BOARD OF COMMISSIONERS CITY OF DOTHAN, ALABAMA REGULAR MEETING MARCH 19, 2013 The Board of Commissioners of the City of Dothan, Alabama, met in regular session in the Commission Chambers of the Roy Driggers Municipal Building at 10:00 A.M., Tuesday, March 19, 2013 with the following members present: Mayor Mike Schmitz, Associate Commissioners James H. Reading, Amos M. Newsome, Jr., Albert Kirkland, Critt Snellgrove, Taylor Barbaree and Hamp Baxley. Also present were City Manager Michael West, City Clerk Pam McCoy, Administrative Assistant Tammy Danner, who recorded the Minutes of the Meeting, and the local news media representatives. Mayor Schmitz called the meeting to order. Reverend Bob Baxter, First Presbyterian Church, then led in prayer, afterwhich Commissioner Newsome led in the Pledge of Allegiance to the Flag. Commissioner Baxley moved that the Minutes of the Special Called Meeting of March 1, 2013, be approved, motion seconded by Commissioner Barbaree and unanimously approved. Commissioner Reading moved that the Minutes of the Meeting of March 5, 2013, be approved, motion seconded by Commissioner Kirkland and unanimously approved. Mayor Schmitz presented and read a proclamation, proclaiming the March 20, 2013 as “Kick Butts Day” in the City of Dothan. Judy Guiler, Dothan-Houston County Substance Abuse Partnership; Logan Blake, Dothan-Houston County Substance Abuse Partnership Youth Council; and Alecia Duke, Dothan High School SADD were present for the proclamation. Commissioner Kirkland commended the Leisure Services staff for the great job they have done with the baseball fields. He said they look great! Commissioner Snellgrove expressed appreciation to Elston Jones and Larry Patrick, Leisure Services for the outstanding job they did this past weekend with the Azalea Dogwood Pageant. He commended Jerry Corbin and his staff for what they are doing on N. Foster Street. Business owners on that street have really complemented the crews for being very cordial. Commissioner Snellgrove also welcomed former Mayor James Grant to the meeting. Commissioner Barbaree said he had received complaints about the bathrooms at the Miracle League Playground. He asked City Manager West to email him the cleanup schedule of the facilities. Larry Patrick, Leisure Services introduced the 2013 Azalea Dogwood Queen and Court: Josie Gagliano, 2013 Azalea Dogwood Queen, Helen Glover, 2013 Azalea Dogwood Princess, and Mary Katherine Chapman, 2013 Azalea Dogwood Maid of Honor. Mr. Patrick announced that the 2013 Azalea Dogwood Trail will be held March 24th beginning at 2:00 p.m. starting at the corner of Woodland Drive and West Main Street and will end at 115 Girard Avenue. “Sunday in the Park” festivities will be at Solomon Park from 2:00 to 4:30 p.m. Mr. Patrick invited everyone to come out and enjoy the festivities. City Manager West announced a Joint Work Session between the Dothan City Commission and the Dothan Planning Commission regarding Sign Regulations will be held this afternoon at 2:00 p.m. in the Commission Chambers. City Manager West announced that the Spring 2013 Dothan 101 Class will begin April 16, 2013. City Manager West stated that the Alabama American Planning Association has recognized the City of Dothan’s bike and pedestrian plan as the top in the state for this year. Minutes of the Board of Commissioners – March 19, 2013, continued. Mayor Schmitz introduced the application of Michael H. Kitchen for a Restaurant Retail Liquor License for Applebee’s Neighborhood Grill and Bar, located at 3050 Ross Clark Circle. Commissioner Kirkland moved for approval, motion seconded by Commissioner Barbaree and unanimously carried. Mayor Schmitz introduced the application of Charles W. Yeates for a Wholesale Beer License for International Wines, located at 301 Snow Drive, Birmingham, Alabama. Commissioner Kirkland moved for approval, motion seconded by Commissioner Baxley and unanimously carried. Mayor Schmitz introduced Ordinance No. 2013-57 (recorded in Ordinance Book No. _______at Page_______), rezoning property owned by Beverlye Hall Apartments Ltd. and Interstate Properties, LLC located at 210 Crossing Lane from B-2 District and H-I District to R-A District. Commissioner Kirkland moved for immediate consideration, motion seconded by Commissioner Snellgrove and upon the motion being put to vote, those voting “yea,” were Schmitz, Reading, Newsome, Kirkland, Snellgrove, Barbaree and Baxley; “nay:” none. The motion was carried by the majority of seven “yeas” to no “nays.” Commissioner Kirkland then moved for adoption of Ordinance No. 2013-57, motion seconded by Commissioner Baxley and upon the motion being put to vote, those voting “yea,” were Schmitz, Reading, Newsome, Kirkland, Snellgrove, Barbaree and Baxley; “nay:” none. The motion was carried by the majority of seven “yeas” to no “nays.” Mayor Schmitz introduced Resolution No. 2013-58 (recorded in Ordinance Book No._______at Page_______), submitting to the Alabama Legislature an official statement of opposition to the passage of HB257, SB217, and any other similar legislation to prohibit the imposition of a business license tax on rental or residential real estate on a per unit basis unless the tax was imposed before January 1, 2013 as an intrusion on the authority of local governments in Alabama to structure and levy business license fees based on local needs and condition. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Baxley and unanimously adopted. City Manager West said this was sent out by the League last week. He said we currently levy a business license based on the number of units. Mr. West said based on this legislation we would be exempt from this requirement. He said the League would like for the cities to pass this and send a message that this is a decision that should be made locally. Mayor Schmitz introduced Resolution No. 2013-59 (recorded in Ordinance Book No._______at Page_______), approving the conversion of the tennis courts located at the Doug Tew Recreation Center into a picnic pavilion and family recreation area. Commissioner Snellgrove moved for adoption, motion seconded by Commissioner Baxley and unanimously adopted. Mayor Schmitz introduced Resolution No. 2013-60 (recorded in Ordinance Book No._______at Page_______), agreeing to join with the Houston County Commission to obtain aerial photography and digital orthographic maps at a cost of $41,700.00. Commissioner Reading moved for adoption, motion seconded by Commissioner Kirkland and unanimously adopted. Mayor Schmitz introduced Resolution No. 2013-61 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with the National Institute for Jail Operations for the use of the Jail Audit and Risk Management System for detention institutions with an implementation fee of $2,000.00 and a monthly fee of $85.00 for s sixty-month period. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Snellgrove. Commissioner Barbaree asked if this was part of the accreditation we just went through with the Police Department. Chief Benton said this has nothing to do with the accreditation. He said this is jail operations; what we are trying to do is develop policies to upgrade our policies that we have in the jail to the highest standards. There being no further discussion the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2013-62 (recorded in Ordinance Book No._______at Page_______), entering into a Software License Agreement and a Support Maintenance Contract with Firehouse Software for the purchase and Minutes of the Board of Commissioners – March 19, 2013, continued. maintenance of software to be used for the reporting of all Fire Department responses and records management systems at a cost of $185,375.00 and appropriating funds for said agreements. Commissioner Reading moved for adoption, motion seconded by Commissioner Kirkland and unanimously adopted. Mayor Schmitz introduced Resolution No. 2013-63 (recorded in Ordinance Book No._______at Page_______), awarding the bid and entering into an agreement with Morse Communications, Inc. for maintenance of the Alcatel-Lucent telephone system for a three-year period with an annual cost of $43,253.10. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Snellgrove and unanimously adopted. Mayor Schmitz introduced Resolution No. 2013-64 (recorded in Ordinance Book No._______at Page_______), executing a Memorandum of Agreement with the Alabama Department of Public Safety to reimburse the City for certain expenses incurred in providing training to student officers at the Alabama Criminal Justice Training Center. Commissioner Snellgrove moved for adoption, motion seconded by Commissioner Kirkland and unanimously adopted. Mayor Schmitz introduced Resolution No. 2013-65 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with Xerox Corporation for the lease of a copy machine to be located in the Leisure Services Department, Rose Hill Senior Center, as awarded in Bid Number 13-005, at a cost of $79.99 per month for a three-year period. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Barbaree and unanimously adopted. Mayor Schmitz introduced Resolution No. 2013-66 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with Xerox Corporation for the lease of a copy machine to be located in the Leisure Services Department, Water World Park, as awarded in Bid Number 13-005, at a cost of $79.99 per month for a three-year period. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Barbaree and unanimously adopted. Mayor Schmitz introduced Resolution No. 2013-67 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with Xerox Corporation for the lease of a copy machine to be located in the Performing Arts Department, as awarded in Bid Number 13-005, at a cost of $174.29 per month for a three-year period. Commissioner Barbaree moved for adoption, motion seconded by Commissioner Kirkland and unanimously adopted. Mayor Schmitz introduced Resolution No. 2013-68 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with the United States Tennis Association for the 2013 USTA Women’s $50,000.00 Tournament to be held the week of April 14-21, 2013. Commissioner Reading moved for adoption, motion seconded by Commissioner Kirkland. Commissioner Reading asked if the winner of this tournament gets an automatic bid to the French Open. Kim Meeker, Leisure Services said they have a competition between all of the American players in three tournaments; one of those is our tournament. He said the top American player out of those three tournaments will get a wild card entry to the French Open. There being no further discussion the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2013-69 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with Pioneer Family Brands, Inc. for use of TROPICAL SNO dry beverage concentrate used in the preparation and sale of shaved ice at Water World for a period of three years. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Snellgrove and unanimously adopted. Mayor Schmitz introduced Resolution No. 2013-70 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with the Army NAF Contracting Office to allow the NAFI to handle the sale or distribution of discounted Water World tickets to authorized patrons of Fort Rucker. Commissioner Newsome moved for adoption, motion seconded by Commissioner Kirkland and unanimously adopted. Mayor Schmitz introduced Resolution No. 2013-71 (recorded in Ordinance Book No._______at Page_______), declaring 1500 watt metal halide ball field fixtures as surplus and no longer needed for public or municipal purposes and authorizing Minutes of the Board of Commissioners – March 19, 2013, continued. the transfer of said fixtures to the Dale County Board of Education to be used at the little league ball field at South Dale Middle School in Pinckard, Alabama. Commissioner Newsome moved for adoption, motion seconded by Commissioner Kirkland. City Manager West said this field will be dedicated to the bus driver, Mr. Poland, who was killed during the hostage situation in Midland City. There being no further discussion the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2013-72 (recorded in Ordinance Book No._______at Page_______), approving payment of invoices for the month of February, 2013 in the amount of $13,185,193.90. Commissioner Reading moved for adoption, motion seconded by Commissioner Kirkland and unanimously adopted. Mayor Schmitz introduced Resolution No. 2013-73 (recorded in Ordinance Book No._______at Page_______), appointing Dr. James Kelley as a member of the Industrial Development Board.
