BOARD OF COMMISSIONERS CITY OF DOTHAN, ALABAMA REGULAR MEETING MAY 17, 2016 The Board of Commissioners of the City of Dothan, Alabama, met in regular session in the Commission Chambers of the Roy Driggers Municipal Building at 10:00 a.m., Tuesday, May 17, 2016 with the following members present: Mayor Mike Schmitz, Associate Commissioners Kevin Dorsey, Amos M. Newsome, Jr., Albert Kirkland, John Ferguson, Beth Kenward, and David Crutchfield. Also present were City Manager Michael West, City Clerk Tammy Danner, Assistant City Clerk Wendy Shiver who recorded the Minutes of the Meeting, and the local news media representatives. Mayor Schmitz called the meeting to order. Pastor Kenneth Robinson, Alabama Avenue Missionary Baptist Church, then led in prayer, afterwhich Commissioner Kenward led in the Pledge of Allegiance to the Flag. Commissioner Kirkland moved that the Minutes of the Meeting of May 3, 2016, be approved, motion seconded by Commissioner Kenward and unanimously approved. Mayor Schmitz presented and read a proclamation, proclaiming May, 2016 as “Foster Care Month” in the City of Dothan. Jessica Oppert, Houston County Department of Human Resources was present for the proclamation. Mayor Schmitz presented and read a proclamation, proclaiming the week of May 15-21, 2016 as “Police Week” in the City of Dothan. Police Chief Steve Parrish was present for the proclamation. Chief Parrish recognized and presented the Officer of the Year Award to Corporal Jonathan Godwin, the Supervisor of the Year Award to Lieutenant Rachel David, and the Employee of the Year Award to Public Safety Dispatcher I Taylor Williams. Mayor Schmitz presented and read a proclamation, proclaiming the week of May 15-21, 2016 as “Emergency Medical Services Week” in the City of Dothan. Fire Chief Larry Williams and Captain Sean Gibson were present for the proclamation. Chief Williams and Captain Gibson recognized and presented the John T. Ingram Emergency Medical Technician (EMT) of the Year Award to Firefighter Robert Forbes and the Paramedic of the Year Award to Sergeant Brady Reeder. Commissioner Dorsey thanked everybody for coming out to the fundraiser held at the Andrew Belle Community Center on Saturday, May 14th where, along with the help of Magic 93.1 FM, Darryl E. and Marcus Kage, $2,180.47 was raised and this means 1,090 kids will be able to swim free for a day. Commissioner Kirkland said he is glad Mayor Schmitz is back and he appreciates him for all he does. Commissioner Crutchfield welcomed Mayor Schmitz back, and he reminded everyone that Foster Fest is being held Friday night. He said this is a great event to attend downtown. Commissioner Newsome congratulated Mayor Schmitz on his son’s engagement. Mayor Schmitz said his son and future daughter-in-law will be getting married on July 9th, and he is proud she is going to be part of their family. Mayor Schmitz thanked the Commission and the community for allowing him to go on a 35 day journey with his son. He said the journey, called the El Camino, is a 500 mile pilgrimage over the Pyrenees Mountains, starting in France and ending in Santiago, Spain and it is where James the Disciple went out through the world and preached the gospel. He said it was an incredible time spent with his son, and he appreciates this time. Mayor Schmitz said he missed Dothan, he missed being mayor, and he is proud to be back. He said he appreciates the Commission for working so hard while he was gone and for supporting his journey. Minutes of the Board of Commissioners – May 17, 2016, continued. Mayor Schmitz said the Mayor’s Ride for Fitness on Saturday, May 14th was a great event and the turnout was incredible. City Manager West said everybody had fun and it may have been the largest crowd ever. Mayor Schmitz said he has a lot of calls to catch up on but promised to do so over the next few days. City Manager West made the following announcements: • Water World and all public pools will open daily for the summer beginning Saturday, May 21st until school starts back. He asked everyone to visit and support your local Water World and your local pool. • The annual “Bark in the Park” fundraiser for animal efforts will be held Saturday, May 21st at Eastgate Park starting at 10:00 a.m. • The Dothan Police Department will host the annual Police Memorial Service at 2:00 p.m. in the Dothan Opera House on Wednesday, May 18th. He encouraged everyone who has the opportunity to attend to please do so. • Graduation for Northview High School is Thursday, May 19th, and Dothan High School is Friday, May 20th, both at 7:00 p.m. at Rip Hewes Stadium, with a rain date set for Saturday. • The ARPA State Track Meet is being held this weekend in Trussville. • City offices will be closed on Monday, May 30th in observance of Memorial Day and there will be no sanitation collection on this date. Garbage and recycling collection will be rescheduled for Wednesday, June 1st. There will be no trash collection for Monday residents. • The new Dothan Utilities Collection center opens on Monday, May 23rd on North Saint Andrews Street across from the Dothan Civic Center. He said Finance Director Lisa Reeder, General Services Director Randy Morris, and staff have done a great job renovating the building. • Foster Fest will be Friday night, this event grows every year, and everyone is invited to come downtown and have fun. • The Poplar Head Farmer’s Market will be open on Saturdays beginning June 4th in the Civic Center parking lot with fresh locally grown fruits and vegetables. • There will be graduations taking place at the Civic Center this Thursday and Friday. Please have patience with parking on these days. • The Forever Wild trail located on Fortner Street closest to Ross Clark Circle will officially open on Saturday, June 4th, and the gate will be open from 6:30 a.m. until dark. • Please keep Fire Captain Jimmy Ward and his family in your prayers as he is at UAB and not doing well. Mayor Schmitz introduced Ordinance No. 2016-132 (recorded in Ordinance Book No. _______at Page_______), rezoning property owned by Southland Bancorporation located at the southwest corner of Ross Clark Circle and Choctaw Street from O-2 (Office Park) and R-2 (Residential Single-Family, Medium Density) Districts to B-3 (Local Shopping) District. Commissioner Ferguson moved for immediate consideration, motion seconded by Commissioner Kirkland and upon the motion being put to vote, those voting “yea,” were Schmitz, Dorsey, Newsome, Kirkland, Ferguson, Kenward, and Crutchfield; “nay:” none. The motion was carried by the majority of seven “yeas” to no “nays.” Commissioner Ferguson then moved for adoption of Ordinance No. 2016-132, motion seconded by Commissioner Kirkland and upon the motion being put to vote, those voting “yea,” were Schmitz, Dorsey, Newsome, Kirkland, Ferguson, Minutes of the Board of Commissioners – May 17, 2016, continued. Kenward, and Crutchfield; “nay:” none. The motion was carried by the majority of seven “yeas” to no “nays.” Mayor Schmitz introduced Ordinance No. 2016-133 (recorded in Ordinance Book No. _______at Page_______), rezoning property owned by Cathy Rase located at 2846 Columbia Highway from H-I (Heavy Industry) District to B-2 (Highway Commercial) District. Commissioner Ferguson moved for immediate consideration, motion seconded by Commissioner Kenward and upon the motion being put to vote, those voting “yea,” were Schmitz, Dorsey, Newsome, Kirkland, Ferguson, Kenward, and Crutchfield; “nay:” none. The motion was carried by the majority of seven “yeas” to no “nays.” Commissioner Kenward then moved for adoption of Ordinance No. 2016-133, motion seconded by Commissioner Crutchfield and upon the motion being put to vote, those voting “yea,” were Schmitz, Dorsey, Newsome, Kirkland, Ferguson, Kenward, and Crutchfield; “nay:” none. The motion was carried by the majority of seven “yeas” to no “nays.” Mayor Schmitz introduced Resolution No. 2016-134 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with the Alabama Department of Transportation to trim trees and underbrush by utility lines along AL/US Route No. 52 (beginning at Milepost No. 59 and ending at Milepost No. 60.85) Dothan, Alabama. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Ferguson and unanimously adopted. Mayor Schmitz introduced Resolution No. 2016-135 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with the Alabama Department of Transportation to trim trees and underbrush by utility lines along AL/US Route No. 210 (beginning at Milepost No. 0.5 and ending at Milepost No. 2.3) Dothan, Alabama. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Dorsey and unanimously adopted. Mayor Schmitz introduced Resolution No. 2016-136 (recorded in Ordinance Book No._______at Page_______), entering into a permit agreement with the Alabama Department of Transportation for the installation of a tapping sleeve and valve, ductile iron pipe, fire hydrant, and two taps with water meters for new Krystal’s restaurant in Dothan, AL. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Crutchfield and unanimously adopted. Mayor Schmitz introduced Resolution No. 2016-137 (recorded in Ordinance Book No._______at Page_______), agreeing to allow the Fire Department to issue a fireworks permit for the Alabama State Games Fireworks Display to be held on Friday, June 10, 2016. Commissioner Kenward moved for adoption, motion seconded by Commissioner Crutchfield and unanimously adopted. Mayor Schmitz introduced Resolution No. 2016-138 (recorded in Ordinance Book No._______at Page_______), agreeing to donate and transfer ownership of Dothan Police Canine Rocky to Joseph Mosner; Dothan Police Canine Zipo to Darren Moody; and Dothan Police Canine Max to Peter Jones. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Crutchfield. City Manager West explained that these dogs are being retired and given to their handlers. There being no further discussion, the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2016-139 (recorded in Ordinance Book No._______at Page_______), amending Resolution No. 2012-29 with Legacy Inmate Communications to provide the Inmate Communications Management System (iCON) in the Dothan City Jail to meet the new Federal Communications Commission (FCC) Order 15-136 setting call charges. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Kenward. City Manager West said this will put us in compliance with the FCC rules. There being no further discussion, the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2016-140 (recorded in Ordinance Book No._______at Page_______), accepting the proposal submitted by Carmichael Engineering, Inc., for construction monitoring and testing for the Westgate Minutes of the Board of Commissioners – May 17, 2016, continued. Aquatics Center, in the amount of $17,116.00. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Kenward and unanimously adopted. Mayor Schmitz introduced Resolution No. 2016-141 (recorded in Ordinance Book No._______at Page_______), applying for and accepting a Community Involvement Grant Award from the United States Tennis Association in the amount of $2,000 to assist with expenses related to the Kids Day Event held during the 2016 USTA Dothan Pro Circuit Tennis Tournament, and appropriating funds for said grant award. Commissioner Kenward moved for adoption, motion seconded by Commissioner Kirkland and unanimously adopted. Mayor Schmitz introduced Resolution No. 2016-142 (recorded in Ordinance Book No._______at Page_______), approving payment of invoices for the month of April, 2016 in the amount of $10,775,523.59. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Newsome and unanimously adopted.
