BOARD OF COMMISSIONERS CITY OF DOTHAN, ALABAMA REGULAR MEETING AUGUST 1, 2017 The Board of Commissioners of the City of Dothan, Alabama, met in regular session in the Commission Chambers of the Roy Driggers Municipal Building at 10:00 a.m., Tuesday, August 1, 2017 with the following members present: Mayor Mike Schmitz, Associate Commissioners Kevin Dorsey, Amos M. Newsome, Jr., Albert Kirkland, John Ferguson, Beth Kenward, and David Crutchfield. Also present were City Manager Michael West, City Clerk Tammy Danner, Assistant City Clerk Wendy Shiver, who recorded the Minutes of the Meeting, and the local news media representatives. Mayor Schmitz called the meeting to order and welcomed everyone to the newly remodeled Commission Chambers. Pastor Ricky Plummer, Bethel Baptist Church, then led in prayer, afterwhich Commissioner Kenward led in the Pledge of Allegiance to the Flag. Commissioner Kirkland moved that the Minutes of the Meeting of July 18, 2017, be approved, motion seconded by Commissioner Dorsey and unanimously approved. Mayor Schmitz said Alabama Secretary of State John Merrill has sent a team from his office to assist with the election, and he invited a member of the team to speak. Attorney Brent Beal came forward and introduced Daniel Dean, Eugenia Stone, and Clay Helms. Mr. Beal said they are thankful the Mayor and members of the Commission invited them here today and embraced their presence. He said Dothan has a City Clerk who does an amazing job and this makes the election process so much better. He said it was important for them to be here today because they want the citizens to know they care about every vote, they will be here all day watching, and if things come up, they will certainly investigate that after the election. He said they are hoping for an uneventful day in the beautiful city of Dothan and they will be here until the last vote comes back. Commissioner Newsome requested City Manager West to follow up with the Wiregrass Transit Authority regarding the fixed public transportation routes outline they were promised a few weeks ago. Commissioner Kirkland thanked the Public Works Department for the street resurfacing currently taking place in District 3. Commissioner Kenward said it is good to be back at home in our Commission Chambers. City Manager West made the following announcements and comments:  The Dothan Police Department will host the 2017 National Night Out event on Saturday, August 5th from 5:00 p.m. until 8:00 p.m. in the Civic Center. The event allows the public the opportunity to interact with law enforcement and other agencies.  The Dothan City Schools will have their district wide teachers meeting on Tuesday, August 8th beginning at 7:30 a.m. in the Civic Center. Anyone planning to do business on this day should anticipate parking issues.  Southeast Alabama Medical Center’s annual Men’s Health Fair will be held from 8:00 a.m. until 11:00 a.m. on Saturday, August 12th in the Civic Center. This event is open to the public and is a wonderful opportunity to receive free health screenings.  Water World will be open through Tuesday, August 8th, and then will be open on weekends only through Labor Day, Monday, September 4th. Minutes of the Board of Commissioners – August 1, 2017, continued.  Staff will be hosting a development forum in the Opera House on Friday, August 18th from 9:00 a.m. until 12:00 p.m. Developers, builders, realtors, and associated trades are being solicited for the opportunity to meet with staff and give feedback. The Commission is requested to attend some or all of the forum.  Today is Election Day! Voting is not a privilege; it’s an obligation. Please get out and vote.  We have a group in town repairing a transformer and we would like to do an emergency repair while they are here in order to save money. This will be added to the next agenda and the cost is estimated to be $23,000.00. Mayor Schmitz announced a Public Hearing regarding the abatement and removal of noxious or dangerous weeds. There being no one present to speak, Mayor Schmitz declared the Public Hearing closed. Mayor Schmitz introduced Resolution No. 2017-234 (recorded in Ordinance Book No._______at Page_______), declaring certain properties which are overgrown with weeds, scrub, wild bushes, grass and other vegetable growth as injurious to the health, safety and welfare of the community as nuisances and ordering that the properties be abated. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Kenward and unanimously adopted. Mayor Schmitz introduced Resolution No. 2017-235 (recorded in Ordinance Book No._______at Page_______), declaring certain properties which are overgrown with weeds, scrub, wild bushes, grass and other vegetable growth as injurious to the health, safety and welfare of the community as nuisances and calling for a public hearing to be held on the matter during the regularly scheduled commission meeting on September 5, 2017. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Newsome and unanimously adopted. Mayor Schmitz introduced Resolution No. 2017-236 (recorded in Ordinance Book No._______at Page_______), confirming the cost incurred in notification and abatement of certain properties determined to be nuisances by Resolution Number 2017-117 and 2017-161 and turning the costs over to the County Tax Collector so that the amounts can be added to the next regular bills for taxes levied against the respective lots and parcels of land. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Kenward and unanimously adopted. Mayor Schmitz introduced Resolution No. 2017-237 (recorded in Ordinance Book No._______at Page_______), confirming the cost incurred in notification and abatement of certain properties determined to be in violation of Article III, Chapter 106 of the City of Dothan Code of Ordinance (repeat offenders) and turning the costs over to the County Tax Collector so that the amounts can be added to the next regular bills for taxes levied against the respective lots and parcels of land. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Kenward and unanimously adopted. Mayor Schmitz introduced Resolution No. 2017-238 (recorded in Ordinance Book No._______at Page_______), extending the current agreement with Melissa McGill to serve as Project Manager in the Administration Department: Office of the Mayor and City Commission through November 3, 2017. Commissioner Dorsey moved for adoption, motion seconded by Commissioner Kenward. Mayor Schmitz said the Commission began discussing this contract two years ago, the position was advertised, interviews were conducted, and Ms. McGill was chosen because of her experience. He said at that same time the decision was made not to renew the lobbyist for the state and the lobbyist for the federal government which together totaled approximately $130,000 a year. He said Ms. McGill has done a great job keeping the Commission aware of what is going on with the state and federal government and she has also performed extensive work to help the Commission set standards and accountability for nonprofits seeking tax dollars from the City. He said she has done a lot of work with many different things over the last two years and this is a ninety day extension to give the new administration and Ms. McGill time to decide how they wish to move forward. Commissioner Newsome said he agrees that Ms. McGill has done a great job but he has a Minutes of the Board of Commissioners – August 1, 2017, continued. concern about this item not appearing on an administrative agenda and he questioned why he is just now hearing this request. City Manager explained that personnel matters do not typically appear on administrative agendas. Mayor Schmitz said he sent an email two weeks ago to each member of the Commission. Commissioner Newsome said he did not receive any information therefore he has concerns and cannot support this. Commissioner Dorsey thanked Ms. McGill for the great job she does for the City. Commissioner Crutchfield expressed appreciation to Mayor Schmitz for providing the Commission advance notice of this item. He said Ms. McGill does a great job and is always very responsive to his requests. There being no further discussion and upon the motion being put to vote, those voting “yea,” were Schmitz, Dorsey, Kirkland, Ferguson, Kenward, and Crutchfield; “nay:” Newsome. The motion was carried by the majority of six "yeas" to one “nay.” Mayor Schmitz introduced Resolution No. 2017-239 (recorded in Ordinance Book No._______at Page_______), accepting the terms of the Commitment Letter for Proposed Credit Facility dated July 18, 2017, and submitted by BBVA Compass on behalf of Compass Mortgage Corporation, for a loan in the principal amount of $17,000,000.00 to be used to construct the new Dothan Regional Public Safety Training Center. Commissioner Newsome moved for adoption, motion seconded by Commissioner Kirkland. City Manager West explained the terms of the loan and said the City will receive $1,000,000.00 from the Wiregrass Foundation each year for the next twenty years. Mayor Schmitz said this training center will be one of the top five in the country. City Manager West confirmed for Commissioner Newsome that at the end of the twenty years there will be no balance due. Mayor Schmitz thanked Dr. Barbara Alford and the Wiregrass Foundation. There being no further discussion, the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2017-240 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with Railroad Management Company IV, LLC for a license for the period from and after the Effective Date until June 1, 2038 for the sum of $6,183.75. Commissioner Newsome moved for adoption, motion seconded by Commissioner Kirkland. City Manager West said staff did a good job negotiating the cost of this agreement and saving the City money. There being no further discussion, the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2017-241 (recorded in Ordinance Book No._______at Page_______), entering into a Support Maintenance Contract with Conduent Government Systems, LLC for maintenance and Firehouse software updates for a one year period at a cost of $22,620.00. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Newsome and unanimously adopted. Mayor Schmitz introduced Resolution No. 2017-242 (recorded in Ordinance Book No._______at Page_______), entering into a Memorandum of Agreement with the Alabama Law Enforcement Agency (ALEA) for reimbursement of registration fees in the amount of $3,900.00 for student officers successfully graduating from the Alabama Criminal Justice Training Center (ACTJC) in Selma, Alabama. Commissioner Newsome moved for adoption, motion seconded by Commissioner Kirkland and unanimously adopted. Mayor Schmitz introduced Resolution No. 2017-243 (recorded in Ordinance Book No._______at Page_______), accepting funding from the Wal-Mart Foundation Local Communities Program to be used for “Save-a-Dog” in the amount of $500.00. Commissioner Kenward moved for adoption, motion seconded by Commissioner Kirkland and unanimously adopted. Commissioner Newsome moved to approve a request by Vicki Dunlap, Sears Holding Management corporation, for an additional thirty (30) consecutive calendar-day period to conduct a Going Out of Business Sale for Kmart #3082, motion seconded by Commissioner Kirkland and unanimously carried. Minutes of the Board of Commissioners – August 1, 2017, continued. Commissioner Kirkland moved to approve a claim by Gregory Adams in the amount of $35,613.74, motion seconded by Commission Newsome. Commissioner Crutchfield said he is thankful for the quick response to this claim. Mayor Schmitz said this was an accident involving a City vehicle, and he is proud we took care of it in the right way. There being no further discussion, the motion was unanimously carried. Commissioner Ferguson moved to accept a Warranty Deed from Daniel M. Johnson for 106 Meadowview Drive in Pleasant Valley Subdivision, motion seconded by Commissioner Crutchfield. City Manager West said this is for a storm drainage line. There being no further discussion, the motion was unanimously carried. Commissioners Amos M. Newsome, Jr. and Beth Kenward were absent. Also present were City Manager Michael West, City Clerk Tammy Danner, Assistant City Clerk Wendy Shiver who recorded the Minutes of the Meeting, and the local news media representatives. Mayor Schmitz called the meeting to order. Mayor Schmitz introduced Resolution No. 2017-246 (recorded in Ordinance Book No._______at Page_______), canvassing the results of the City of Dothan Municipal Election held August 1, 2017, which was read. WHEREAS, an Election was held in the City of Dothan, Alabama on August 1, 2017, under applicable provisions of law, for the Election of Mayor, Associate Commissioner for Districts 1, 2 and 4, Dothan City School Board Chairman and Dothan City School Board Members for Districts 1, 4 and 5 for four year terms. All such terms to begin on the first Monday in October, 2017; and WHEREAS, the Board of Commissioners of said City has met at the appointed time and place, and has canvassed the results of said Election as required by law. NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the City of Dothan, Alabama, as follows: Section 1. That upon canvassing the Certificates of Results prepared by the officials who held said Election, the total votes cast for each candidate for Mayor, Associate Commissioner for Districts 1, 2 and 4, Dothan City School Board Chairman and Dothan City School Board Members for Districts 1, 4 and 5 as shown by the Election Certificates are as follows: MAYOR Ruth Page-Nelson - 1185 Mark Saliba - 7983 ASSOCIATE COMMISSIONER – DISTRICT 1 Kevin Dorsey - 658 Larry Donnell Johnson - 105 Anthony “Tony K” Keith - 250 Larry E. Having received the highest number of votes cast in said Election held on August 1, 2017, the following persons are hereby declared eligible for a second or Run-off Election to be held on September 12, 2017: ASSOCIATE COMMISSIONER – DISTRICT 2 Janasky Fleming - 379 Jemmie R. Watford, Jr. - 211 Commissioner Ferguson moved for adoption, motion seconded by Commissioner Crutchfield and unanimously adopted.
