BOARD OF COMMISSIONERS CITY OF DOTHAN, ALABAMA REGULAR MEETING MARCH 21, 2017 The Board of Commissioners of the City of Dothan, Alabama, met in regular session in the Commission Chambers of the Roy Driggers Municipal Building at 10:00 a.m., Tuesday, March 21, 2017 with the following members present: Mayor Mike Schmitz, Associate Commissioners Kevin Dorsey, Amos M. Newsome, Jr., Albert Kirkland, John Ferguson, Beth Kenward, and David Crutchfield. Also present were City Manager Michael West, City Clerk Tammy Danner, Assistant City Clerk Wendy Shiver, who recorded the Minutes of the Meeting, and the local news media representatives. Mayor Schmitz called the meeting to order. Zachary Grice, Grandview Baptist Church, then led in prayer, afterwhich Commissioner Newsome led in the Pledge of Allegiance to the Flag. Commissioner Kenward moved that the Minutes of the Meeting of March 7, 2017, be approved, motion seconded by Commissioner Dorsey and unanimously approved. Mayor Schmitz said we are privileged to have Rehobeth Mayor Joe Collins and Slocomb Mayor Rob Hinson here today, and in response to letters received from both mayors, he invited them to the podium to speak about the terrible weather events their cities have experienced this year. Mayor Collins and Mayor Hinson spoke about the recent storm events that affected their cities, and they expressed appreciation for the City of Dothan’s quick response and assistance provided after the storms. Mayor Schmitz thanked the Commission, City Manager West, and staff for their concern and response, and he thanked Mayor Collins and Mayor Hinson for their leadership. Mayor Schmitz invited Kiwanis Club of Dothan members John Taylor, Ben Freeman, T.J. Haywood, Critt Snellgrove, and Brandon Ziegenfelder to the podium. Mr. Taylor spoke on behalf of the Kiwanis Club, talked about Kiwanis Park at Westgate, and explained that the organization would like to give back more to the community by providing a $1,000.00 yearly donation for the City to use at its discretion. He said the City has agreed to allow the Kiwanis Club in exchange for this donation to place a sign at James Oates Park, preferably along the walking trail. He expressed their hope that this effort grows and the citizens of Dothan will understand the next time a Kiwanian approaches them to buy a pancake ticket or take part in their golf tournament. At this time, a check in the amount of $1,000.00 for the City was presented to Mayor Schmitz from the Kiwanis Club of Dothan. Mayor Schmitz expressed gratitude to the Kiwanis Club of Dothan. Mayor Schmitz presented and read a proclamation, proclaiming March 21, 2017 as “Down Syndrome Day.” Rhonda Hicks and F.R.I.E.N.D.S organization members were present for the proclamation. Mayor Schmitz presented and read a proclamation, proclaiming April 2-8, 2017 as “Crime Victims’ Rights Week.” Patricia Jones was present for the proclamation. Commissioner Dorsey said more than 1.3 million dollars has been invested at the Windmill Station off of Headland Avenue in the last several years, and he asked the Commission to take a look at the improvements being made and be kind in providing assistance to help them along the way. Commissioner Kirkland said he would like to further the comments made by Mayor Collins and Mayor Hinson. He said District 3 received quite a bit of damage in recent storm events, and he thanked staff for the efficient cleanup they provided. Minutes of the Board of Commissioners – March 21, 2017, continued. Commissioner Kenward said most members of the Commission traveled to Washington, DC last week to participate in a National League of Cities (NLC) conference. She said she is glad to be home and Dothan is blessed to not face the challenges that many other cities face. She said we love one another, we get along, we communicate well, and she comes home with a very thankful heart for not only our citizens but our surrounding area. Mayor Schmitz said the Alabama State Games is coming up and this is our third year hosting the event. He said the City has contributed $5,000.00 towards this year’s event and the Alabama Sports Festival (ASF) Foundation has requested an additional $10,000.00 from the City to be used for advertising. Mayor Schmitz asked for this request to be granted as the Foundation would like to advertise the event and promote our area statewide. He said this is a first class event, and he shared information provided by the Dothan Area Convention and Visitors Bureau regarding the number of participants who have competed here and the economic impact in our City. Mayor Schmitz said thirteen high school students attended the NLC Conference in Washington, DC with the Commission last week and they had the opportunity to visit many sites. He spoke about the students’ achievements, and he said we are blessed to have great kids in our community. City Manager West reminded the Commission that the request listed under Communications from City Clerk, Item No. 7, will require a vote to remove because the address listed on the alcohol application is wrong. City Manager West made the following announcements and comments:  Special Olympics will take place at 10:00 a.m. tomorrow, March 22nd, at the Dothan High School track, and he encouraged the public to attend.  Alabama State Games press conference will be held at 2:00 p.m. on Wednesday, March 22nd, in the Commission Chambers.  James Oates Park playground community build will be Saturday, March 25th and volunteers are needed. Leisure Services Assistant Director of Programs Roy Kitts said another 30-40 participants are needed, and he invited anyone over the age of 18 who would like to volunteer to pre-register for meal count purposes by calling the office at 615-3700.  The Grand Opening of James Oates Park will be held at 9:00 a.m. on Saturday, April 8th. Opening ceremonies will follow at 10:00 a.m. for American Little League from Doug Tew and at 11:00 a.m. for Girls’ Softball. This is a great day in the City of Dothan! James Oates Park is a major addition to our Leisure Services activities and it provides a venue for larger tournaments to come to our City.  Expressed thanks to National Little League for dedicating their season to Westgate staff. He said this was a really nice gesture and the staff does a great job maintaining, not only the little league complex, but the entire park.  Kickoff for Dothan 101 will be Tuesday, April 18th and will continue for nine weeks ending on Tuesday, June 13th. Assistant City Clerk Wendy Shiver has agreed to be the coordinator since Administrative Secretary Anita Fulton is having some medical issues. The class is over half full, this is a great course, and those who have never attended are invited to participate. Mayor Schmitz said the request under the next item will need to be removed from the agenda because the wrong address was listed on the advertisement and the request will need to be re-advertised with the correct address. Commissioner Ferguson made a motion to remove the application of Vishal Anand for a Lounge Retail Liquor License – Class II (off premise) for Fast Stop Liquor 2 Minutes of the Board of Commissioners – March 21, 2017, continued. located at 1147 South Oates Street, motion seconded by Commissioner Kirkland and unanimously approved. Mayor Schmitz introduced a proposed ordinance, amending Chapter 102, Utilities, Article I, In General; Article II, Electric Service, Division 1, Generally; and Article III, Water Service, Division 2, Rates, Charges and Billing, Section 102-137, Senior citizen discount on water usage, of the City of Dothan Code of Ordinances. Commissioner Kirkland moved for immediate consideration, motion seconded by Commissioner Crutchfield and upon the motion being put to vote, those voting “yea,” were Schmitz, Newsome, Kirkland, Ferguson, Kenward, and Crutchfield; “nay:” Dorsey. Without unanimous consent for immediate consideration, the proposed ordinance will be placed on the next commission agenda. City Clerk Danner explained that consideration of the next ordinance is contingent on passage of the previous item, and therefore, a motion is needed to table the next item for two weeks. Commissioner Kenward made a motion to table item no. 9, amending Chapter 2, Administration, Sec 2-242, Checks and drafts in payment of city accounts, of the City of Dothan Code of Ordinances, for two weeks, motion seconded by Commissioner Crutchfield and unanimously approved. Mayor Schmitz introduced Ordinance No. 2017-86 (recorded in Ordinance Book No. _______at Page_______), rezoning property owned by Marlie Holdings, LLC, located in the 5800 block of W. Main Street from B-3 (Local Shopping) District to O-I (Office/Institutional) District. Commissioner Kenward moved for immediate consideration, motion seconded by Commissioner Kirkland and upon the motion being put to vote, those voting “yea,” were Schmitz, Dorsey, Newsome, Kirkland, Ferguson, Kenward, and Crutchfield; “nay:” none. The motion was carried by the majority of seven “yeas” to no “nays.” Commissioner Kirkland then moved for adoption of Ordinance No. 2017-86, motion seconded by Commissioner Kenward. Upon Commissioner Kirkland’s request, City Manager West clarified the number of lots being rezoned, the current zoning classifications, and the proposed zoning classifications. There being no further discussion and upon the motion being put to vote, those voting “yea,” were Schmitz, Dorsey, Newsome, Kirkland, Ferguson, Kenward, and Crutchfield; “nay:” none. The motion was carried by the majority of seven “yeas” to no “nays.” Mayor Schmitz introduced Resolution No. 2017-87 (recorded in Ordinance Book No._______at Page_______), declaring certain properties which are overgrown with weeds, scrub, wild bushes, grass and other vegetable growth as injurious to the health, safety and welfare of the community as nuisances and calling for a public hearing to be held on the matter during the regularly scheduled commission meeting on April 18, 2017. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Dorsey and unanimously adopted. Mayor Schmitz introduced Resolution No. 2017-88 (recorded in Ordinance Book No._______at Page_______), confirming the cost incurred in notification and abatement of certain properties determined to be nuisances by Resolution Number 2017-18 and 2017-31 and turning the costs over to the County Tax Collector so that the amounts can be added to the next regular bills for taxes levied against the respective lots and parcels of land. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Dorsey and unanimously adopted. Mayor Schmitz introduced Resolution No. 2017-89 (recorded in Ordinance Book No._______at Page_______), approving a Petty Cash Fund in the amount of $1,500.00 for the Leisure Services Department to be used for James Oates Park. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Crutchfield. City Manager West said this is common in all our parks. There being no further discussion, the resolution was unanimously adopted. Minutes of the Board of Commissioners – March 21, 2017, continued. Mayor Schmitz introduced Resolution No. 2017-90 (recorded in Ordinance Book No._______at Page_______), entering into a Memorandum of Agreement with the Alabama Law Enforcement Agency (ALEA) for reimbursement of registration fees in the amount of $3,900.00 for student officers successfully graduating from the Alabama Criminal Justice Training Center (ACTJC) in Selma, Alabama. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Dorsey and unanimously adopted. Mayor Schmitz introduced Resolution No. 2017-91 (recorded in Ordinance Book No._______at Page_______), entering into contract with Praestare Engineering in the amount of $35,000.00 to provide engineering services for the Limestone Creek Drainage Basin Study and cost estimates for possible improvements, and appropriating funds for said services. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Dorsey. City Manager West said this is the final of the four drainage basins the Commission decided to move forward with at the recently held work session. Commissioner Dorsey said he is glad to see this is a local contract. There being no further discussion, the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2017-92 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with Ring Power Corporation for rental of a bucket truck to be used for the installation of transmission line to the E. Burdeshaw Substation and to upgrade the transmission line at the South Park Substation at $10,000.00 per month. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Dorsey. Commissioner Kenward said she would like to make a motion to amend the resolution to read “$10.000.00 per month, for one month” to make it clear the $10,000.00 is being spent one time for one month and not in perpetuity. City Manager West explained that the City has one bucket truck of this height and the additional bucket truck is needed so the line can be pulled from both ends for this installation. City Manager West confirmed for Commissioner Newsome that the job can be completed in one month. Commissioner Kirkland withdrew his motion for adoption and Commissioner Dorsey withdrew his second to the motion. Commissioner Kenward then made a motion to amend the resolution to add “for one month” on the last sentence, motion seconded by Commissioner Crutchfield and unanimously approved. Commissioner Crutchfield moved for approval of the resolution as amended, motion seconded by Commissioner Dorsey and unanimously adopted. Mayor Schmitz introduced Resolution No. 2017-93 (recorded in Ordinance Book No._______at Page_______), entering into a permit agreement with the Alabama Department of Transportation for the installation of one (1) tapping tee and valve with approximately 10 linear feet of ductile iron pipe for fire line and one (1) tapping tee and valve with approximately 30 linear feet of ductile iron pipe for fire hydrant to serve addition to Wayne Farms processing plant located in Dothan. Commissioner Dorsey moved for adoption, motion seconded by Commissioner Kirkland. City Manager West said this means more jobs. There being no further discussion, the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2017-94 (recorded in Ordinance Book No._______at Page_______), appointing Ruby Harris as a member of the Community Development Advisory Board to fill the unexpired term of Patsy Greenwood. Commissioner Newsome moved for adoption, motion seconded by Commissioner Kirkland and unanimously adopted. Mayor Schmitz acknowledged Ms. Harris as being present in the audience, and he thanked her for serving. Mayor Schmitz introduced Resolution No. 2017-95 (recorded in Ordinance Book No._______at Page_______), approving payment of invoices for the month of February, 2017 in the amount of $18,148,870.88. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Kenward. City Manager West explained that this amount includes a debt service payment of over $4 million. Mayor Schmitz expressed appreciation for their many years of serving our community. There being no further discussion, the motion was unanimously approved.
