BOARD OF COMMISSIONERS CITY OF DOTHAN, ALABAMA REGULAR MEETING APRIL 21, 2015 The Board of Commissioners of the City of Dothan, Alabama, met in regular session in the Commission Chambers of the Roy Driggers Municipal Building at 10:00 A.M., Tuesday, April 21, 2015 with the following members present: Mayor Mike Schmitz, Associate Commissioners Kevin Dorsey, Amos M. Newsome, Jr., Albert Kirkland, John Ferguson, Beth Kenward, and Hamp Baxley. Also present were City Manager Michael West, City Clerk Tammy Danner, Assistant City Clerk Wendy Shiver who recorded the Minutes of the Meeting, and the local news media representatives. Mayor Schmitz called the meeting to order. Pastor Ricky Plummer, Bethel Baptist Church, then led in prayer, afterwhich Commissioner Dorsey led in the Pledge of Allegiance to the Flag. Commissioner Baxley moved that the Minutes of the Meeting of April 7, 2015, be approved, motion seconded by Commissioner Kirkland and unanimously approved. Mayor Schmitz introduced Zachary Nelson and Colin Roth, 8th grade students from Carver Magnet School who raised money for Career-A-Thon, and as their prize, chose to spend the day with the mayor. Mayor Schmitz presented and read a proclamation, proclaiming May 4-8, 2015 as “Small Business Week” in the City of Dothan. Lori Wilcoxon and Dean Mitchell, Dothan Area Chamber of Commerce were present for the proclamation. Mayor Schmitz presented and read a proclamation, proclaiming May 6-12, 2015 as “National Nurses Week” in the City of Dothan. Sandra Bryant, Advisor for Association of Student Practical Nurses, Wallace Community College, Jackie Spivey, Division Director of Associate Degree Nursing, Wallace Community College, and other representatives were present for the proclamation. Mayor Schmitz invited Derek Boulware, Executive Director, East Alabama Chapter American Red Cross, to provide an update to the Commission on the Wiregrass Area American Red Cross. Mr. Boulware presented information about the Wiregrass Area American Red Cross and played a brief video. He thanked Mayor Schmitz for agreeing to be the guest speaker on Tuesday, May 19th at their annual volunteer appreciation event sponsored by Flowers Hospital, and he extended an invitation to all Commission members. Commissioner Dorsey announced that he will hold a community forum on Thursday, April 30th at New Attitude Church, 1579 Montgomery Highway. He said a cleaner community and the report card will be the topics of discussion. Mayor Schmitz recognized State Representative Dexter Grimsley, who was present in the audience, and thanked him for his service. Commissioner Newsome asked City Manager West if any department heads are involved in automobile referral inside or outside the city limits. City Manager West confirmed there are no department heads involved in automobile referral. Commissioner Newsome said a few weeks ago there was a report that the EEO Officer was involved in referrals and he did not get any information as to whether or not any department heads were involved in referrals. Commissioner Newsome said there is a house being demolished at 827 South Appletree Street and he asked if it is being demolished according to regulations when there is asbestos involved in the building. Planning Director Todd McDonald confirmed for City Manager West that the City is in the process of abating this house and checking for asbestos is not part of the abatement process. Commissioner Newsome said he has spoken to residents across the street from Minutes of the Board of Commissioners – April 21, 2015, continued. where the house is being demolished who are concerned because the house does have asbestos and they are asking for some relief. City Manager West said we will follow-up to make sure our procedures comply with all requirements. Commissioner Newsome asked for a report to be given in hard print and City Manager West said he will do this. Commissioner Newsome said that after he found out Police Chief Greg Benton was resigning, he went to City Manager West’s office and talked with him extensively about some items, and he asked City Manager West if he remembered what those items were. City Manager West said one was about moving the Howell School project somewhere else, one was about how we were going through the Ferguson report, one was about recycling for the printing company on Main Street, and they also talked about the recruitment of the police chief. Commissioner Newsome said that he told City Manager West during their conversation that this was a good time to take a look at how well the City of Dothan is policing in relation to the Department of Justice (DOJ) findings in Missouri. City Manager West said he had asked EEO Officer Darryl Mathews to start going through the report. Commissioner Newsome said he told City Manager West that he did not want the report; he wanted to take a look at the areas in which the statistics were gathered by the DOJ so that we can look at our statistics in those same areas to see how well we are doing. He said if we are not doing very well it is a good time to reorient the chief of police to move in that direction. He said if we are doing well, very good we can be the best. Commissioner Newsome asked why he has not received anything regarding this request. City Manager West said the police department has completed the report and someone from the police department called Commissioner Newsome yesterday to go over the report. Commissioner Newsome said he received a call from Captain Robinson yesterday to see if he wanted to sit down, but that is not what he wanted. He said he asked the city manager for that report. City Manager West told Commissioner Newsome that Executive Assistant Sarah Woodham also has the information he requested available for him. Commissioner Newsome then asked Mr. Mathews to come up to the podium. Commissioner Newsome said City Manager West informed him of his selection at 9:00 a.m. on Friday and Mr. Mathews called him some time in the afternoon. He stated that Mr. Mathews told him he had some problems reviewing the 193 page report, and he told Mr. Mathews he did not ask him for any report. He said he requested Mr. Mathews to put in writing anything he had to report to him and put it on hid desk. Commissioner Newsome said he told Mr. Mathews if he is trying to report from the city manager concerning that info, then he needs to make sure he reports to the city manager and not to him. He asked Mr. Mathews if he remembered him telling him that, and Mr. Mathews replied that he did. Commissioner Newsome said he told the city manager that we have an opportune time to ensure we have the best police department not just in Alabama but in the whole United States. He said let’s look at this report from the Justice Department and look at the areas of training, equipment, diversity, etc. to know where we stand. City Manager West said they have been working on this and there are a lot more than statistics in the report. He said there are a lot of policies that are being looked at as well. Commissioner Newsome said he would like the referrals for automobile dealerships inside and outside the city limits and he would like to have statistics on how the city’s police department is doing in relation to the DOJ findings. He asked if he can get this and City Manager West replied that he can. Commissioner Newsome said he cannot task a department head for anything, he can only task the city manager, and when that is done, he expects a reply in that direction. He said he wants to make this clear. Commissioner Kirkland said he has been out of town a couple of weeks on vacation and it sure is good to be back in Dothan! Mayor Schmitz said he wanted to take a moment to personally thank Chief Benton before moving on to the next item on the agenda. He said he has gotten to know Chief Benton and his leadership, and he has served with honor. Mayor Schmitz said he is grateful for Chief Benton’s service, he is proud of his new opportunity, and we will miss him. City Manager West presented Chief Benton with a retirement certificate for twenty- five years of service with the City of Dothan. City Manager West recognized Chief Benton for his leadership and expressed appreciation for his service. Minutes of the Board of Commissioners – April 21, 2015, continued. City Manager West gave his Annual Report on the Financial Condition of the City. His report covered topics on: Five Year Forecast; Ten Year Information of Historical Expenditures; Fund Balance; Major Service Expenditures; Debt Service; Comparison of Revenues to Other Cities; Potential Revenue Sources; Facility, Fleet, Computer & Capital Identified Needs; and the City’s Path Forward. In summary, City Manager West said the City is financially strong, sales tax revenue is showing some signs of economic recovery, our current reserves are adequate, our strategic planning process is exceptional, our credit rating is strong, our quality of life is second to none, and the City provides exceptional services. Mayor Schmitz said this Commission over the years has put a lot of money aside for storm events and projects. He said the recommended amount of reserves is 8 percent, and even after putting money aside, we are at 31 percent in reserves. He said this is a balance that the City is handling well. He said he is proud of the community and this Commission for being concerned about our finances, addressing our challenges, and reinvesting in our community. He expressed gratitude for the Dothan Area Chamber of Commerce, Chamber President Matt Parker, and the leadership of Houston County and the Commission. Mayor Schmitz said he is grateful to sit on a commission that is financially conservative while also being proactive to reinvesting in our community. He thanked City Manager West for his leadership. City Manager West made the following announcements: • The Hardee’s Pro Classic Women’s Tennis Tournament kicked off Sunday, April 19th at the Westgate Tennis Complex, and will continue through Sunday, April 26th. City Manager West invited everyone to come out to the event, and he thanked Hardee’s for their sponsorship. • Opening ceremonies for Walton Park’s Little League was rescheduled due to the rain event last weekend and will take place at 10:00 a.m. on Saturday, April 25th. • The Dothan Fire Department is holding a “Burgers for Babies” sale for March of Dimes from 11:00 a.m. until 1:00 p.m. on Friday, April 24th. • The next internal Dothan Leadership Academy is being planned for May 19th-20th, and he invited Commission members to drop by if able. • Discussions with staff have started regarding preparing for the upcoming hurricane season. Mayor Schmitz introduced the application of Janna Everett for a Special Events Retail License (on premise) for Wiregrass Blues Fest & Gumbo Cook Off, located at 126 Museum Avenue. Commissioner Baxley moved for approval, motion seconded by Commissioner Dorsey and unanimously carried. Mayor Schmitz introduced the application of Samantha Creel for a Restaurant Retail Liquor License (on premise) for Hacienda Garcias, located at 2855 Ross Clark Circle, Suite 100. Commissioner Kirkland moved for approval, motion seconded by Commissioner Baxley and unanimously carried. Mayor Schmitz introduced the application of Maulik M. Patel for a Retail Beer and Retail Table Wine License (off premise) for Beeline 643, located at 1378 Hodgesville Road. Commissioner Kirkland moved for approval, motion seconded by Commissioner Ferguson and unanimously carried. Mayor Schmitz announced a Public Hearing regarding the demolition and removal of unsafe structures. Mayor Schmitz noted that there are two properties under appeal, and he invited Howard Newsome to speak on 817 East Adams Street and 821 McKay Street. Mr. Newsome reviewed a list of improvements to be made to include roof repair, window repair or replacement, deck repair, siding repair, and debris removal for 817 East Adams Street and roof repair, fence repair, window repair or replacement, debris removal, and interior upgrades to comply with city codes for 821 McKay Street. City Manager West asked if a permit has been Minutes of the Board of Commissioners – April 21, 2015, continued. pulled, and Mr. Newsome replied that permits have been pulled for both properties. City Manager West advised that the Commission will typically vote for demolition of the property at this point in the process; however, as long as there is an active permit and work is being performed, the City will not demolish the structure. Mr. McDonald stated that neither structure has an active permit at this time. He explained that a 30-day repair permit was pulled on March 9th for 817 East Adams Street, but no inspections were ever requested and the permit expired on April 9th. He said Code Enforcement Inspector Brad Hughes has had verbal contact with Mr. Newsome to try to move the process along but has not had any luck. He said they have recently placed a power pole and have done some clearing of the property. He pointed out that there is a swimming pool, hidden from view, in the back corner of the 821 McKay Street property. He said this is of particular concern as it poses a rather serious public safety issue for the City. Mr. McDonald advised that a 30-day permit is contingent on showing substantial continued progress on resolving the nuisance issues. He said they will be happy to do the same with this property, and Mr. Hughes will visit the site on a regular basis to make sure target goals are being accomplished. Mr. McDonald requested that the Commission leave these properties on the list for approval so that staff may have flexibility to move forward with demolition if nothing is done. Commissioner Ferguson confirmed with Mr. McDonald that it is the responsibility of the permit holder to request inspections. Commissioner Newsome stated that he received a telephone call from Dyxie Newsome Lincoln requesting time to repair these properties and he asked Mr. McDonald who is shown as the property owner? Mr. McDonald noted that Ms. Lincoln sent him a letter requesting an extension in time and this letter was provided to the Commission prior to the meeting. Mr. McDonald said that the recorded owner of the properties is Jessie Lois Newsome C/O Howard Newsome. Commissioner Dorsey stated that he has received several phone calls regarding this property and something needs to be done. He said he is noticing owners of nuisance properties start working on the issues only after receiving notice from the City and he is sick of it, as are his constituents, because a lot of these properties have been in bad condition for years. He said that, while he believes in giving people grace periods, some are not making progress. Commissioner Newsome asked Mr. Newsome how much time he needs to make the corrections. Mr. Newsome said he would need one month for each property and he requested these be consecutive months for a total of 60 days. Mayor Schmitz asked if there is anyone else present who wishes to speak on their property during this public hearing. Lenora Butler said she is speaking on behalf of her mother who lives at 577 Britt Lane in the historic district. She said her mother is present but unable to stand. She said her mother received notification that the house is not in the safety code and she read a letter of response. She said they have obtained a permit, have started work, and are asking for a six-month period of time to fix the issues. She said they are in litigation with the insurance company and this is holding them up somewhat. Commissioner Ferguson noted that the address of 577 Britt Lane is not included on the resolution for today’s agenda. Ms. Butler said there was a notice published in Sunday’s newspaper and that is why they are here today. Mayor Schmitz advised Ms. Butler that this property will be scheduled for action at a future meeting and hopefully, the issues can be resolved before that time. Ed Vaughn said he lives behind this address. He explained that they had a fire at this property and they are in litigation with the insurance company. He said they have pulled a permit and will bring it into compliance. Lois Barber of Barber’s Grocery at 801 Williams Avenue said she came before the commission last month, was given the opportunity to repair the structure, and she has talked to a contractor who is going to repair her roof. Ms. Barber said has talked to her attorney who advised her to contact her state representative Dexter Grimsley, who is present today. She said Larry Johnson is here today as well to explain her situation. Mayor Schmitz noted that Mr. Johnson is a local architect and business owner. Mr. Johnson said he is helping Ms. Barber with the process and he is working with Mr. McDonald and Mr. Hughes to make sure the issues are rectified. He requested another extension be granted to enable this to happen. Representative Grimsley said Ms. Barber contacted him regarding joint property owner and lien issues with the Alabama Department of Revenue (ADOR). He said he feels these issues have been rectified and Ms. Barber can continue to work with ADOR so that she may move forward with taking care of the property. Mayor Schmitz said safety is the issue with this property and, while he personally does not have a problem giving Ms. Barber another 30 days, something has to happen. City Manager West confirmed for Mayor Schmitz that this property has been Minutes of the Board of Commissioners – April 21, 2015, continued. approved for demolition, but as long as progress is being made, it will not be bid out. Mayor Schmitz requested Mr. Johnson work with Mr. McDonald to move forward. There being no further discussion, Mayor Schmitz declared the Public Hearing closed. Mayor Schmitz introduced Resolution No. 2015-95 (recorded in Ordinance Book No._______at Page_______), declaring certain properties as creating a nuisance, constituting a hazard to the public health, safety and convenience of the citizens and authorizing the demolition and removal of said properties. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Dorsey and unanimously adopted. Mayor Schmitz introduced Resolution No. 2015-96 (recorded in Ordinance Book No._______at Page_______), appointing Steven L. Parrish as Police Chief at an annual salary of $98,521.28, effective May 1, 2015. Commissioner Ferguson moved for adoption, motion seconded by Commissioner Kirkland. Commissioner Newsome thanked Personnel Director Delvick McKay for responding to the letter he sent to Mr. McKay early on. Commissioner Newsome said he had two or three questions and he received an answer to the first question but the second question was somewhat left open. Commissioner Newsome asked Mr. McKay if he made recommendations to City Manager West. Mr. McKay said he did not make any recommendations, and he explained that he and his staff supplied City Manager West with those candidates that met the minimum qualifications. Mr. McKay confirmed for Commissioner Newsome that one of the top candidates City Manager West was considering decided to remove himself from the process. Commissioner Newsome asked Mr. McKay if it is a part of his responsibilities to take a look at people who apply for jobs from a personnel expertise and recommend the top people to the city manager for selection. Mr. McKay said no, this is not the case for unclassified positions as this is the sole responsibility of the city manager. Commissioner Newsome said he asked a question concerning affirmative action because he knows this is usually embedded in personnel because they are the people who see people coming, who make a decision on those people, who look at qualifications. He said he asked what criteria were used in the recommendations, such as experience, training, qualifications, and education. He asked Mr. McKay if he applied the thought and the action in his decision affirmatively. Mr. McKay said yes, and this is customary for all of the positions that the City advertises externally. He said we advertise with predominately historically black colleges and universities, fraternities and sororities, and civic groups. Commissioner Newsome said the applicants have been provided to him, but he has not had the opportunity to review the information and he has not gotten answers so he just wanted to feel that out with Mr. McKay because this is very concerning. He said this is embedded in looking at the DOJ’s statistics on what could be done to make a better department, and he asked Mr. McKay if this is correct. Mr. McKay agreed that hiring and diversity is certainly very important. Commissioner Newsome said he sent a letter to City Manager West but the response he received from City Manager West said Mr. McKay provided a notebook with applications for the City of Dothan Police Chief and Mrs. Woodham has this notebook. Commissioner Newsome asked City Manager West what was his criteria in selecting the chief of police. City Manager West said his criteria included education, experience, and discussions held with the applicants. City Manager West said Mr. McKay has never recommended a department head to him and has always provided him with the people who meet the minimum qualifications. City Manager West explained that ultimately, in this case, he felt the Police Department is going in the right direction, Major Parrish has been a part of that, and we need to continue the track we are on. City Manager confirmed for Commissioner Newsome that the minimum education requirement is a bachelor’s degree and Major Parrish does have a bachelor’s degree. Commissioner Newsome asked if any applicants with a master’s degree were recognized, and City Manager West said there were some candidates. City Manager West noted that education is only one component and another is experience in a city our size. Commissioner Newsome mentioned one of the candidates selected as a finalist, and he asked City Manager West how large is the city he serves. City Manager West said the candidate spent 22 years in Huntsville, Alabama as a police officer, and the city he currently serves in is approximately 3,000 people. Commissioner Newsome asked City Manager West if, in his best judgment, he selected the best candidate for the chief of the City of Dothan, and City Manager West replied that Minutes of the Board of Commissioners – April 21, 2015, continued. he did. Commissioner Newsome asked how the statistics of Dothan compare to DOJ’s statistics. City Manager West explained that, as part of the Commission on Accreditation for Law Enforcement Agencies (CALEA) process, the Police Department is required to do a report annually on all of these items, and compared to Ferguson, Missouri, Dothan looks very well. Commissioner Newsome asked why he did not receive this information. City Manager West said it was made available yesterday. Commissioner Newsome said yesterday is Monday before the meeting and he asked for this information shortly after the 11th of March. City Manager West said he just received it yesterday. Commissioner Newsome said it took more than a month, he finds this very strange, and he questioned the selection made. Commissioner Kirkland said the Commission hired the city manager to hire people and the Commissioners are just advisors. Commissioner Newsome said this is one of the worst he has seen and he doesn’t think the people are getting their money’s worth. Commissioner Dorsey asked for a show of how many people in the audience today are here on behalf of Steve Parrish, and a substantial number of those present raised there hands. Commissioner Ferguson said he feels we have the right man for the job, and he does not want anything said here today to diminish this day for him. He said it is a long time coming, and he has earned the right to do this job. Commissioner Ferguson said he appreciates Major Parrish, is excited about the plan he has for his department, and he looks forward to his leadership. Commissioner Ferguson said it seems all the information Commissioner Newsome requested has been made available, and whether or not he has read it is not his problem, and he is ready to vote on this. Mayor Schmitz said A.Y. Cotton, President of the Dothan Wiregrass Branch of the National Association for the Advancement of Colored People (NAACP) came to his office this morning and said someone used the local branch’s e-mail address to send out e-mails that were not his branch’s point of view. Mayor Schmitz said he was asked by Mr. Cotton to read the following message: “I would like to remind all citizens of the community the NAACP does not endorse any candidate in the political field whether state, local, or city government. We must all remember to continue to support our city leaders and continue on being a strong voice in the community for all citizens. On behalf of the NAACP mission statement, the mission of the NAACP is to ensure the political, educational, social, and economic equality of rights of all persons. Meetings are open to the public each month on the second and fourth Thursday.” Mayor Schmitz recognized Major Parrish, who five years ago was a captain and a finalist alongside Greg Benton for the position of police chief, for his support of Chief Benton and our City. Mayor Schmitz said he has made us better and stronger, and in fact, at their last Community Relations meeting, Major Parrish talked about Ferguson and how he is going to use the DOJ report in his department. He said Major Parrish and his command staff talked about a number of things they are doing to make our community better. Mayor Schmitz said he is grateful to the Police Department for their leadership. There being no further discussion and upon the motion being put to vote, those voting “yea,” were Schmitz, Dorsey, Kirkland, Ferguson, Kenward, and Baxley; “nay:” Newsome. The motion was carried by the majority of six "yeas" to one “nay.” Major Parrish expressed appreciation to City Manager West for his recommendation and the entire Commission for this opportunity. He said he is looking forward to working with the other departments in the City, City Manager West, this Commission, and the men and women of the Dothan Police Department. He said he has been with the department for 31 years, and he is looking forward to serving the community by promoting safety, security, and peace of mind. He said this is the key to economic development and he pledged that this is what the department will provide. Mayor Schmitz introduced Resolution No. 2015-97 (recorded in Ordinance Book No._______at Page_______), submitting an offer to Pate Montgomery, LLC in the amount of $150,000.00 with the balance of the total purchase price of $260,000.00 to be conveyed to the City of Dothan by charitable gift, and that the City of Dothan enter into a real estate sale contract for the purchase of a building and parking lot located at 125 North St. Andrews Street. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Baxley. City Manager West confirmed for Commissioner Dorsey that the appraisal price of the property is Minutes of the Board of Commissioners – April 21, 2015, continued. $260,000.00. There being no further discussion, the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2015-98 (recorded in Ordinance Book No._______at Page_______), approving certain improvements on SR-52 (within its City Limits) in accordance with plans prepared by the Alabama Department of Transportation, Resurfacing and 2’ safety widening on SR-52 from SR-12 (US 84) in Dothan to east of CR-55 Houston County. Commissioner Dorsey moved for adoption, motion seconded by Commissioner Kirkland and unanimously adopted. Mayor Schmitz introduced Resolution No. 2015-99 (recorded in Ordinance Book No._______at Page_______), submitting a loan application for 2015 CWSRF Loan to fund the Omussee Creek Wastewater Treatment Plant Improvements Project. Commissioner Dorsey moved for adoption, motion seconded by Commissioner Kirkland. City Manager West said the interest rate is 2.2 percent. Commissioner Kenward asked how much this loan will add to our debt service. City Manager West said it will add approximately 1.8 million dollars to the debt service payment. Commissioner Dorsey confirmed with City Manager West that this was the location of the police range and he asked if another location has been found. City Manager West said they are looking at other City-owned sites as possibilities. There being no further discussion, the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2015-100 (recorded in Ordinance Book No._______at Page_______), submitting a Transportation Alternatives Program application to the Alabama Department of Transportation for construction improvements, including construction engineering and inspection, for Westgate Parkway Sidewalk. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Baxley. City Manager West said we received a grant several years ago for this project but after ALDOT reviewed the plans, they over doubled the price of the project. City Manager West said this will put a sidewalk from Slingluff Elementary School to Northview High School. He confirmed for Commissioner Newsome that the sidewalk will be installed on the same side of the street as the schools are located. There being no further discussion, the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2015-101 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with Northstar Engineering Services, Inc. for professional surveying, engineering design services and construction administration for the Beaver Creek Elevated Walkway. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Dorsey. City Manager West said this will tie the two parcels on each side of Beaver Creek for the Forever Wild Project. He said this will allow people to cross from the Flowers Chapel Road side to the Fortner Street side. City Manager West confirmed for Commissioner Newsome that the agreement is at a cost not to exceed $20,000.00. There being no further discussion, the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2015-102 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with the Alabama Department of Transportation (ALDOT) for cost reimbursement for in-kind work to be installed on the right of way of S.R. 210 in conjunction with the ALDOT Project No. BRF-0210(506), replacement of Bridge Culvert on S.R. 210 near Bauman Road, and associated roadway widening. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Dorsey. City Manager West said the City is moving a water line, and ALDOT will reimburse us for the labor. He said this is an aging pipe that needs to be replaced anyway. There being no further discussion, the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2015-103 (recorded in Ordinance Book No._______at Page_______), accepting the proposal of McGriff, Seibels and Williams, Inc. for Specific Stop Loss Reinsurance for the City of Dothan’s Health and Accident Insurance Plan, as quoted by Unimerica/Optum. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Dorsey and unanimously adopted. Minutes of the Board of Commissioners – April 21, 2015, continued. Mayor Schmitz introduced Resolution No. 2015-104 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with the Alabama High School Athletic Association for the South Regional Basketball tournaments to be held February 16-25, 2016, February 15-23, 2017, and February 14-22, 2018, to be held at the Dothan Civic Center. Commissioner Dorsey moved for adoption, motion seconded by Commissioner Kirkland. In reference to the lot located beside the Wiregrass Museum of Art, Commissioner Newsome said gravel was put down and it did an excellent job of drying the water. He asked how this property will look for the tournament. City Manager West said the Public Works Department will evaluate and work on this lot prior to the tournament. Commissioner Newsome said that during the last basketball tournament there was still water and many of the attendees were finding the location difficult so this is a good opportunity. City Manager West agreed and said this tournament will bring people throughout the whole southern region in to Dothan. Commissioner Dorsey added that this is really good for the City as they could have chosen Troy but instead chose the great city of Dothan. Commissioner Newsome said we want them to come back so we need to do what we need to do. There being no further discussion, the resolution was unanimously adopted. It has the capability to determine the closest street route from one address location to another address location. This map is used by the officers in all Police vehicles. Commissioner Kirkland then moved for adoption of Resolution No. 2015-107, motion seconded by Commissioner Dorsey. In reference to the legal fee item, Commissioner Newsome asked how much money has been paid. City Manager West said there are two ongoing legal cases, and fees for both have reached well over $75,000.00 total. Commissioner Ferguson asked if there is an end in sight or if either will be going to trial. City Manager West said one is not represented by an attorney at this time and it is not known if that suit will move forward. He said the other case continues to be active with no end in sight.
