BOARD OF COMMISSIONERS CITY OF DOTHAN, ALABAMA REGULAR MEETING MARCH 20, 2012 The Board of Commissioners of the City of Dothan, Alabama, met in regular session in the Commission Chambers of the Roy Driggers Municipal Building at 10:00 A.M., Tuesday, March 20, 2012 with the following members present: Mayor Mike Schmitz, Associate Commissioners James H. Reading, Amos M. Newsome, Jr., Albert Kirkland, Critt Snellgrove, Taylor Barbaree and Hamp Baxley. Also present were City Manager Michael West, City Clerk Pam McCoy, Administrative Assistant Tammy Danner, who recorded the Minutes of the Meeting, and the local news media representatives. Mayor Schmitz called the meeting to order. Reverend Dr. James Moore-Grimes United Methodist Church, then led in prayer, afterwhich Commissioner Baxley led in the Pledge of Allegiance to the Flag. Commissioner Reading moved that the Minutes of the Meeting of March 6, 2012, be approved, motion seconded by Commissioner Kirkland and unanimously approved. Mayor Schmitz presented and read a proclamation, proclaiming March, 2012 as “Wiregrass Museum of Art-Youth Art Month”. Amber Henson, Wiregrass Museum of Art Tutorial Assistant and Merit Award winners for this year’s Youth Art Exhibit were present. Commissioner Reading said it has come to his attention that EEO Officer Daryl Mathews is pulling double duty; EEO and Purchasing. He said that does not need to be. City Manager West said he is in the process of changing that. Commissioner Reading said the EEO office does not need to be in this complex. He said that office needs to be independent. Commissioner Reading said he should fall under the auspices of the Mayor and Commission. He said some of the complaints will be against the City Manager and before a person can get back to his work station they will know it. Commissioner Newsome expressed appreciation to the citizens of the City of Dothan for allowing him to spend two weeks in Washington D.C. He said during the two weeks he had two sessions with Senator Sessions, two sessions with Senator Shelby and/or his staff and at least two sessions with Congresswoman Roby. Commissioner Newsome said there are a lot of things going on in Washington that you do not see every day. He said there are a lot of meetings and if you think they are not going on, travel the halls where your representatives are working. He said there is not a lot of money changing hands at this time, but optimism is still in the air. Commissioner Newsome said he will do his best to represent Dothan, not only here in Dothan, but in Washington whenever he is afforded the opportunity. He said part of the representation was with the Friends of Ft. Rucker. There are some big concerns about the possibility of two BRAC meetings. One was initially scheduled for 2013 and another in 2015. Hopefully, the 2013 realignment commission will be moved up to 2015. From that point, a second realignment may come sometime after that. Commissioner Newsome said it is very important to the people in the Wiregrass and this community to recognize the importance of Ft. Rucker to our community. He said if we do not stay alert and be proactive there could be consequences that will go into years and years to come. Commissioner Newsome said whatever you can do to insure that Ft. Rucker remains strong he would ask you to do that. In regard to the comments that Commissioner Reading passed on to the City Manager, Commissioner Newsome said we have passed those comments on to you Mr. City Manager before Daryl was hired as our EEO officer. He said hopefully, Mr. Mayor, we will get to discuss this….who the EEO works for so that the people of the City of Dothan will know the chain of command for their EEO officer. Minutes of the Board of Commissioners – March 20, 2012, continued. Commissioner Kirkland commended his neighbor and good friend Jimmy Golden for being inducted into the Sports Hall of Fame last night. He said Jimmy has had a great influence on the kids in our community. Commissioner Snellgrove said when he ran for office last summer he told the people in District 4 he wanted to stay in touch with them. He said one of the ways he wants to do that is to have a District 4 community wide meeting. He then announced that he will be at the Doug Tew Center on March 28th from 10:00 a.m. to 6:00 p.m. for anyone that wants to come by and talk about anything to do with District 4 or the city. Commissioner Snellgrove said Chief Benton and Planning Director Todd McDonald will be there also from 1:00 to 3:00. He said this will give those who work late an opportunity to come by after work or those who do not work to come by anytime. Commissioner Snellgrove asked the media to help him get the word out. Commissioner Barbaree stated that he believes the Commission is working better together than they ever have. He said it is important to have input and diversity. He expressed appreciation to the Mayor and City Manager for taking time out of their schedule last week to go out of town and try to look at possible new industry for Dothan. Commissioner Barbaree said the rumors of the Base Realignment and Closure Commission are well known by now. He said BRAC not only recommends possible changes in military installations, they target Reservist and the National Guard. He said we have already lost a headquarters element here in Dothan. Commissioner Barbaree said if you lose a headquarters element, a battalion size element of 500 people, you are losing the upper echelon of military rank, which means that you lose a lot of salary. He said we need to be careful as a commission and as a city, not to be out maneuvered by other municipalities in the state that create these super armories and move these headquarters and battalion size elements to their cities. Commissioner Barbaree said the Mayor has worked hard and has a great relationship with the Governor. He said having a National Guard or reserve unit in a city is like having an industry within an industry. Commissioner Barbaree said we cannot afford to lose those kinds of jobs because they produce income in our city. Commissioner Barbaree said it has been almost six years and those fences are still at Westgate. He said it is in a pile; it is clutter and we need to do something with it. This is the fence that was originally supposed to go up next to the Miracle Field for the Dixie Majors baseball field. Commissioner Barbaree said someone has hit it twice. He said after six years, he would think that the statue of limitations has run out on any type of lawsuit. City Attorney Len White said that action is pending; it is on the trial docket and they are objecting to us moving it. He said it is going to be up to the Judge to allow us to do that. Commissioner Barbaree said he has been out at Doug Tew with his son and people have started baseball at other parks; mosquitoes are a problem and they cannot understand why we cannot go ahead and start spraying at night around our parks. City Manager West said we have started spraying in the day time. He said we do not want to spray when there is a bunch of people in a park. Public Works Director Jerry Corbin stated that they were trying to hold out until the first of April like we normally do, but they have decided that they will start a week early. He said the spray we are using now is not like the malathion we used previously, which was kill on contact. He said it interrupts the reproductive cycle of mosquitoes so that it makes them sterile. Mr. Corbin said it is not an immediate kill even if you spray during the night, but they can change that up and see if it will help. He said they have also started putting out larvicide pellets. Mr. Corbin said we will start spraying our full normal schedule next Monday night. Commissioner Baxley expressed appreciation to Leisure Services for the great job they did with the Azalea Dogwood Trail this past weekend. He said he attended the opening ceremonies at a couple of parks over the weekend and they were well attended. Commissioner Baxley commended Mr. Corbin and his staff on the Fortner/Park intersection. He said that is a vast improvement to that intersection. Minutes of the Board of Commissioners – March 20, 2012, continued. Commissioner Barbaree expressed appreciation to the Mayor for everything he did toward economic development…..giving up all of his time to go to Monroeville. Hopefully something will come out of it. Commissioner Newsome expressed appreciation to the Mayor for what he did in getting the Korean firm here. He said this can be very powerful for this area. Commissioner Snellgrove said the intersection at Fortner and Park is a great improvement and is going to help out over there. He expressed appreciation to Mr. Corbin and Charles Metzger for their work on this. Mayor Schmitz expressed appreciation to the Commission for going to Washington. He said the federal government effects what happens in the City of Dothan and the Wiregrass. He said it is important they hear our voice and they know who we are and the issues that face us and hopefully they will address us. Mayor Schmitz said when the entire commission shows up, it shows this city is committed to resolving the issues that are facing us. Kim Meeker, Leisure Services and Angelia Turner announced the 2012 Dothan Pro Classic Tennis Tournament – April 15-22, 2012 at Westgate Tennis Center. City Manager West announced that on April 1st, water restrictions will go into effect. Those residents with odd number addresses will be able to water on Tuesday, Thursday and Saturdays. Those with even number addresses will be able to water on Wednesday, Friday and Sunday. City Manager West announced the grand opening ceremonies for Miracle League Ball this Saturday morning beginning at 9:00 a.m. There will be a community build this coming Saturday beginning at 8:00 a.m. to build a playground on W. Powell Street next to Headstart. Spring session for Dothan 101 begins April 17th. Deadline for organizations to submit their CDBG request is March 29th. City Manager West commended the Leisure Service staff for a great job with the Azalea Dogwood Trail. City Manager West announced that a public forum meeting will be held on March 26th at Westgate beginning at 6:00 p.m. The City Commission and Recreation Board are requested to attend. They are working on their five year master plan and need input from the City Commission and public. Commissioner Reading asked for an update on the long range plan for our water. James Brannon, Polyengineering stated that the long range plan is in the draft form with Billy Mayes and his staff. They are reviewing the plan from the standpoint of several options for water for Dothan. He said another option we are looking at now is to make sure that we have looked at all possible options is doing an RO (Reverse Osmosis) facility using the deep Tuscaloosa Wells in the Dothan area. Mr. Brannon said all of that is in the mix and we are looking at wells in various areas of the Chattahoochee River and then the RO. Commissioner Barbaree asked, on water purification…Reverse Osmosis, are there any other municipalities close by that are doing that. Mr. Brannon said there is one near Mobile that has an RO plant as well as several in Georgia and other areas along the coast lines. Commissioner Barbaree asked that he give that information to Billy so he can pass it on to the Commission to review. Mr. Brannon said the good thing about the Tuscaloosa formation in this area; the sodium chloride levels are very low compared to sea water. The RO process would not be near as difficult. He said that is the same formation that Ozark, Henry and Barbour Counties use but they do not have to treat that water. Commissioner Reading said the reason he brought that up is because he is getting tired of hearing “when can I water my lawn; when I can wash my car and when I can’t”. He said we need to get it before the public and do something about it. Larry Patrick, Leisure Services, reminded everyone that the Dothan City Fest/ Alabama Wildlife and Outdoor Expo will be held March 30-April 1, 2012 at the Dothan Civic Center. Minutes of the Board of Commissioners – March 20, 2012, continued. Commissioner Newsome asked if there will be food furnished for the community build on Powell Street. Mr. West said yes, there will be snacks and lunch provided. Commissioner Newsome said if they need additional funds to see him. Mayor Schmitz introduced Resolution No. 2012-64 (recorded in Ordinance Book No._______at Page_______), requesting the introduction and passage of local legislation authorizing the use of an automated red light enforcement system in the City of Dothan, Alabama during the 2012 Alabama Legislative Session. Commissioner Reading moved to amend the resolution to state that it will be introduced during the 2013 Alabama Legislation Session instead of 2012, motion seconded by Commissioner Snellgrove and upon the motion being put to vote, those voting “yea,” were Schmitz, Reading, Kirkland, Snellgrove and Baxley; “nay:” Newsome and Barbaree. The motion was carried by the majority of five "yeas" to two “nays.” Commissioner Kirkland then moved for adoption of Res. No. 2012-64 as amended, motion seconded by Commissioner Baxley Mayor Schmitz announced that three people had signed up to speak on this item. Mr. Bobby Lewis spoke in opposition to this item. He said this was originally sold as a safety issue, but it is about revenue enhancement. Mr. Lewis said his daughter has had a ticket with this trying to avoid an accident. He said he asked her to email each of the Commission. Mr. Lewis said while it might stop the side impact or slows those down at these intersections, it creates rear end accidents equal or greater to the number of accidents is saves side impact or t-bone as they are referred to. He said it being a safety issue, it may stop one type of accident, but it creates a deluge of another whole type of accidents. He said he has had four back surgeries and attests to those rear end collisions. Mr. Lewis encouraged the Commission to not vote for this and look at other ways to improve the safety in this community. Mr. Lewis said we have a great police force. We appreciate our law enforcement whether it is the police department, sheriff’s department other people that enforce our laws. Mr. Lewis said his daughter asked him to encourage the Commission to not vote for this at this time and he again asked that this not be passed along so that we have these rear end collisions when we have catastrophic injuries that occur at those rear end collision. Mr. Joey Pilcher, owner and operator of Dothan Ambulance Service spoke in favor of this item. He said he takes a different view on this than Mr. Lewis. Mr. Pilcher said, from his experience, these intersections that we are talking about, are deadly. He said it is like a bomb goes off at these intersections when you have these t-bones and right turn impacts. Mr. Pilcher said for example: he lives out Highway 84 west and coming in off Highway 84 west this morning it was similar to Daytona; everyone has their own agenda, putting on make-up, talking on cell phones to being late. He said as he got on up the road one of our finest, Dothan PD just happens to pull in. He said it was just as orderly as it could be. Mr. Pilcher said we know that finances cannot allow us to put police on every corner, but he believes from what he has seen in many years of experience in this that this is a system that will work and that will cut down on these type of accidents. Mr. Pilcher said in seeing this often, this is something that really needs to be looked at close and needs to be deeply considered. Chief Greg Benton said he got up about 3:00 a.m. this morning with a lot on his mind. He said he decided to take that opportunity to write down his thoughts. Chief Benton said instead of getting up here and talking to you he wanted to read what he had written: Citizens of Dothan, Mayor, Commission, there is still a lot of misinformation out in the public that still exist about the use of a Red Light Camera System. Even after holding a public forum, being on television, radio, talking with Civic groups and church groups, this misinformation still perpetuates. This misinformation exists in the following: That there will be dramatic increase in rear end collisions, thus, making the roadways even more dangerous. Our research has shown, while there is an initial increase in rear end collisions, the number drops back to normal levels in time and actually there is a drop of overall collisions of at least 25%. I have been in law enforcement for 23 years and I have never seen a rear end collision that caused a fatality. But, I have seen numerous deaths caused by someone running a red light and t-boning another vehicle. The right angle collision is by far the more dangerous of the two. There was a letter to the editor in the Dothan Eagle a few days ago where the author stated he was fearful of being hit from behind by a semi. I can most assuredly say from experience, if you are rear ended by a semi, your chances of surviving are extremely, extremely high. However, if you are struck by a semi that has Minutes of the Board of Commissioners – March 20, 2012, continued. run a red light, your chances of surviving are slim and none and slim done left town. The second piece of misinformation I hear and read is that “we just need to extend the lengths of the amber and red lights. I have had Mr. Charles Metzger the City’s traffic engineer with me on several occasions when speaking about the camera system. He has explained many times that the timing of our lights in Dothan is set to Nation Safety Traffic Standards. There is more than adequate time for someone doing the speed limit and I want to emphasize speed limit to stop before the light turns red. The Red Light Camera System is a behavior modifier. It is intended to change the behavior of those drivers who consistently run red lights. If the lights were extended, it would not change a thing. Drivers will just increase their speed from greater distances away to try and get through the intersection without having to stop for the light. As I have said many times, the most glaring statistic I have seen comes from a report done by the Montgomery Police Department. They show an average decrease in speeds of 8 miles per hour of vehicles entering intersections since the installation of the camera system. This is a true indication of behavior change in drivers. The third piece of misinformation out there is no appeal process; that the camera alone is responsible for issuing the citation. I say again, an officer from the Dothan Police Department will be who determines if there has been a violation. He will review a video of the incident and will determine if there was an actual violation. People will be allowed to appeal. There will be one day a week that they are allowed to come to the Police Department and sit down with the officer and plead their case. If the officer decides that the citation stands as is, there will be another appeal possibly to the Municipal Judge. The last piece of misinformation I hear is that the Commission is considering this as a way to generate revenue. That is the farthest thing from the truth. The Police Department has recognized the dangers in Dothan of people running red lights. Not having nearly the amount of manpower to effectively do anything about it, we began to look into and research the Red Light Camera System. We brought our findings to the City Manager, Mayor and Commission as a proposal to make our city a safer place to drive. I can assure you that as the Chief of Police, I don’t care if the city doesn’t make one red cent from the camera system. Safety is the priority and always has been when looking into this system. You see, not only am I the Police chief, I am a father, husband and son. I have a family that drives in this city every day. If I thought for one second that this was not the right and prudent thing to do, I would not be standing here advocating the use of this system in our city. Mayor, Commissioners, I have also heard some discontent from the public about bringing in an outside private company for this process. By not acting or making a decision on the installation until 2013, it will give the Police Department more time to research the cost of purchasing and installing the needed equipment ourselves. Thank you for your consideration. Mayor Schmitz explained that what they are voting on today is to move it to the State level for them to pass a Bill to allow us to even consider it. He said if that does happen, the Police Department will come back and suggest exactly the program that they want to offer to the city and then we will have to vote for it. Mayor Schmitz said even if this does pass today and he is asking the Commission to vote for it, you are not going to have red lights with cameras. We have a long, long way to go to get to that and we will have to vote again in 2013 if it continues to move forward. Commissioner Newsome said he wanted to comment on “misinformation”. He said the citizens of Dothan form their own opinion on red lights…be it misinformation, no information or all of the information; they make that decision. Commissioner Newsome said he hears people of the City of Dothan. He said another comment on “behavior changer”…..and he recited a personal example. In the last 6 to 8 months he had the opportunity to drive from Dothan to Phoenix, Arizona, which is about 2,000 miles. Commissioner Newsome said he drove through every city along Interstate 10 going west. He said every city along Interstate 20 and other Interstates coming back east. Commissioner Newsome said incidentally, he drove through Montgomery and their red light control, through Selma and their red light…through Houston, San Antonio….coming back through Dallas and Fort Worth and others. Commissioner Newsome said he wanted to come back to Montgomery…in 2010, he was t-boned in Montgomery and he is limping with his right knee. He said he is facing possible operation. Commissioner Newsome said he is taking pain medication at least twice a day for his right knee. He said here is a city with red light control and here is a person just a little over two years ago was t-boned in the City of Montgomery. He said if a behavior change is ingrained in the red light, apparently, our capitol city has not awakened to it. Commissioner Newsome said he is not in a position to tell 65,000 or 67,000 people in the City of Dothan that you are misinformed, that you don’t know what you want, what you need and when you want it. Commissioner Newsome said he is here to hear you and to vote his conscious based on what he hears and much of what he heard was right here at this podium at a public hearing. He said he did not hear anyone from this city saying “well not this year, but maybe 2013”. He said he heard a different voice. Commissioner Newsome said elected representatives of our city need to hear and need to hear very clearly what the people are saying. Minutes of the Board of Commissioners – March 20, 2012, continued. Commissioner Reading said he has done his homework. At his house, he has two sets of voters, people who are registered to vote and a copy of the voters of people who actually vote from Montgomery, Alabama. Commissioner Reading said he made a random sampling of over 400 calls. The two questions he asked was the age category. He said people are not going to give you their age. He said he asked them if their ages were between 20 and 50 and then 50 and above. He said people from 20 to 50 are totally against the cameras. People 50 and above are for them. Commissioner Reading said the results were about 50/50. Commissioner Reading said now, where does that put him. He said if he is going to error, he is going to error on the side of safety. Commissioner Reading said the question was asked, down the road if it passes, there will be some revenue derived from this…..but simply put, if it passes that revenue does not go into the general fund it will go directly to our police department to enhance their safety conditions. Commissioner Barbaree said the Reverend Dr. James Moore, this morning talked about honest, open and respectable debate, which is what this decision entails today. He said he also had a difficult time sleeping last night, so he got up and prepared his statement for this morning. He then read it: I have received a lot of input from residents of District 5 and Dothan regarding today’s vote on red light traffic cameras. I certainly appreciate the input. The discussion about the cameras have created interest in our city government and for that I am grateful…and I truly am and I am sure the rest of the commissioners are too. While I certainly support modifying and improving motorists driving habits to insure safer intersections, I don’t support it through the installment of red light traffic cameras within our City and here is why. My primary concern is due to the uncertainties of a pending future contract between our city and a company I have no knowledge of…or have yet to receive any details of a fiscal requirement that comes with a system like this in place. The bottom line is that our residents want our city to operate as fiscal as possible and my vote is based on this. I believe there are other ways we can change driving behaviors and if given the chance, I will recommend these to the Commission. In closing, Greg I certainly do appreciate you. I appreciate your leadership and I appreciation the command team that you have assemble and members of our public safety department. Our Chief is doing an outstanding job and I look forward to continue to work with him to make Dothan a better place. Commissioner Barbaree added that they all attended meetings in Washington D.C., and we do not have the problems that other cities have. He said it looks like this resolution is going to move forward and he can accept that. Commissioner Barbaree said he will work toward a better Dothan that way. There being no further discussion and upon the motion being put to vote, those voting “yea,” were Schmitz, Reading, Kirkland, Snellgrove and Baxley; “nay:” Newsome and Barbaree. The motion was carried by the majority of five "yeas" to two “nays.” Mayor Schmitz introduced Resolution No. 2012-65 (recorded in Ordinance Book No._______at Page_______), appointing Regions Bank as successor custodian, depository, registrar, paying agent and transfer and authenticating agent with respect to General Obligation Warrant Series 2005. Commissioner Reading moved for adoption, motion seconded by Commissioner Kirkland and unanimously adopted. Mayor Schmitz introduced Resolution No. 2012-66 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with MDG, Inc. to provide lobbying and governmental relations services for a twelve month period at a cost of $48,000.00. Commissioner Barbaree moved for adoption, motion seconded by Commissioner Baxley upon the motion being put to vote, those voting “yea,” were Schmitz, Reading, Kirkland, Snellgrove, Barbaree and Baxley; “nay:” Newsome. The motion was carried by the majority of six "yeas" to one “nay.” Commissioner Barbaree introduced Mr. Goolsby and Mr. Miller. He said they have already begun helping us in a lot of ways with current legislation and also with economic development. He said he looks forward to working with them in the future and looks for good things. Mayor Schmitz introduced Resolution No. 2012-67 (recorded in Ordinance Book No._______at Page_______), confirming the costs incurred in notification and abatement of certain properties determined to be nuisances by Resolution Number Minutes of the Board of Commissioners – March 20, 2012, continued. 2012-3 and Resolution Number 2012-27 and turning the costs over to the County Tax Collector so that the amount can be added to the next regular bills for taxes levied against the respective lots and parcels of land. Commissioner Newsome moved for adoption, motion seconded by Commissioner Barbaree and unanimously adopted. Mayor Schmitz introduced Resolution No. 2012-68 (recorded in Ordinance Book No._______at Page_______), applying for and accepting a Safe Routes to School Grant from the Alabama Department of Transportation in the amount of $147,593.01 to be used for sidewalks and street crossing improvements at the Selma Street Elementary School and appropriating funds for said project. Commissioner Snellgrove moved for adoption, motion seconded by Commissioner Kirkland and unanimously adopted. Mayor Schmitz introduced Resolution No. 2012-69 (recorded in Ordinance Book No._______at Page_______), applying for and accepting a Safe Routes to School Grant from the Alabama Department of Transportation in the amount of $159,309.96 to be used for sidewalks and street crossing improvements at the Grandview Elementary School and appropriating funds for said project. Commissioner Newsome moved for adoption, motion seconded by Commissioner Kirkland. Commissioner Barbaree asked if this is the grant that was discussed for the possibility of the Highlands in the future. Mr. West said Jerry Corbin is putting together something now for us to submit Highlands next time. There being no further discussion the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2012-70 (recorded in Ordinance Book No._______at Page_______), accepting a Quit Claim Deed from the Armory Commission of Alabama for two (2) parcels of real property located at the Southwest corner of Choctaw Street and Westgate Parkway. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Baxley and unanimously adopted. Mayor Schmitz introduced Resolution No. 2012-71 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with the United States Tennis Association for the 2012 USTA Women’s $50,000.00 Tournament. Commissioner Snellgrove moved for adoption, motion seconded by Commissioner Reading and unanimously adopted. Mayor Schmitz introduced Resolution No. 2012-72 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with the Wiregrass Foundation to accept funding in the amount of $20,000.00 for the 2012 USTA Women’s Tennis Tournament and appropriating funds for said funding. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Reading and unanimously adopted. Mayor Schmitz introduced Resolution No. 2012-73 (recorded in Ordinance Book No._______at Page_______), filing an application with the State of Alabama Department of Education for participation in a Summer Food Service Program for Children, entering into an agreement with the United States Department of Agriculture for administration of the program and entering into an agreement with the Dothan City Board of Education for providing the food services. Commissioner Reading moved for adoption, motion seconded by Commissioner Kirkland and unanimously adopted. Mayor Schmitz introduced Resolution No. 2012-74 (recorded in Ordinance Book No._______at Page_______), submitting an application to the U.S. Department of Justice, Office of Community Oriented Policing Services COPS Hiring Program Grant in the amount of $1,339,808.00 to fund eight police officer positions for a three year period.
