BOARD OF COMMISSIONERS CITY OF DOTHAN, ALABAMA REGULAR MEETING JUNE 17, 2014 The Board of Commissioners of the City of Dothan, Alabama, met in regular session in the Commission Chambers of the Roy Driggers Municipal Building at 10:00 A.M., Tuesday, June 17, 2014 with the following members present: Mayor Mike Schmitz, Associate Commissioners Kevin Dorsey, Amos M. Newsome, Jr., Albert Kirkland, John Ferguson, and Hamp Baxley. Commissioner Taylor Barbaree was absent. Also present were City Manager Michael West, City Clerk Tammy Danner, Assistant City Clerk Wendy Shiver who recorded the Minutes of the Meeting, and the local news media representatives. Mayor Schmitz called the meeting to order. Mr. Machroyce Corbitt, then led in prayer, afterwhich Commissioner Ferguson led in the Pledge of Allegiance to the Flag. Mayor Schmitz announced Commissioner Barbaree is out of town today attending an Alabama Municipal Electric Authority meeting. Commissioner Baxley moved that the Minutes of the Meeting of June 3, 2014, be approved, motion seconded by Commissioner Ferguson and unanimously approved. Commissioner Baxley recognized Dothan American League Red Team “Zaxby’s” as the Dixie Youth Baseball City Champions. Coach Philip Mullin introduced the players and assistant coaches. Mayor Schmitz presented and read a proclamation, proclaiming June 23-29, 2014 as “Amateur Radio Week” in the City of Dothan. Densie Williams, Public Information Officer Wiregrass Amateur Radio, and James Nelson, Club President, were present for the proclamation. Mayor Schmitz presented and read a proclamation, proclaiming June 22-27, 2014 as “WIRED 2014” in the City of Dothan. He also presented a proclamation from Governor Robert Bentley. Mark Anderson, Director of WIRED Ministries, was present for the proclamations. Commissioner Dorsey said that he traveled to Washington, D.C. last week with Chief Probation Officer Angela Underwood and Sergeant Clark Allums to participate in the Municipal Leadership for Juvenile Justice Reform Leadership Academy. Ms. Underwood thanked the Commission and City Manager West for affording her the opportunity to participate in the academy. She provided a synopsis of the discussions held and said the plan is now to implement information gained during the trip. Commissioner Dorsey announced a community meeting to be held at 6:00 p.m. on Thursday, June 19th at New Attitude Church on 1579 Montgomery Highway. Commissioner Dorsey announced a basketball camp currently being held at Kinney Park on North Alice Street. He thanked Mayor Schmitz and Leisure Services Director Elston Jones. Commissioner Kirkland expressed appreciation to the Department Heads for all they do to help Dothan be a better place. Mayor Schmitz announced Standard & Poor is giving the City a credit rating increase and said this helps us in many ways. He said this has been achieved through teamwork and recognized City Manager West, Finance Director Angela Palmer, Department Heads and the Commission. Minutes of the Board of Commissioners – June 17, 2014, continued. Mayor Schmitz announced Alabama Department of Transportation (ALDOT) is beginning to hold public hearings to gain input for the next phase of Ross Clark Circle improvements. He said this will be a challenging process, but in the long run, it will be the best thing for our city. He said he is grateful to ALDOT for their help and the Commission for working hard on this issue. City Manager West recognized the Dothan 101 graduates and thanked Ms. Anita Robertson for doing an excellent job in conducting this program. City Manager West, along with Mayor Schmitz, invited Barry Mott of Barge Waggoner Sumner & Cannon (BWSC) to provide an award presentation. Mr. Mott said the City of Dothan and BWSC embarked on a project in 2007 to decommission the Beaver Creek Wastewater Treatment Plant. He said the team got together early in the process to analyze and challenge standard demolition methods in order to determine the best way to tackle this project. He said the outcome of these meetings resulted in a large amount of debris being recycled and a tremendous cost savings to the City. Mr. Mott, on behalf of the team, announced BWSC earned two regional awards and a national honorable mention by the American Council of Engineering Companies for their work in this project. He thanked everyone for allowing BWSC to be a part of the team and recognized that this is a great accomplishment. He presented an award to Dothan Utilities Director Billy Mayes and Public Works Director Jerry Corbin. Mr. Corbin talked about the project and thanked BWSC for their work. He said the decommissioned Beaver Creek property is included in the Forever Wild preserve project which will be the first of its kind in the City of Dothan. City Manager West announced the Special Olympics team is in New Jersey competing in the National Special Olympics and they won three medals in cycling yesterday. City Manager West announced the Junior Police Academy is currently underway at Wiregrass Park and is occurring in two week sessions. City Manager West said we are going to the market this morning for bond refunding, and based on yesterday’s rates, the City will save $870,000.00 over the course of the remaining seven years. City Manager West reminded everyone of the bidder’s seminar being held by Purchasing on Thursday, June 19th beginning at 1:00 p.m. to assist interested companies in the enrollment process. He said the response has been so heavy that the event has been moved from the Training Room to the Board Room. Mayor Schmitz introduced the application of Bryan Scott Applefield for a Restaurant Retail Liquor License (on premise) for Full Moon Bar B Que, located at 3826 Montgomery Highway. Commissioner Baxley moved for approval, motion seconded by Commissioner Kirkland and unanimously carried. Mayor Schmitz introduced the application of Simon Davis for a Lounge Retail Liquor License, Class II (off premise) for Denton Road Package Store, located at 3803 Ross Clark Circle. Commissioner Kirkland moved for approval, motion seconded by Commissioner Dorsey and unanimously carried. Mayor Schmitz introduced Resolution No. 2014-149 (recorded in Ordinance Book No._______at Page_______), confirming the cost incurred in notification and abatement of certain properties determined to be nuisances by Resolution Number 2014-106 and 2014-135 and turning the costs over to the County Tax Collector so that the amounts can be added to the next regular bills for taxes levied against the respective lots and parcels of land. Commissioner Baxley moved for adoption, motion seconded by Commissioner Kirkland and unanimously adopted. Mayor Schmitz introduced Resolution No. 2014-150 (recorded in Ordinance Book No._______at Page_______), submitting permit renewal applications for the Little Choctawhatchee and New Cypress Creek Wastewater Treatment Plants to the ADEM Municipal Section Water Division. Commissioner Kirkland moved for Minutes of the Board of Commissioners – June 17, 2014, continued. adoption, motion seconded by Commissioner Newsome and unanimously adopted. Mayor Schmitz introduced Resolution No. 2014-151 (recorded in Ordinance Book No._______at Page_______), authorizing the Mayor to sign a Warrant Purchase Agreement between the City and The Frazer Lanier Company, Inc., with respect to the issuance of approximately $13,170,000.00 General Obligation Warrants. Commissioner Baxley moved for adoption, motion seconded by Commissioner Ferguson. Mayor Schmitz said this item is for the refunding discussed earlier in the meeting and this will save the City a lot of money. There being no further discussion, the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2014-152 (recorded in Ordinance Book No._______at Page_______), entering into a five-year lease agreement with the United States Postal Service (USPS) at an annual rate of $61,856.00 and paying a leasing commission of $8,660.00 to CBRE Brokerage Services. Commissioner Newsome moved for adoption, motion seconded by Commissioner Kirkland. City Manager West said this is an approximate $10,000.00 increase over what the USPS was paying. City Manager West confirmed for Commissioner Dorsey that using a local broker was not possible because the USPS handles this on a national basis. There being no further discussion, the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2014-153 (recorded in Ordinance Book No._______at Page_______), entering into a permit agreement with the Alabama Department of Transportation for the installation of 10” x 6” tapping tee, 6” gate valve and approximately 14 linear feet of 6” fire line to the right-of-way for the new Walgreens located at 2200 Ross Clark Circle. Commissioner Newsome moved for adoption, motion seconded by Commissioner Kirkland and unanimously adopted. Mayor Schmitz introduced Resolution No. 2014-154 (recorded in Ordinance Book No._______at Page_______), entering into a contract with Praestare Engineering to provide engineering services for improvements to the Jackson Circle drainage structures in the amount of $55,000.00, and appropriating funds for said improvements. Commissioner Ferguson moved for adoption, motion seconded by Commissioner Kirkland and unanimously adopted. Mayor Schmitz introduced Resolution No. 2014-155 (recorded in Ordinance Book No._______at Page_______), approving the Final Summary Change Order with Diversified General Contractors for a net increase of $17,604.00 and a final amount of $1,080.604.00. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Ferguson and upon the motion being put to vote, those voting “yea,” were Schmitz, Dorsey, Newsome, Kirkland and Ferguson; “nay:” Baxley. The motion was carried by the majority of five "yeas" to one “nay.” Mayor Schmitz introduced Resolution No. 2014-156 (recorded in Ordinance Book No._______at Page_______), approving payment of invoices for the month of May, 2014 in the amount of $11,371,203.36. Commissioner Baxley moved for adoption, motion seconded by Commissioner Kirkland and unanimously adopted. Mayor Schmitz introduced Resolution No. 2014-157 (recorded in Ordinance Book No._______at Page_______), re-appointing Jerry Coleman as a member of the Planning Commission. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Baxley and unanimously adopted. Mayor Schmitz introduced Resolution No. 2014-158 (recorded in Ordinance Book No. _______at Page_______), approving purchases over $15,000.00 by the City. City Manager West confirmed for Commissioner Ferguson that some of these items are blanket purchase orders. There being no further discussion, the resolution was unanimously carried.
