BOARD OF COMMISSIONERS CITY OF DOTHAN, ALABAMA REGULAR MEETING NOVEMBER 18, 2014 The Board of Commissioners of the City of Dothan, Alabama, met in regular session in the Commission Chambers of the Roy Driggers Municipal Building at 10:00 A.M., Tuesday, November 18, 2014 with the following members present: Mayor Mike Schmitz, Associate Commissioners Kevin Dorsey, Amos M. Newsome, Jr., Albert Kirkland, John Ferguson, and Hamp Baxley. Also present were City Manager Michael West, City Clerk Tammy Danner, Assistant City Clerk Wendy Shiver who recorded the Minutes of the Meeting, and the local news media representatives. Mayor Schmitz called the meeting to order. Pastor Bobby Marks, Cornerstone Church, then led in prayer, afterwhich Commissioner Newsome led in the Pledge of Allegiance to the Flag. Commissioner Baxley moved that the Minutes of the Meeting of November 4, 2014, be approved, motion seconded by Commissioner Kirkland and unanimously approved. Mayor Schmitz presented and read a proclamation, proclaiming December 1, 2014 as “World Aids Day” in the City of Dothan. Niece Danzey, Health Educator, Medical AIDS Outreach was present for the proclamation. Mayor Schmitz presented and read a proclamation, proclaiming November 25 – December 10, 2014 as “Zonta Says No Days of Activism to End Violence Against Women and Girls” in the City of Dothan. Leslie Hicks and other representatives of Zonta were present for the proclamation. Bettye Forbus, Houston-Love Memorial Library Director, updated the Commission on the two new libraries. Charlotte Mitchell, Downtown Branch Manager, distributed a handout showing statistical data and activities happening at each of the libraries. Commissioner Dorsey thanked Police Chief Greg Benton, Major Steve Parrish and the Dothan Police Department (DPD) for their quick response regarding a recent burglary that occurred at his home. Commissioner Dorsey said he has received phone calls regarding the intersection of Grey Hodges Road and Highway 431 being dangerous, and he requested that this intersection be looked at to determine if something can be done. Commissioner Dorsey said he has received several phone calls from people wanting to reach out and help the victims of the Barstone Apartments fire. He expressed appreciation for their response and said we have a very loving community. Commissioner Baxley thanked Fire Chief Larry Williams and the Dothan Fire Department (DFD) for the great job they have done fighting the recent rash of fires and said he has received several phone calls commending them for their response. Commissioner Baxley introduced Jamar Ivey and said they are shadowing each other as part of Farm City Week. On behalf of the Commission, Mayor Schmitz recognized retiring Finance Director Angela Palmer. He said the City has been extraordinarily fortunate to have her in a leadership position, and he thanked her for her service. City Manager West said Mrs. Palmer has been a cornerstone to the City and is a great advisor. He said she is the best finance director he’s ever worked with and she will be missed. He presented Mrs. Palmer with a plague in appreciation for her service. Mrs. Palmer thanked City Manager West and the Commission, both past and present, for their Minutes of the Board of Commissioners – November 18, 2014, continued. support. She said she is leaving the City in capable hands, and she is proud of her department and to have served. Mayor Schmitz invited Sharon Cherry to the podium to talk about an exciting event taking place in Dothan tomorrow. Ms. Cherry announced that over 2,000 children will join together in the Dothan Civic Center tomorrow at 10:00 a.m. to break the Guinness World Record for largest hip-hop dance performance, and she invited everyone to attend. She said Patti Rutland Jazz Outreach has choreographed the dance, Ben Vereen will be here for the event, and Commissioner Dorsey will be the deejay. She thanked Mayor Schmitz, the City of Dothan and Dothan City Schools for their support. Mayor Schmitz said a Veteran’s Day Ceremony was held at the local Veterans of Foreign Wars (VFW) Post, and it was an extraordinary event. He said a dinner was held for Wounded Warriors last night, and he recognized a local group, lead by Jeep Sullivan, who takes veterans on hunting and fishing outings. Mayor Schmitz said he cannot express in words how grateful he is for the sacrifice of our military, and he expressed appreciation to the community for their support. City Manager West, along with Public Works Director Jerry Corbin and Engineering Services Manager Bart Barefoot, presented Wayne McKinnon with a service award for thirty-five years of service with the City. City Manager West announced that the winners of the 2014 ARPA State Soccer Tournament held November 15th-16th in Opelika, AL included the following Dothan Leisure Services teams: 9U Boy’s, 9U Girls, 11U Boys, 11U Girls, and 13U Co-Ed. City Manager West announced City offices will be closed in observance of Thanksgiving on Thursday, November 27th and Friday, November 28th. Regarding the sanitation schedule, Thursday residents will receive garbage and recycling pick-up on Wednesday, November 26th and Friday residents will receive garbage and recycling pick-up on their regularly scheduled day of Friday, November 28th. There will be no trash collection for Thursday or Friday residents. City Manager West said the DFD has responded to five working fires over the past week. He thanked Chief Williams for his leadership, and he expressed appreciation to all the DFD and DPD members for their dedication. Mayor Schmitz introduced the application of Theron Paul Nelson for a Pool Hall License, located at 110 East Crawford Street. Commissioner Kirkland moved for approval, motion seconded by Commissioner Baxley and unanimously carried. Mayor Schmitz announced a Public Hearing regarding the abatement and removal of noxious or dangerous weeds. There being no one present to speak, Mayor Schmitz declared the Public Hearing closed. Mayor Schmitz introduced Ordinance No. 2014-298 (recorded in Ordinance Book No. _______at Page_______), amending Chapter 106, Vegetation, of the Code of Ordinances of the City of Dothan by adding Article III, Sections 38-39. Commissioner Baxley moved for immediate consideration, motion seconded by Commissioner Kirkland and upon the motion being put to vote, those voting “yea,” were Schmitz, Dorsey, Newsome, Kirkland, Ferguson, and Baxley; “nay:” none. The motion was carried by the majority of six “yeas” to no “nays.” Commissioner Baxley then moved for adoption of Ordinance No. 2014-298, motion seconded by Commissioner Kirkland and upon the motion being put to vote, those voting “yea,” were Schmitz, Dorsey, Newsome, Kirkland, Ferguson, and Baxley; “nay:” none. The motion was carried by the majority of six “yeas” to no “nays.” Mayor Schmitz introduced Ordinance No. 2014-299 (recorded in Ordinance Book No. _______at Page_______), ordering a Special Municipal Election to be held in the City of Dothan, Alabama on Tuesday, February 10, 2015 and a second or Run-Off Election, if necessary, on March 24, 2015 for the purpose of electing an Associate Commissioner for District 5 of the City of Dothan. Commissioner Baxley moved for immediate consideration, motion seconded by Commissioner Kirkland Minutes of the Board of Commissioners – November 18, 2014, continued. and upon the motion being put to vote, those voting “yea,” were Schmitz, Dorsey, Newsome, Kirkland, Ferguson, and Baxley; “nay:” none. The motion was carried by the majority of six “yeas” to no “nays.” Commissioner Baxley then moved for adoption of Ordinance No. 2014-299, motion seconded by Commissioner Kirkland and upon the motion being put to vote, those voting “yea,” were Schmitz, Dorsey, Newsome, Kirkland, Ferguson, and Baxley; “nay:” none. The motion was carried by the majority of six “yeas” to no “nays.” Mayor Schmitz introduced Ordinance No. 2014-300 (recorded in Ordinance Book No. _______at Page_______), establishing the hours for which the polls will be open for voting in the Special Municipal Election to be held on February 10, 2015 and the Run-Off Election, if necessary, to be held on March 24, 2015. Commissioner Baxley moved for immediate consideration, motion seconded by Commissioner Kirkland and upon the motion being put to vote, those voting “yea,” were Schmitz, Dorsey, Newsome, Kirkland, Ferguson, and Baxley; “nay:” none. The motion was carried by the majority of six “yeas” to no “nays.” Commissioner Baxley then moved for adoption of Ordinance No. 2014-300, motion seconded by Commissioner Kirkland and upon the motion being put to vote, those voting “yea,” were Schmitz, Dorsey, Newsome, Kirkland, Ferguson, and Baxley; “nay:” none. The motion was carried by the majority of six “yeas” to no “nays.” Mayor Schmitz introduced Resolution No. 2014-301 (recorded in Ordinance Book No._______at Page_______), appointing Susan Anderson as Associate Commissioner for District 5 of the City of Dothan to serve until such time as a duly qualified candidate is elected in accordance with State Law. Commissioner Ferguson moved for adoption, motion seconded by Commissioner Kirkland. Mayor Schmitz expressed appreciation to the media for doing a great job in notifying the public of the Commission’s openness to listening to any District 5 resident interested in serving as interim. He said he is encouraged by the number of people who responded to serve. He thanked the Commission for this appointment and said he is grateful Mrs. Anderson is willing to serve. There being no further discussion, the resolution was unanimously adopted. Mrs. Anderson said she appreciates this opportunity and the vote of confidence. She said she looks forward to learning from everyone on the Commission and representing the great constituents of District 5. Mayor Schmitz invited everyone to attend Mrs. Anderson’s swearing-in ceremony on Monday, November 24th at 9:00 a.m. in the Commission Chambers. Mayor Schmitz introduced Resolution No. 2014-302 (recorded in Ordinance Book No._______at Page_______), appointing Lisa H. Reeder as Finance Director- Treasurer at an annual salary of $89,086.40 to be paid on a biweekly basis effective November 30, 2014. Commissioner Ferguson moved for adoption, motion seconded by Commissioner Baxley and unanimously adopted. Mayor Schmitz, on behalf of the Commission, thanked Mrs. Reeder for her service. Mayor Schmitz introduced Resolution No. 2014-303 (recorded in Ordinance Book No._______at Page_______), declaring certain properties which are overgrown with weeds, scrub, wild bushes, grass and other vegetable growth as injurious to the health, safety and welfare of the community as nuisances and ordering that the properties be abated. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Baxley and unanimously adopted. Mayor Schmitz introduced Resolution No. 2014-304 (recorded in Ordinance Book No._______at Page_______), approving Change Order No. 1 to Donald Smith Company of Headland, Alabama to deduct $25,602.50 from the original contract amount, resulting in a final contract price of $353,876.50. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Baxley and unanimously adopted. Mayor Schmitz introduced Resolution No. 2014-305 (recorded in Ordinance Book No._______at Page_______), entering into a permit agreement with the Alabama Department of Transportation for the installation of a tap and valve with water main Minutes of the Board of Commissioners – November 18, 2014, continued. for fire line, taps with copper service line, each with service meters and tap with copper service line and irrigation meter for two new restaurants located at the 5000 Block of Montgomery Highway (US 231 N) in Dothan. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Baxley and unanimously adopted. Mayor Schmitz introduced Resolution No. 2014-306 (recorded in Ordinance Book No._______at Page_______), awarding the bid, entering into a contract and issuing a Notice to Proceed to Air Conditioning Associates for the Chiller Replacement and HVAC Upgrades to the Civic Center Complex in the amount of $263,050.00, which includes the Base Bid, Alternate 1, and Alternate 3. Commissioner Newsome moved for adoption, motion seconded by Commissioner Kirkland and unanimously adopted. Mayor Schmitz introduced Resolution No. 2014-307 (recorded in Ordinance Book No._______at Page_______), accepting a Recreational Trails Program grant in the amount of $100,000.00 administered by the Alabama Department of Economic and Community Affairs for the development of trails at the project location of the 3200 and 4200 blocks of Fortner Street and the 300 block of Narcisse Drive in Dothan and appropriating funds for said grant. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Baxley. Mayor Schmitz said he is grateful for this grant, and City Manager West said this is a major step forward for the project. There being no further discussion, the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2014-308 (recorded in Ordinance Book No._______at Page_______), approving the vacation and annulment of a portion of Peachtree Drive to the use of the public as a street right-of-way. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Baxley. City Manager West said this section of the road has never been developed. There being no further discussion, the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2014-309 (recorded in Ordinance Book No._______at Page_______), agreeing to donate a Command Vehicle to Friends of Army Aviation-Ozark from the Dothan Fire Department. Commissioner Dorsey moved for adoption, motion seconded by Commissioner Kirkland. Doc Holiday, Vice President and CEO of the Friends of Army Aviation-Ozark, gave an overview of the organization’s mission and said this vehicle will be used to transport their membership to various events. Mr. Holiday presented Mayor Schmitz, Chief Benton, and Chief Williams with a Certificate of Appreciation from the Friends of Army Aviation for this donation. There being no further discussion, the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2014-310 (recorded in Ordinance Book No._______at Page_______), approving payment of invoices for the month of October, 2014 in the amount of $14,657,659.93. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Baxley and unanimously adopted. Mayor Schmitz announced that interested candidates for Associate Commissioner District 5 must qualify by 5:00 p.m. on Wednesday, November 26th and any questions regarding this may be directed to City Clerk Danner.
