BOARD OF COMMISSIONERS CITY OF DOTHAN, ALABAMA REGULAR MEETING OCTOBER 21, 2014 The Board of Commissioners of the City of Dothan, Alabama, met in regular session in the Commission Chambers of the Roy Driggers Municipal Building at 10:00 A.M., Tuesday, October 21, 2014 with the following members present: Mayor Pro tem John Ferguson in the absence of Mayor Mike Schmitz, Associate Commissioners Kevin Dorsey, Amos M. Newsome, Jr., Albert Kirkland and Hamp Baxley. Commissioner Taylor Barbaree was absent. Also present were City Manager Michael West, City Clerk Tammy Danner, Assistant City Clerk Wendy Shiver who recorded the Minutes of the Meeting, and the local news media representatives. Mayor Pro tem Ferguson called the meeting to order. Pastor Stephen Russell, Central Baptist Church, then led in prayer, afterwhich Commissioner Baxley led in the Pledge of Allegiance to the Flag. Mayor Pro tem Ferguson announced that Mayor Schmitz will soon be returning from China and Commissioner Barbaree is unable to be here this morning because of a scheduling conflict. Commissioner Baxley moved that the Minutes of the Meeting of October 7, 2014, be approved, motion seconded by Commissioner Kirkland and unanimously approved. Commissioner Baxley presented and read a proclamation, proclaiming October 23-31, 2014 as “Red Ribbon Week” in the City of Dothan. Dustin Casper, Secretary of the Youth Council for the Prevention Project, was present for the proclamation. Commissioner Baxley presented and read a proclamation, proclaiming October, 2014 as “Pro Bono Month” in the City of Dothan. Cliff Mendheim, Houston County Bar Association, was present for the proclamation. Commissioner Kirkland presented and read a proclamation, proclaiming October 19-25, 2014 as “Respiratory Care Week” in the City of Dothan. Judy Harrell, Respiratory Therapy Program Director, Wallace Community College, and Jonathan Capella, President of the Respiratory Therapy Association for Better Breathing and Wallace Community College Senior Class Member, were present for the proclamation. Commissioner Kirkland presented and read a proclamation, proclaiming October, 2014 as “Physical Therapy Month” in the City of Dothan. Shannon Turner, Physical Therapist Assistant Program Academic Coordinator of Clinical Education, Wallace Community College, was present for the proclamation. Mayor Pro tem Ferguson presented and read a proclamation, proclaiming November 21-27, 2014 as “Farm City Week” in the City of Dothan. Dr. Adair Gilbert, Farm City Committee Chairman, was present for the proclamation. Mayor Pro tem Ferguson, along with Dothan Area Chamber of Commerce President Matt Parker, presented and read a proclamation, proclaiming October 21, 2014 as “Michelin Appreciation Day” in the City of Dothan. Marcel Leclerc, Michelin Tire Plant Manager, and other representatives were present for the proclamation. Mr. Leclerc presented the City with a memento for thirty-five years of partnership and in recognition of the City’s dedication and support of Michelin. Mayor Pro tem Ferguson offered the City’s first official Joseph statue to Michelin for the contributions and leadership they have provided to the community. Mayor Pro tem Ferguson recognized the respiratory therapists and physical therapy associates who were present in the audience and thanked them for everything they do. Minutes of the Board of Commissioners – October 21, 2014, continued. Commissioner Dorsey announced that there will be a “First Responder’s” event on Saturday, November 1st at Andrew Belle Community Center from 12:00 p.m. until 3:00 p.m. He said the purpose of this event is to address the issue of first responders and encourage community participation in reporting crime. Commissioner Newsome asked if the Andrew Belle Community Center pool is on schedule to meet the December deadline. City Manager West confirmed this project is on schedule. He said bids will be received in November and the result will be brought before the Commission the first meeting in December. Commissioner Baxley requested an update on street paving. Assistant Public Works Director Charles Metzger said paving is currently taking place in the Plantation Road and Selkirk Drive area. Mr. Metzger said they are expected to start Westgate Park soon. Commissioner Baxley expressed appreciation to Bob Hendrix, Executive Director of the Dothan Area Convention and Visitors Bureau (DACVB), for all he has done to help bring tourism to Alabama and the Dothan area. Commissioner Baxley encouraged the public to view the “The Art of Alabama Food” exhibit currently on display in the first floor lobby of the Civic Center. City Manager West, along with Public Works Director Jerry Corbin and Environmental Services Manager Ken Rice, presented George Ward, Jr. with a service award for thirty years of service with the City. City Manager West reminded the public that the annual Diabetes Wellness Workshop will be held Thursday, October 30th from 7:30 a.m. until 2:00 p.m. in the Civic Center. City Manager West announced the Cubmobile Derby will take place at 10:00 a.m. on Saturday, October 25th on East Main Street at the overpass. City Manager West announced the City of Dothan will observe Halloween on Friday, October 31st from 5:00 p.m. until 8:00 p.m. City Manager West announced the Southern Region Open Karate Tournament will take place on Saturday, November 1st in the Civic Center. City Manager West said tickets for the Troy and Fort Valley State basketball game are currently on sale, with prices ranging from $10 to $25. City Manager West reminded employees and commissioners of the Employee Heath Benefit Fair going on today in the Civic Center arena. Mayor Pro tem Ferguson introduced the application of Manjulaben Patel for a Retail Beer and Retail Table Wine License (off premise) for 231 Marathon, located at 4684 South Oates Street. Commissioner Baxley moved for approval, motion seconded by Commissioner Kirkland and unanimously carried. Mayor Pro tem Ferguson announced a Public Hearing regarding the abatement and removal of noxious or dangerous weeds. There being no one present to speak, Mayor Pro tem Ferguson declared the Public Hearing closed. Mayor Pro tem Ferguson announced a Public Hearing regarding the demolition and removal of unsafe structures. He acknowledged that there is one item under appeal and invited Anita Owens to speak. Ms. Owens said she purchased the property at 800 Allen Road approximately twenty years ago, but because of recent family related matters, the property has not been maintained. She asked for time to repair the house. Commissioner Baxley asked how much time is being requested and Ms. Owens estimated that she will need six months to one year to complete repairs. She said she made some repairs over the weekend. There being no further discussion, Mayor Pro tem Ferguson declared the Public Hearing closed. Mayor Pro tem Ferguson introduced Resolution No. 2014-272 (recorded in Ordinance Book No._______at Page_______), declaring certain properties which Minutes of the Board of Commissioners – October 21, 2014, continued. are overgrown with weeds, scrub, wild bushes, grass and other vegetable growth as injurious to the health, safety and welfare of the community as nuisances and ordering that the properties be abated. Commissioner Baxley moved for adoption, motion seconded by Commissioner Kirkland and unanimously adopted. Mayor Pro tem Ferguson introduced Resolution No. 2014-273 (recorded in Ordinance Book No._______at Page_______), declaring certain properties which are overgrown with weeds, scrub, wild bushes, grass and other vegetable growth as injurious to the health, safety and welfare of the community as nuisances and calling for a public hearing to be held on the matter during the regularly scheduled commission meeting on November 18, 2014. Commissioner Baxley moved for adoption, motion seconded by Commissioner Kirkland and unanimously adopted. Mayor Pro tem Ferguson introduced Resolution No. 2014-274 (recorded in Ordinance Book No._______at Page_______), confirming the cost incurred in notification and abatement of certain properties determined to be nuisances by Resolution Number 2014-213 and 2014-230 and turning the costs over to the County Tax Collector so that the amounts can be added to the next regular bills for taxes levied against the respective lots and parcels of land. Commissioner Newsome moved for adoption, motion seconded by Commissioner Kirkland and unanimously adopted. Mayor Pro tem Ferguson introduced Resolution No. 2014-275 (recorded in Ordinance Book No._______at Page_______), declaring certain properties as creating a nuisance, constituting a hazard to the public health, safety and convenience of the citizens and authorizing the demolition and removal of said properties. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Baxley. Regarding Ms. Owens appeal, City Manager West advised that as long as an active permit exists and progress is being made, the City will not proceed with demolition. There being no further discussion, the resolution was unanimously adopted. Mayor Pro tem Ferguson introduced Resolution No. 2014-276 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with SunGard Public Sector for the purchase of software to interface the Cityworks Software with existing SunGard Software in the amount of $29,920.00. Commissioner Baxley moved for adoption, motion seconded by Commissioner Kirkland and unanimously adopted. Mayor Pro tem Ferguson introduced Resolution No. 2014-277 (recorded in Ordinance Book No._______at Page_______), appointing Maurice Johnson as a member of the Planning Commission and reappointing David Brewer as a member of the Planning Commission. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Baxley and unanimously adopted.
