BOARD OF COMMISSIONERS CITY OF DOTHAN, ALABAMA REGULAR MEETING JANUARY 19, 2016 The Board of Commissioners of the City of Dothan, Alabama, met in regular session in the Commission Chambers of the Roy Driggers Municipal Building at 10:00 A.M., Tuesday, January 19, 2016 with the following members present: Mayor Mike Schmitz, Associate Commissioners Kevin Dorsey, Amos M. Newsome, Jr., Albert Kirkland, John Ferguson, Beth Kenward, and Steve McCarroll. Also present were City Manager Michael West, City Clerk Tammy Danner, Assistant City Clerk Wendy Shiver who recorded the Minutes of the Meeting, and the local news media representatives. Mayor Schmitz called the meeting to order. Pastor Bobby Marks, Cornerstone Church, then led in prayer, afterwhich Commissioner Dorsey led in the Pledge of Allegiance to the Flag. Commissioner Kirkland moved that the Minutes of the Meeting of January 5, 2016, be approved, motion seconded by Commissioner Dorsey and unanimously approved. Mayor Schmitz presented and read a proclamation, proclaiming February 4, 2016 as “Public Education Day for the City of Dothan.” Dothan Education Foundation President Tami Culver and other representatives were present for the proclamation. Commissioner Dorsey announced that he will be having a forum at Greater Beulah Baptist Church on Thursday, January 21st from 6:00 p.m. until 8:00 p.m. to discuss “Issues Concerning Race - A REAL Uncomfortable Conversation.” He said food will be provided and everyone is encouraged to be in attendance. Commissioner Ferguson said he would like to commend Commissioner Dorsey for all the hard work he does to try to improve his district, and he has grown to really appreciate him for all he does for his community. Commissioner Ferguson said he knows Commissioner Dorsey has faced a lot of criticism lately, and he wants him to know he considers him a friend and he has a lot of respect for him. He said the Commission is on his team and will help him in any way they can. Commissioner Ferguson said he thinks we have failed our chief of police the last couple of meetings. He said obviously we want to be able to give the community the opportunity to voice concerns, but he does not think some of the comments that have been made are appropriate for Police Chief Steve Parrish, any of our employees, or our department heads. Commissioner Ferguson said he is sorry he stayed silent, he considers Chief Parrish a friend, and he respects him. He said Chief Parrish is doing a great job for the citizens of Dothan, and as far as he is concerned, it is not going to happen again in this forum. He apologized to Chief Parrish for not speaking previously on his behalf. Commissioner Kenward said the Commission’s strategic planning session held this past weekend confirmed for her that we are all very much on the same page as far as our vision for Dothan and what we need to do to get there. She said there was a lot of fruitful conversation and a lot of valuable work was accomplished. She noted that much was achieved in 2015, and she said she sees lots of great things coming for 2016. She said it is a wonderful thing that our city takes the time to sit down and strategically plan because it affects all of us. Mayor Schmitz reminded everyone that the District 6 Special Municipal Election will be held on Tuesday, February 9th. He encouraged voters to get to know the two candidates, David Crutchfield and Gary Roney, and to vote on Election Day. Mayor Schmitz said there was a lot of discussion and much work was accomplished at the strategic planning session held this past weekend. He said the Commission examined a large number of items which were narrowed down to Minutes of the Board of Commissioners – January 19, 2016, continued. six major priorities. He said this was probably the most active planning session in his seven years, and he is grateful for everyone’s participation. Mayor Schmitz said he had the honor of attending the Martin Luther King Jr. Day celebration at Greater Beulah Baptist Church yesterday and hearing John Gray, Associate Pastor with Joel Osteen at Lakewood Church in Houston, speak. Mayor Schmitz said this was a great event. City Manager West made the following announcements: • Fort Rucker AUSA Kickoff Luncheon will be held on Thursday, January 28th at 11:30 a.m. in the Dothan Civic Center. Jeff Coleman will be the keynote speaker. • Spring baseball and softball registration is underway and will continue through Saturday, January 23rd. Interested players may register at their regional recreation center. • Miracle League registration will be held on Saturday, January 23rd and Saturday, January 30th at 9:00 a.m. at the Miracle Complex-Westgate Park. • The Community Development Advisory Board will hold a public hearing at Greater Beulah Baptist Church at 6:30 p.m. on Thursday, January 21st which starts off the Competitive Process for preparation of this year’s Community Development Block Grant. • A Bidder Enrollment Seminar will be hosted by the Purchasing Division in the Civic Center Board Room at 1:00 p.m. on Thursday, January 21st. • The “How to Do Business with the City of Dothan” free workshop will be conducted on Tuesday, February 9th in the City Commission Chambers beginning at 5:30 p.m. City Manager West said this year’s strategic planning session was the best yet, and he thanked the Commission for their participation. He said knowing their priorities is important to both him and staff as they move forward. Mayor Schmitz announced a Public Hearing regarding the abatement and removal of noxious or dangerous weeds. There being no one present to speak, Mayor Schmitz declared the Public Hearing closed. Mayor Schmitz introduced Resolution No. 2016-15 (recorded in Ordinance Book No._______at Page_______), declaring certain properties which are overgrown with weeds, scrub, wild bushes, grass and other vegetable growth as injurious to the health, safety and welfare of the community as nuisances and ordering that the properties be abated. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Kenward and unanimously adopted. Mayor Schmitz introduced Resolution No. 2016-16 (recorded in Ordinance Book No._______at Page_______), entering into a Memorandum of Agreement with the Alabama Law Enforcement Agency (ALEA) for reimbursement of registration fees in the amount of $2,600.00 for student officers successfully graduating from the Alabama Criminal Justice Training Center in Selma, Alabama. Commissioner Kirkland moved for adoption, motion seconded by Commissioner McCarroll and unanimously adopted. Mayor Schmitz introduced Resolution No. 2016-17 (recorded in Ordinance Book No._______at Page_______), appropriating the necessary funds, awarding the Motor Control Panels with SCADA bid, entering into contract, and issuing a Notice of Award, Notice to Proceed and other related documents to Revere Control Systems, Inc. in the amount of $170,827.00. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Kenward. City Manager West noted that $140,000.00 has been brought over from last year and the remaining $30,877.00 is being allocated. City Manager West explained that the SCADA system will provide direct communication with the wells and will be able to identify potential hazards that can be fixed before there are overflows. He advised that this is also part of our fiber network to improve communication. City Manager West confirmed for Commissioner Ferguson that as we continue with our rehab effort this will still be a viable part of our maintenance. There being no further discussion, the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2016-18 (recorded in Ordinance Book No._______at Page_______), executing the ADEM Notification for Aboveground Storage Tank documents for the newly installed aboveground petroleum storage tank located at the Water Production Well #30. Commissioner Newsome moved for adoption, motion seconded by Commissioner Kirkland. City Manager West said this goes along with a generator that has been placed at this well. There being no further discussion, the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2016-19 (recorded in Ordinance Book No._______at Page_______), entering into a permit agreement with the Alabama Department of Transportation for the installation of one thousand seventy (1070) feet of ACSR Conductor and four (4) forty-five (45) feet poles along US Highway 431/AL Highway 210/AL Highway 52 to provide a looped service feed to Publix located at 1620 Ross Clark Circle. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Newsome. City Manager West said Publix is buying the materials for this. Commissioner Ferguson asked if they have had issues and is this is a repair job. Electric Operations Superintendent Chris Phillips said the developer did not install a loop feed when the Publix at Cottonwood Corners was developed. Mr. Phillips explained that Publix is looking at adding some emergency generation to all of their stores and completing this loop will allow them to do so without affecting the other customers. Commissioner McCarroll asked if it is feasible for the utilities to be installed underground rather than aboveground because people prefer to have utilities underground and fewer telephone and electrical poles when possible. Mr. Phillips explained that the actual feed to the development is underground because it is a smaller load but the larger lines on the right-of-way of the Ross Clark Circle will be overhead and sized accordingly to feed future loads at that development. There being no further discussion, the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2016-20 (recorded in Ordinance Book No._______at Page_______), entering into a contract with Polyengineering, Inc., for a proposal to inspect the Dixie Standpipe (#1), Napier Field (#2), Cherry Street (#3), Greentree Avenue (#4) and Wallace (#13) water tanks for the lump sum price of $23,200.00. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Dorsey. Commissioner Kenward asked how often inspections are done. Dothan Utilities Director Billy Mayes advised that the coating service life is 15-18 years and when coatings get older more inspections are performed. He said they try to inspect each tank within a ten year period the first time and then approximately five years. There being no further discussion, the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2016-21 (recorded in Ordinance Book No._______at Page_______), awarding the bid, entering into a contract and issuing a Notice to Proceed to Cox Pools for the Water World Wave Pool Re- Plaster project in the amount of $221,000.00. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Dorsey. Commissioner Ferguson said the last Water World report he has is from 2013, and he asked if the Commission will be receiving a Water World report this year. City Manager West said a report was done last year, and Leisure Services Director Elston Jones said this year’s report is almost ready. Commissioner Ferguson said it would be nice to have it before voting to spend this amount of money on repairs. There being no further discussion, the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2016-22 (recorded in Ordinance Book No._______at Page_______), awarding the bid, entering into a contract, approving Change Order No. 1 and issuing a Notice to Proceed to Cox Pools for the Lining Replacement for the Westgate Indoor Pool in the amount of $172,750.00. Commissioner Kirkland moved for adoption, motion seconded by Minutes of the Board of Commissioners – January 19, 2016, continued. Commissioner Dorsey. Commissioner Ferguson asked if the litigation from several years ago with the contractor of this pool has been resolved. City Manager West said this lawsuit was going on when he became city manager in 2004, it has been resolved, and they paid the City $10,000.00. Regarding this change order, City Manager West said Cox Pools inspected the current gutter system and recommended that it be replaced while replacing the liner because they do not feel the gutters will last as long as the liner. He said the net increase is $13,000.00. Commissioner Dorsey said he is happy this is a local company. There being no further discussion, the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2016-23 (recorded in Ordinance Book No._______at Page_______), approving Change Order No. 1 (Final) to deduct $31,040.00 from the original contract amount with Donald Smith Company for Refurbishment of Water Wells, resulting in a final contract price of $398,970.00 and an increase of project time of 60 days, resulting in a completion date of March 6, 2016. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Dorsey and unanimously adopted. Mayor Schmitz introduced Resolution No. 2016-24 (recorded in Ordinance Book No._______at Page_______), approving payment of invoices for the month of December, 2015 in the amount of $12,121,661.99. Commissioner Newsome moved for adoption, motion seconded by Commissioner Kirkland and unanimously adopted. Mayor Schmitz introduced Resolution No. 2016-25 (recorded in Ordinance Book No. _______at Page_______), awarding a bid received by the City.
