A Special Meeting of the Board of Trustees of City of Dripping Springs was held Tuesday,
January 22, 2013, beginning at 5:30 PM in the 511 Mercer Street, Dripping Springs, Texas.
I. CALL TO ORDER AND ROLL CALL - 5:30 p.m.

Mayor Purcell calls meeting to order at 5:40 p.m. All present except Jon Thompson,
Larry McClung, Alan Bojorquez and Gina Gillis. Also present Jill Hoffman with the
Bojorquez Law Firm.
II. EXECUTIVE SESSION
The City Council for the City of Dripping Springs has the right to adjourn into
executive session at any time during the course of this meeting to discuss any matter
as authorized by Texas Government Code Sections 551.071 (Consultation with
Attorney), 551.072 (Deliberations about Real Property), 551.073 (Deliberations
about Gifts and Donations), 551.074 (Personnel Matters), 551.076 (Deliberations
about Security Devices), and 551.086 (Economic Development).
Convened to Executive Session at 5:50 p.m. Those present: Mayor Purcell,
Councilman Kroll, Councilman Alba, Councilman Busbey, Mayor Pro Tem Foulds,
Councilman King, Deputy City Administrator Ginger Faught, City Administrator
Michelle Fischer, City Secretary Jo Ann Touchstone, and attorney Jill Hoffman.
Reconvened to Regular Session at 6:30 p.m.
A. Consultation with City Attorney Regarding alternatives and options for obtaining
and permitting subsurface wastewater drip irrigation lands for the disposal of
wastewater treated under the authorization of Texas Pollutant Discharge
Elimination System Permit No. WQ0014488001 at the City's South Regional
Wastewater Treatment Facilities Collection System, including additional area
needed to meet wastewater service needs of the future development adjacent to
the City's collection lines, (551.071: Consultation with Attorney and 551:072;
Purchase, Exchange, Lease or Value of Real Property)
III. PLEDGE OF ALLEGIANCE
A. Pledge of Allegiance – Councilman King leads the pledge.
IV. PRESENTATION OF CITIZENS
Floor open to discussion on any subject. No action may be taken by law. Citizens
wishing to speak shall do so after being recognized by the Mayor. The Mayor and
City Council may establish a time limit as necessary.
None.
V. BUSINESS
Consideration and Possible Action On:
A. Request from Dripping Springs Chamber of Commerce for a Maximum Usage
Fee of $3000.00 for the Use of Dripping Springs Ranch Park for the 2013
Dripping With Taste Wine and Food Festival, (Sponsor: Mayor Pro Tem Foulds)
– Mayor Pro Tem Foulds motions to approve provided there is a facility to use.
Councilman Alba seconds. Motion passes, 5-0.
B. Dripping Springs Ranch Park Event Center Layout and Cost Estimate (Sponsor:
Mayor Purcell) – No action taken.
C. Gross Maximum Price(s) proposed by Waldrop Construction for Construction
Manager at Risk services to construct all or specified phases of the Dripping
Springs Ranch Park Event Center and Related Improvements (Sponsor: Mayor
Purcell) – Deputy City Administrator Ginger Faught details the financials for the
project (report on file). Ms. Faught points out that once all of the grant required
improvements are completed the current budget shows that there will be
approximately a $215,000.00 shortfall and that to complete all the facilities
(restrooms, concession stand, etc.) the projected budget shortfall is
$1,301,663.00. Councilman King motions to approve the Guaranteed Maximum
Price as proposed by Waldrop Construction for Phase I of the Dripping Springs
Ranch Park Rodeo Arena and to approve corresponding exhibits to be
incorporated into the A133 contract between the City and Waldrop Construction.
Councilman Alba seconds. Motion passes, 5-0.
Councilman King motions to amend Sections 6.2.2 and 6.8.1.1 of the
A133 contract with Waldrop Construction in accordance with City Attorney edits
and the exhibits presented by Waldrop Construction. Councilman Alba seconds.
Motion passes, 5-0.
Mayor Pro Tem Foulds motion to move to item D at 5:45. Councilman Alba
seconds. Motion passes, 5-0.
D. Approval of Professional Services Provider Agreement Between the City of
Dripping Springs and Klotz Associates for City of Dripping Springs STP MM
CAMPO Project CSJ: 0914-33-065: Mercer Street Pedestrian Improvement
Project, Pending Texas Department of Transportation Approval (Sponsor:
Councilman Busbey) - Councilman Alba motions to approve with staff
approval and contingent upon amendments from TXDot. Councilman King
seconds. Motion passes, 5-0.
E. Professional Services Proposal from Luck Design Team to Update the City's
Master Parks, Recreation and Open Space Plan (Sponsor: Mayor Pro Tem
Foulds) – Mayor Pro Tem Foulds motions to approve subject to minor changes
to be made by staff. Councilman Alba seconds. Councilman Kroll suggests that
the elements from the sustainable places project be incorporated. Motion
passes, 5-0.
F. Professional Services Agreement Between the City of Dripping Springs and
Luck Design Team, LLC to Update the City's Master Parks, Recreation and
Open Space Plan (Sponsor: Mayor Pro Tem Foulds) – Mayor Pro Tem Foulds
motions to approve subject to staff recommendations. Councilman Alba seconds.
Motion passes, 5-0.
G. Recommendation from the City of Dripping Springs Economic Development
Committee for the City to Study the Feasibility of Expanding its Wastewater
System (Sponsor: Mayor Pro Tem Foulds)- Mayor Pro Tem Foulds motions to
accept the recommendation and authorize staff and start working on a feasibility
study. Councilman Kroll seconds. Motion passes, 5-0.
VI. ADJOURN – Councilman Alba motions to adjourn. Councilman Kroll seconds.
Motion passes, 5-0. Meeting adjourned at 6:47 p.m.
