BOARD OF COMMISSIONERS CITY OF DOTHAN, ALABAMA REGULAR MEETING DECEMBER 3, 2013 The Board of Commissioners of the City of Dothan, Alabama, met in regular session in the Commission Chambers of the Roy Driggers Municipal Building at 10:00 A.M., Tuesday, December 3, 2013 with the following members present: Mayor Mike Schmitz, Associate Commissioners Kevin Dorsey, Amos M. Newsome, Jr., Albert Kirkland, John Ferguson, Taylor Barbaree and Hamp Baxley. Also present were City Manager Michael West, City Clerk Tammy Danner, Assistant City Clerk Wendy Shiver who recorded the Minutes of the Meeting, and the local news media representatives. Mayor Schmitz called the meeting to order. Sister Miriam Fiduccia, then led in prayer, afterwhich Commissioner Dorsey led in the Pledge of Allegiance to the Flag. Commissioner Baxley moved that the Minutes of the Meeting of November 19, 2013, be approved, motion seconded by Commissioner Barbaree and unanimously approved. Commissioner Kirkland asked everyone to remember Mr. Bruce Hall’s family in their prayers. Mr. Hall’s father, Mr. Bob Hall, passed away on Sunday. Commissioner Baxley inquired about a previous request for research into the legal remedies available to the City to enforce maintenance and replacement of poles by utility companies who use and detach equipment from poles. He asked for this to be done. Commissioner Barbaree said there needs to be written legal language in the franchise agreements to address maintenance of boxes as well. Mayor Schmitz announced Assistant Leisure Services Director Larry Patrick will be retiring this month. Mayor Schmitz, City Manager West, Leisure Services Director Elston Jones and Commissioner Newsome recognized Mr. Patrick for always providing outstanding customer service and thanked him for his years of service. Mayor Schmitz thanked the Dothan Rotary Club for honoring area senior citizens at the 35th annual Christmas luncheon held at the Dothan Civic Center yesterday. He expressed appreciation to the commission for attending and assisting with the event. Houston-Love Memorial Library Director Ms. Bettye Forbus and Library Board Member/Building Committee Chair Ms. Cindy Aman updated the Commission on the construction progress of the two new libraries. Ms. Forbus announced construction is on schedule. A soft opening is tentatively scheduled for January 21, 2014 and the grand opening with ribbon cutting is tentatively scheduled for February 3, 2014. Ms. Forbus announced that during this time of transition, library services will be available in the bookmobile, which is parked in front of the new library downtown. City Manager West, along with Public Works Director Jerry Corbin and Assistant Public Works Director Charles Metzger, presented a service award to Larry Andrews, for twenty-five years of service with the City. City Manager West announced that the Downtown Dothan Hoops Classic will be held December 27th – 31st at the Dothan Civic Center with an off-day scheduled for Sunday, December 29th. City Manager West reminded everyone that the City’s Annual Christmas Tree Lighting will be held tonight at 6:00 p.m. City Manager West announced the Annual Downtown Christmas Festival will be held on Saturday, December 7th from 9:00 a.m. until 3:00 p.m. Minutes of the Board of Commissioners – December 3, 2013, continued. City Manager West reminded the Commission and Department Heads that the 2014 Strategic Planning Work Session will be held January 9-11, 2014 at Friend Bank’s community room. Mayor Schmitz introduced the application of Walker Grant for a Wholesale Table Wine License (off premises) for Allstate Beverage Company, LLC, 130 Sixth Street, Montgomery, Alabama. Commissioner Kirkland moved for approval, motion seconded by Commissioner Barbaree and unanimously carried. Mayor Schmitz introduced the application of Martha B. Camacho for a Retail Beer and Table Wine License (on or off premises) for La Canasta, 2855 Ross Clark Circle, Suites 101 & 102. Commissioner Newsome moved for approval, motion seconded by Commissioner Barbaree and unanimously carried. Mayor Schmitz introduced Resolution No. 2013-420 (recorded in Ordinance Book No._______at Page_______), confirming the cost incurred in notification and abatement of certain properties determined to be nuisances by Resolution Number 2013-330 and 2013-368 and turning the costs over to the County Tax Collector so that the amounts can be added to the next regular bills for taxes levied against the respective lots and parcels of land. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Ferguson and unanimously adopted. Mayor Schmitz introduced Resolution No. 2013-421 (recorded in Ordinance Book No._______at Page_______), entering into a contract with Praestare Engineering for professional consulting services for Downtown Streetscape, Project No. TAPAA-TA13(916), for an amount of $28,300.00. Commissioner Ferguson moved for adoption, motion seconded by Commissioner Barbaree and unanimously adopted. Mayor Schmitz introduced Resolution No. 2013-422 (recorded in Ordinance Book No._______at Page_______), amending the Lease Agreement with the United States Post Office by adding a termination option by providing written notice to the Landlord at any time during the remaining lease term. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Barbaree. City Manager West said this agreement involves the lot previously leased directly to the post office for their use and this lot now will become a public parking lot; therefore, the intention of the post office is to cancel the lease. There being no further discussion the resolution was unanimously adopted Mayor Schmitz introduced Resolution No. 2013-423 (recorded in Ordinance Book No._______at Page_______), declaring certain personal property as obsolete and no longer needed for public or municipal purposes and authorizing the disposal of said property by whatever means is determined to be in the best interest of the City. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Barbaree and unanimously adopted. Mayor Schmitz introduced Resolution No. 2013-424 (recorded in Ordinance Book No._______at Page_______), entering into a contract with Bic Media for radio and television advertising for Water World for a one-time cost of $2,500.00. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Newsome and unanimously adopted. Mayor Schmitz introduced Resolution No. 2013-425 (recorded in Ordinance Book No._______at Page_______), appointing Hamp Baxley as one of the City’s representatives on the Policy Committee of the Southeast Wiregrass Area Metropolitan Planning Organization. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Ferguson and unanimously adopted. Mayor Schmitz introduced Resolution No. 2013-426 (recorded in Ordinance Book No._______at Page_______), re-appointing Sheila Azar as a member of the Substance Abuse Board. Commissioner Barbaree moved for adoption, motion seconded by Commissioner Kirkland and unanimously adopted. Mayor Schmitz introduced Resolution No. 2013-427 (recorded in Ordinance Book No._______at Page_______), re-appointing Heath Carpenter as a member of the Minutes of the Board of Commissioners – December 3, 2013, continued. Mayor Schmitz introduced Resolution No. 2013-428 (recorded in Ordinance Book No. _______at Page_______), awarding the following bids and approving other purchases over $15,000.00 by the City.
