BOARD OF COMMISSIONERS CITY OF DOTHAN, ALABAMA REGULAR MEETING SEPTEMBER 1, 2015 The Board of Commissioners of the City of Dothan, Alabama, met in regular session in the Commission Chambers of the Roy Driggers Municipal Building at 10:00 A.M., Tuesday, September 1, 2015 with the following members present: Mayor Mike Schmitz, Associate Commissioners Kevin Dorsey, Amos M. Newsome, Jr., Albert Kirkland, John Ferguson, Beth Kenward, and Hamp Baxley. Also present were City Manager Michael West, City Clerk Tammy Danner, Assistant City Clerk Wendy Shiver who recorded the Minutes of the Meeting, and the local news media representatives. Mayor Schmitz called the meeting to order. Pastor Greg Wilmore, Victory Baptist Church, then led in prayer, afterwhich Commissioner Ferguson led in the Pledge of Allegiance to the Flag. Commissioner Baxley moved that the Minutes of the Meeting of August 18, 2015, be approved, motion seconded by Commissioner Kenward and unanimously approved. Mayor Schmitz presented and read a proclamation, proclaiming September 7-13, 2015 as “Suicide Prevention Week.” Melissa Cope, Wiregrass Suicide Prevention, was present for the proclamation. Mayor Schmitz presented and read a proclamation, proclaiming September 10, 2015 as “Black Out Cancer Day.” Taylore Logan, American Cancer Society, was present for the proclamation. Commissioner Dorsey thanked everyone who attended the Grand Opening of the Andrew Belle Pool on Saturday, August 29th. Commissioner Dorsey acknowledged Mayor Schmitz for recently being inducted into the Dothan Business Hall of Fame. He said we have a great mayor in the City of Dothan! Commissioner Kirkland reported that his good friend Jimmy Golden, who recently had a liver transplant, has come home and is doing well. He thanked everyone for their prayers. Commissioner Baxley recognized City of Dothan Schools Superintendent Dr. Charles Ledbetter as being present today, and he thanked him for meeting with the Commissioners individually to share his ideas and plans for the school system. Commissioner Baxley said he looks forward to working with Dr. Ledbetter. Mayor Schmitz introduced several people present at today’s meeting to include President of the NAACP A.Y. Cotton, Dothan Area Chamber of Commerce President Matt Parker, State Representative Paul Lee, and Houston County Commissioner Brandon Shoupe. Mayor Schmitz said the announcement was recently made that the 2016 Alabama State Games, which will be held here for the next two years, has been set for June 10th-12th. He said he met a Dothan athlete who won the Gold medal here for Taekwondo, went on to win the Gold medal at Nationals, and has now been invited to try out for the Olympic Trials. He said it is exciting to see local people having these types of opportunities. Mayor Schmitz announced that he will need to abstain from voting on item numbers 20 and 21 (agreements for television advertising) because his son is promoting an event taking place in November at the Dothan Civic Center. Minutes of the Board of Commissioners – September 1, 2015, continued. Mayor Schmitz said he and Houston County Commission Chairman Mark Culver had the honor of representing our community in New York where they talked with Standard and Poor’s about obtaining a rating for E911. He said this is the first rating of its kind in our state and a rating of AA- was given, which is one of the highest ratings. He said this shows the work that the Dothan/Houston County Communications District Board and mostly the Enhanced 911 Advisory Committee have done over many years. He said one of the items on today’s agenda is to vote on appointments to the new board. He said we have come a long way, this is an exciting time, and he is proud of everybody for their hard work. City Manager West made the following announcements: • City offices will be closed on Monday, September 7th in observance of Labor Day and there will be no sanitation collection on this date. Garbage and recycling collection will be rescheduled for Wednesday, September 9th. There will be no make-up day for trash collection. • Water World will close after the Labor Day weekend for the season. • The newly appointed E911 District Board members will hold their first meeting on Tuesday, September 8th. • A 9/11 Memorial Service will be held at Veteran’s Memorial Park on Friday, September 11th at 9:00 a.m. • The Andrew Belle Pool Grand Opening was a phenomenal event, and he expressed the importance of the park to the community. Mayor Schmitz said this is a first-class facility to be proud of. Mayor Schmitz introduced the application of Billie E. Stevens, Jr. for a Retail Beer and Retail Table Wine License (on or off premise) for Delectable Edibles and More, located at 150 North Foster Street. Commissioner Newsome moved for approval, motion seconded by Commissioner Kirkland. Commissioner Kenward recused herself from this vote because of her affiliation with the building. There being no further discussion and upon the motion being put to vote, those voting “yea,” were Schmitz, Dorsey, Newsome, Kirkland, Ferguson, and Baxley; “nay:” none; “abstained:” Kenward. The motion was carried by the majority of six "yeas" to one “abstention.” Mayor Schmitz introduced Resolution No. 2015-239 (recorded in Ordinance Book No._______at Page_______), declaring certain properties which are overgrown with weeds, scrub, wild bushes, grass and other vegetable growth as injurious to the health, safety and welfare of the community as nuisances and calling for a public hearing to be held on the matter during the regularly scheduled commission meeting on October 6, 2015. Commissioner Dorsey moved for adoption, motion seconded by Commissioner Baxley and unanimously adopted. Mayor Schmitz introduced Resolution No. 2015-240 (recorded in Ordinance Book No._______at Page_______), confirming the cost incurred in notification and abatement of certain properties determined to be nuisances by Resolution Number 2015-166 and 2015-188 and turning the costs over to the County Tax Collector so that the amounts can be added to the next regular bills for taxes levied against the respective lots and parcels of land. Commissioner Dorsey moved for adoption, motion seconded by Commissioner Kirkland and unanimously adopted. Mayor Schmitz introduced Resolution No. 2015-241 (recorded in Ordinance Book No._______at Page_______), confirming the cost incurred in notification and abatement of certain properties determined to be nuisances by Resolution Number 2015-207 and 2015-222 and turning the costs over to the County Tax Collector so that the amounts can be added to the next regular bills for taxes levied against the respective lots and parcels of land. Commissioner Baxley moved for adoption, motion seconded by Commissioner Kenward and unanimously adopted. Minutes of the Board of Commissioners – September 1, 2015, continued. Mayor Schmitz introduced Resolution No. 2015-242 (recorded in Ordinance Book No._______at Page_______), assessing properties for the cost of demolition of substandard structures and turning the amounts over to the county tax collector to be added to the next regular bills for taxes levied against the respective lots and/or parcels of land. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Dorsey and unanimously adopted. Mayor Schmitz introduced Resolution No. 2015-243 (recorded in Ordinance Book No._______at Page_______), designating the Dothan-Houston County Airport Authority as the granting authority for certain statutory tax incentive abatements pursuant to Act 2015-25, known as the “Alabama Reinvestment and Abatement Act”. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Dorsey. City Manager West pointed out that this designation is only for thirty days. Mayor Schmitz explained that we have a prospective customer at the airport and hope to announce the name soon. Commissioner Baxley said he will need to abstain from this vote due to his connection with the board. There being no further discussion, the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2015-244 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with Northstar Engineering for professional consulting services for the Westgate Parkway Sidewalk Project in the amount of $14,500.00. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Dorsey. Commissioner Newsome noted that this item was on the last meeting agenda, and he asked how it happened for it to be placed on today’s agenda. City Manager West explained that the motion made at the last meeting was not seconded, and the rules allow for the item to be brought forward again. Commissioner Newsome asked if there is anything in writing to substantiate this action, and City Clerk Danner said she will provide this rule for him. Commissioner Newsome said there have been other items which did not receive motions or seconds but were not brought back, and he asked what is the procedure to do this. Mayor Schmitz explained that there needs to be a request from a Commissioner and the Will of the Commission. He said Commissioner Dorsey asked to put this item back on the agenda because he believes people will vote for it and it is important to him. Commissioner Newsome said he is not aware of any search for Will as he was not asked if he had a Will. City Manager West confirmed for Commissioner Newsome that the next item on the agenda is contingent on this item. Commissioner Newsome noted that the next item is for the agreement of the 80% ($383,074.40) that the Federal Government will fund and the 20% ($95,768.60) that the City will fund for the project. City Manager West pointed out that the Commission recently approved the submission of the application for this project by unanimous vote. Commissioner Dorsey said he did ask Mayor Schmitz to place this item back on the agenda because 80% of the cost will be provided by federal funding and the sidewalk will connect two schools. Commissioner Dorsey invited Morris Slingluff Elementary School Principal Jeff Torrence to the podium to speak. Mr. Torrence said his school continues to collaborate with Northview High School (NHS), and he hopes for the students to be able to walk to NHS next year to attend day ballgames. He said this sidewalk will also allow parents in that community the opportunity to walk their kids to school and it will also provide beautification. Commissioner Ferguson asked if this project is part of the Metropolitan Planning Organization (MPO). City Manager West and Public Works Director Jerry Corbin provided background information regarding this project and explained that it is now part of the Transportation Alternatives Program (TAP). Commissioner Newsome inquired into the reason consulting services are necessary for this project, and he asked how many civil engineers are employed with the City. City Manager West said there are approximately ten civil engineers in the departments of Public Works and Dothan Utilities. Mr. Corbin explained that the Engineering Services Division has designed about 90% of all sidewalks installed in the City of Dothan, but this is an Alabama Department of Transportation (ALDOT) project which requires expertise we do not have. He said this project began several years ago and Northstar Engineering did the design, but the project was dropped because the cost estimate was more than the grant at that time. Commissioner Dorsey confirmed with Lee Brown of Northstar Engineering that their firm is located in Dothan. Commissioner Newsome confirmed with Mr. Brown that the fee of $14,500.00 is a lump sum proposal for Minutes of the Board of Commissioners – September 1, 2015, continued. the design phase through bidding of the project. Mr. Brown provided detail of the services included in the proposal. Commissioner Kenward asked for clarification regarding the list of approved engineering firms stipulated by the grant. Mr. Corbin said the grant requires the Construction Engineering and Inspection service to go through a solicitation process. He explained that if an engineering firm from ALDOT’s prequalified list is selected and ALDOT agrees with the selection, a price for that service is then negotiated with the engineering firm. Commissioner Kenward said she would love to see us have at least one employee who can handle the paperwork and process with ALDOT. Mr. Corbin said we can prepare to do this. Commissioner Newsome confirmed with City Manager West that this will not require any additional personnel. There being no further discussion and upon the motion being put to vote, those voting “yea,” were Schmitz, Dorsey, Newsome, and Kirkland; “nay:” Ferguson, Kenward, and Baxley. The motion was carried by the majority of four "yeas" to three “nays.” Mayor Schmitz introduced Resolution No. 2015-245 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with the State of Alabama for construction improvements, including engineering and inspection, for Westgate Parkway Sidewalk Project. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Dorsey. Commissioner Ferguson thanked Representative Paul Lee for helping with this grant. He said he understands we want to keep our sidewalks to school program going, and his only concern with this project was that the location is not in a densely populated area. He said Principal Torrence has somewhat swayed his opinion. He advised that since we have set this project in motion, we need to vote for it, but we need to do better homework in the future on items we are seeking grants for if we are not comfortable with them. There being no further discussion, the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2015-246 (recorded in Ordinance Book No._______at Page_______), accepting the proposal of Blue Cross/Blue Shield of Alabama to provide and administer a Group Health, Accident and Dental Self- Insurance Program for City employees and eligible retirees for a one year period beginning October 1, 2015. Commissioner Dorsey moved for adoption, motion seconded by Commissioner Kirkland and unanimously adopted. Mayor Schmitz introduced Resolution No. 2015-247 (recorded in Ordinance Book No._______at Page_______), entering into a contract with Wiregrass Rehabilitation Center, Inc. to provide maintenance services at an annual cost of $465,206.79 (plus approximately $17,000.00 per year for Rip Hewes Stadium cleanup). Commissioner Newsome moved for adoption, motion seconded by Commissioner Kirkland. City Manager West said there is no increase in the cost and this is a one year renewal contract. There being no further discussion, the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2015-248 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with State of Alabama for operation and maintenance of traffic control signals at the intersection of U.S. Hwy 84 and N. Shady Lane/Buckingham Drive. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Dorsey. City Manager West said the new Walmart development requires some slight changes to these traffic control signals, and Walmart will be paying for these modifications. Mayor Schmitz said we had a great meeting recently with Walmart, this is a unique project, and he is proud they are being proactive. There being no further discussion, the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2015-249 (recorded in Ordinance Book No._______at Page_______), entering into a permit agreement with the Alabama Department of Transportation for the installation of tapping tee, valve, and 8” DIP to right-of-way for a new hotel on Montgomery Highway. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Dorsey and unanimously adopted. Minutes of the Board of Commissioners – September 1, 2015, continued. Mayor Schmitz introduced Resolution No. 2015-250 (recorded in Ordinance Book No._______at Page_______), entering into a permit agreement with the Alabama Department of Transportation for the installation of tapping tee, valve, 8” DIP and 3” DIP to right-of-ways, and 2” type K copper pipe to right-of-way for a new retail store on Hwy 84 West. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Baxley. City Manager West said this is for Walmart. There being no further discussion, the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2015-251 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with Scenic Cable Network & Production for television advertising in the amount of $10,000.00. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Dorsey and upon the motion being put to vote, those voting “yea,” were Dorsey, Newsome, Kirkland, Ferguson, Kenward, and Baxley; “nay:” none; “abstained:” Schmitz. The motion was carried by the majority of six "yeas" to one “abstention.” Mayor Schmitz introduced Resolution No. 2015-252 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with WTVY for television advertising in the amount of $20,000.00. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Dorsey. Commissioner Kenward said she received some calls requesting detail of the time slots, and she thanked WTVY for providing this information. Public Works Director Marshall Perry confirmed for Commissioner Kenward that Requests for Proposals (RFPs) were sent out to over twenty media outlets that do television production, and he said these were the successful candidates. Commissioner Kenward thanked them for their partnership in making our Civic Center and the events very successful. Commissioner Newsome said this is the first time we have gone in this direction with marketing and he thinks we have missed out because of lack of advertising in much of the activities we have had in the past. He said he hopes this will turn things around and the Commission will be observing this closely. He said he expects a report back on how successful this has been, lessons learned, and ways to correct any deficiencies that may have caused the leak in our success. He thanked WTVY and Scenic Cable for their support. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Dorsey and unanimously adopted. City Manager West expressed that this is a wonderful children’s event, and he said it will be held on Saturday, October 3rd at Eastgate Park. Mayor Schmitz introduced Resolution No. 2015-254 (recorded in Ordinance Book No._______at Page_______), appointing Jerry Corbin and Steve Carlisle as the City of Dothan’s representatives on the City of Dothan-Houston County Communications District Board to serve a two-year term beginning September 3, 2015 and Joey Pilcher and Jason Rudd as the City of Dothan’s representatives on the City of Dothan-Houston County Communications District Board to serve a four- year term beginning September 3, 2015. Commissioner Kenward moved for adoption, motion seconded by Commissioner Baxley. Mayor Schmitz expressed appreciation to these representatives. Commissioner Kenward requested an explanation regarding the vendor chosen on the telecommunications bid. Interim I.T. Director Robb Meredeth discussed the specifications included in the RFP, and he explained that this vendor met those specifications as well as the lead times. He said the other vendors either did not meet those specifications or could not meet the lead times. Commissioner Dorsey thanked Mr. Meredeth for providing information to his constituent last month.
