The City of Devils Lake may convene in an executive session as provided by NDCC 44-04-19.2 to consider and discuss closed or confidential records and information, negotiating strategy or negotiating instructions as provided by NDCC 44-04-19.1, 44-04-19.2, 44-04-18.4. Page 1 of 1 ORDINANCE NO. _______ AN ORDINANCE TO ESTABLISH AND REGULATE A CITY SALES, USE, AND GROSS RECEIPTS TAX UNDER THE HOME RULE CHARTER OF THE CITY OF DEVILS LAKE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DEVILS LAKE, RAMSEY COUNTY, NORTH DAKOTA: 5.24.240 – Special Permit The holder of a Qualified Alcoholic Beverage License issued pursuant North Dakota law may request the authorization by the city commission to engage in the sale of alcoholic beverages at events designated by permit, subject to the following conditions: A. The holder of the license must file with the city auditor an application on a form provided by the city auditor, no later than thirty days prior to the special event, which application must contain the following: 1. The date(s) of the special event—which may not be longer than 14 days—and any alternate date in the event of inclement weather; 2. The hours of the special event; a. As provided in Chapter 8.28, outdoor events shall not proceed past midnight and indoor events shall not proceed past one a.m., unless permission has been granted by the city commission as set out in that chapter. 3. The location of the special event; 4. The name, address and license number of the holder of the license; 5. A description of the special event, including reasons why the city commission should determine that it is a special event and issue a permit allowing the license holder to engage in the sale of alcoholic beverages; 6. Whether the special event will include a public dance, as defined in Chapter 8.28 of the Devils Lake Municipal Code, or a private dance as provided in Section 8.28.100 of the Devils Lake Municipal Code, and if so, an application for a public dance must accompany this application; 7. If the chief of police recommends that police officers be present at the special event, the license holder will be responsible for the cost of hiring those police officers to be present; B. The city commission may impose whatever restrictions or conditions it deems appropriate in granting a permit to authorize the license holder to engage in the sale of alcoholic beverages at a special event. C. To authorize the license holder to engage in the sale of alcoholic beverages at a special event, the holder of the license must obtain a permit under this section. D. Any conditions imposed by N.D.C.C. § 5-02-01.1 are incorporated by reference. Any future amendments to N.D.C.C. § 5-02-01.1 are incorporated by reference to this section. E. The license holder must hold the class of license which allows for alcohol to be sold as requested in the application in this section. F. The fee for a special permit to engage in the sale of alcoholic beverages is $25. G. For purposes of this section, a “Qualified alcoholic beverage license” means a licensee in a city or county who that imposed a city lodging and restaurant tax on July 31, 1993, who paid the tax and who continues to pay any such tax imposed by the city or county, or a licensee in a county, or a licensee in a city that did not impose a city lodging and restaurant tax on July 31, 1993, or a tribal licensee. H. Any person that dispenses, sells, or permits the consumption of alcoholic beverages in violation of this section or the conditions of a permit is guilty of a class B misdemeanor. 5.24.241 Effective Date. This Ordinance shall take effect after its passage, approval, and publication, but not prior to March 1, 2023. 5.24.242 Previous Sales Tax Ordinance Revoked All previously enacted special permit requirements under 5.24.240 are revoked as of the Effective Date.
