BOARD OF COMMISSIONERS CITY OF DOTHAN, ALABAMA REGULAR MEETING MAY 20, 2014 The Board of Commissioners of the City of Dothan, Alabama, met in regular session in the Commission Chambers of the Roy Driggers Municipal Building at 10:00 A.M., Tuesday, May 20, 2014 with the following members present: Mayor Mike Schmitz, Associate Commissioners Kevin Dorsey, Amos M. Newsome, Jr., John Ferguson and Hamp Baxley. Commissioners Albert Kirkland and Taylor Barbaree were absent. Also present were City Manager Michael West, City Clerk Tammy Danner, Assistant City Clerk Wendy Shiver who recorded the Minutes of the Meeting, and the local news media representatives. Mayor Schmitz called the meeting to order. Rabbi Lynne Goldsmith, Temple Emanu-el, then led in prayer, afterwhich Commissioner Newsome led in the Pledge of Allegiance to the Flag. Commissioner Ferguson moved that the Minutes of the Meeting of May 6, 2014, be approved, motion seconded by Commissioner Baxley and unanimously approved. Mayor Schmitz presented and read a proclamation, proclaiming May 18-24, 2014 as “Emergency Medical Services Week” in the City of Dothan. Fire Chief Larry Williams, along with members of the Dothan Fire Department, and Joey Pilcher, along with members of Pilcher’s Ambulance Service, were present for the proclamation. Captain Sean Gibson, along with Chief Williams and City Manager West, presented the John T. Ingram Emergency Medical Technician (EMT) of the Year Award to Firefighter Dustin Mendheim and the Paramedic of the Year Award to Sergeant Troy Black. Commissioner Dorsey said he recently returned from attending an Alabama League of Municipalities (ALM) convention and learned a lot during the trip. Commissioner Dorsey said he has gathered and studied information over the past two weeks to the matter of payday lending, car title loans and check cashing businesses. He said the results of his findings reveal it is not good for the quality of life, hurts the economic growth of our city and hurts economic development. Commissioner Newsome said he brought to attention at the last meeting a problem regarding stray dogs biting people in the vicinity of the church on Stringer Street and he has not received any information regarding the progress of this matter. Captain Carlton Ott said animal control officers have gathered reports regarding this particular group of dogs and forwarded this information from their investigation to the City Attorney’s office to determine if a summons may be issued for allowing vicious dogs to roam. He said that if the City Attorney’s office determines this to be the case, the department can then issue a summons and deal with the matter in court. Captain Ott said officers have been instructed to ride by this area numerous times per day in an attempt to catch the dogs out of the yard. Commissioner Newsome said he sees numerous dogs throughout the city that are not on leashes and in many cases, on city property. He said these dogs need to be impounded, and he requested a vigorous effort be made to ensure that there are no loose dogs. City Manager West announced that Purchasing Agent Charlotte Langford has implemented a new online bid registration and notification system. He said Mrs. Langford will hold four seminars on Thursday, June 19th beginning on the hour at 1:00 p.m., 2:00 p.m., 3:00 p.m. and 4:00 p.m. in the Training Room located on the first floor of the Dothan Civic Center where she will provide information and assist interested companies in enrolling on this system. City Manager West announced “Sesame Street Live” will take place on Saturday, May 24th at the Dothan Civic Center and encouraged attendance. City Manager West reminded everyone of a work session to be held at 4:00 p.m. today with Barge Waggoner Sumner and Cannon regarding an Environmental Protection Agency update on the Administrative Order of Consent. City Manager West announced the public pools will be opened daily beginning Memorial Day, which is Monday, May 26th. City Manager West announced the Dothan City Landfill will close on June 16th to conserve the remaining landfill space for emergencies, etc. Mayor Schmitz confirmed with City Manager West that this closure will not affect residential collection service provided by the City. City Manager West announced City offices will be closed on Monday, May 26th in observance of Memorial Day and there will be no sanitation collection on this date. Garbage and recycling collection will be rescheduled for Wednesday, May 28th. There will be no make-up day for trash collection. Mayor Schmitz introduced Ordinance No. 2014-125 (recorded in Ordinance Book No. _______at Page_______), rezoning property owned by Southeast Alabama Medical Center located at 1108 Ross Clark Circle from O-I (Office/Institutional) District to B-2 (Highway Commercial) District. Commissioner Baxley moved for immediate consideration, motion seconded by Commissioner Ferguson and upon the motion being put to vote, those voting “yea,” were Schmitz, Dorsey, Newsome, Ferguson and Baxley; “nay:” none. The motion was carried by the majority of five “yeas” to no “nays.” Commissioner Baxley then moved for adoption of Ordinance No. 2014-125, motion seconded by Commissioner Ferguson and upon the motion being put to vote, those voting “yea,” were Schmitz, Dorsey, Newsome, Ferguson and Baxley; “nay:” none. The motion was carried by the majority of five “yeas” to no “nays.” Mayor Schmitz introduced Resolution No. 2014-126 (recorded in Ordinance Book No._______at Page_______), entering into a contract with the Center for Public Safety Management, LLC to conduct a workload analysis for the Police Department at a cost of $49,500.00. Commissioner Baxley moved for adoption, motion seconded by Commissioner Ferguson and unanimously adopted. Mayor Schmitz introduced Resolution No. 2014-127 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with S2K Consulting, Inc. to perform a Telecom audit on the City’s telecommunications billings covering all non 911 circuits. Commissioner Baxley moved for adoption, motion seconded by Commissioner Newsome. City Manager West said there is no cost to the City unless a discrepancy is discovered. Interim I.T. Director Robb Meredith confirmed for Commissioner Ferguson that the City will seek reimbursement from the provider if any discrepancies are found. Sherry Bellomo, President of S2K Consulting, said the company typically finds savings and the audit will take approximately three to four months. Ms. Bellomo confirmed for Commissioner Newsome that the company actively seeks municipalities of a certain population number or monthly telecom expense amount. There being no further discussion, the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2014-128 (recorded in Ordinance Book No._______at Page_______), entering into a contract with Omussee C&D Landfill for the disposal of its Trash stream (approximately 9,000 tons per year) for $13.50 per ton. Commissioner Baxley moved for adoption, motion seconded by Commissioner Ferguson and unanimously adopted. Minutes of the Board of Commissioners – May 20, 2014, continued. Mayor Schmitz introduced Resolution No. 2014-129 (recorded in Ordinance Book No._______at Page_______), entering into a permit agreement with Steve Glover for installation and maintenance of water meters for Park Place, located at 1550 Westgate Parkway. Commissioner Ferguson moved for adoption, motion seconded by Commissioner Newsome and unanimously adopted. Mayor Schmitz introduced Resolution No. 2014-130 (recorded in Ordinance Book No._______at Page_______), approving payment of invoices for the month of April, 2014 in the amount of $11,646,062.29. Commissioner Baxley moved for adoption, motion seconded by Commissioner Ferguson and unanimously adopted. Mayor Schmitz introduced Resolution No. 2014-131 (recorded in Ordinance Book No._______at Page_______), appointing James Williams as a member of the Board of Zoning Adjustment. Commissioner Dorsey moved for adoption, motion seconded by Commissioner Baxley and unanimously adopted. Mayor Schmitz introduced Resolution No. 2014-132 (recorded in Ordinance Book No. _______at Page_______), awarding the following bids and approving other purchases over $15,000.00 by the City.
