall not affect the validity of any remaining provisions herein.
Section 5. Effective Date. This resolution shall be effective from and after its
adoption.

Subject: Review of the 2022-2026 Capital Improvement Plan (CIP)
Meeting: Planning Commission - 15 Jul 2021

BACKGROUND:
• The Planning Commission by-laws require that the Planning Commission determine that public
improvements, facilities or utilities are consistent with the recommendations of the
Comprehensive Plan.
• Kansas statute (K.S.A. 12-748) requires the Planning Commission to report conformance or
non-conformance of each capital project with the Comprehensive Plan unless conformance of
all projects is otherwise determined by reviewing the City's Capital Improvement Plan (CIP).
• The City Manager's recommended budget, including the proposed CIP, was presented to the
City Council on July 13, 2021.
• Citizen input has been requested beginning in June and will continue until the budget is
adopted in August.
FINANCIAL/SUSTAINABILITY CONSIDERATIONS:
• The CIP is attached for review and identifies projects proposed for construction from 2022 to
2026.
• The CIP calls for expenditures in the amount of $62,914,454 during the next 5 years.
LEGAL CONSIDERATIONS:
• It is a requirement of state law (K.S.A. 12-748) and the Planning Commission by-laws to
review the City's CIP for consistency with the Comprehensive Plan.
POLICY IMPLICATIONS:
• The Comprehensive Plan provides recommended actions for development and
redevelopment within the City. Many of the recommended actions are realized through
the implementation of the CIP. Following is a list of recommended actions and the CIP
projects that correspond with each.
o Action: Retrofit existing streets for pedestrian and bicycle transportation according to the
Walkable Development Plan.

• Bike path repair and replacement
• Sidewalk gap infill and repair projects
• South Woodlawn Blvd. hike and bike path
• On-street bicycle lanes on Tall Tree Rd. and Triple Creek Dr.
