Minutes of Regular Meeting City Council City of Dripping Springs A Regular Meeting of the City Council of City of Dripping Springs was held Tuesday, May 13, 2014, beginning at 5:30 PM in the 511 Mercer Street, Dripping Springs, Texas. I. III. EXECUTIVE SESSION The City Council for the City of Dripping Springs has the right to adjourn into executive session at any time during the course of this meeting to discuss any matter as authorized by Texas Government Code Sections 551.071 (Consultation with Attorney), 551.072 (Deliberations about Real Property), 551.073 (Deliberations about Gifts and Donations), 551.074 (Personnel Matters), 551.076 (Deliberations about Security Devices), and 551.086 (Economic Development).  Convened to Executive Session at 6:30 p.m. Those present: Mayor Pro Tem Foulds, Councilman Alba, Councilman Busbey, Councilman Kroll, Councilman King, City Administrator Michelle Fischer, Deputy City Administrator Ginger Faught, Alan Bojorquez, and Jo Ann Touchstone. Reconvened to Workshop at 6:50 p.m. A. Consultation with City Attorney regarding an Ordinance amending the Dripping Springs Code of Ordinances, Chapter 30, Exhibit A, providing for adequate commercial space in city limits, while protecting residential districts, modifying provisions related to Office, Local Retail, General Retail, and Commercial Services districts (551.071 Consultation with City Attorney) B. Confer with City Attorney regarding land use and zoning issues, including evaluation of regulations governing signage, historic preservation, compatibility, and adult entertainment, addressing comprehensive planning concerns and long- term scope of ordinances distinguishing uses based on age of patronage and rules of the Texas Alcoholic Beverage Commission (551.071 Consultation with City Attorney) C. Consultation with City Attorney regarding potential alternatives and options to currently planned wastewater discharge permitting plans, including potential additional area needed to meet wastewater service needs (551.071 Consultation with Attorney and 551:072 Purchase, Exchange, Lease or Value of Real Property). No action may be taken by law. Citizens wishing to speak shall do so after being recognized by the Mayor. The Mayor and City Council may establish a time limit as necessary. Citizen asks Council to repaint crosswalks for student safety in school areas as well as RR 12 and RR 290. Citizen asks support for Business Item C. VIII. CONSENT ITEMS The following items are anticipated to require little or no individualized discussion due to their nature being clerical, ministerial, mundane or routine. In an effort to enhance the efficiency of City Council meetings, it is intended that these items will be acted upon by the City Council with a single motion because no public hearing or determination is necessary. However, a City Council Member or citizen may request separate deliberation for a specific item, in which event those items will be removed from the consent agenda prior to the City Council voting on the consent agenda as a  collective, singular item. Hargraves Survey No. 240, and being a portion of the remained of a 2055.90 acre tract of land conveyed to the Sawyer- Cleveland Partnership, of record in the OPR of Hays County, David Price, P.E., Applicant – Neighbor behind Valero, inquiring of project. X. REPORTS OF AGENCIES, COMMISISONS AND STAFF A. Farmers Market Report - Market Manager Jo Ann Touchstone – report on file. XI. BUSINESS Consideration and Possible Action On: A. Six Month Extension to Co-Sponsorship Agreement between the City of Dripping Springs and D Bar S Roping (Sponsor: Mayor Purcell)- Brian Schwenning gives history of events and request. Co-Sponsorship Application from the Hill Country Cutting Horse Association for Cutting Horse Shows at Dripping Springs Ranch Park (Sponsor: Mayor Purcell)- Gary Mitchum, states request and is available for questions. Jason Bohart, resident of Blanco county who regularly “cuts” speaks to economic impact of event a positive impact on community. Mayor Pro Tem Foulds motions to approve staff recommendations of a ten percent reduction in all fees. Councilman King seconds. Motion passes, 5-0. C. Co-Sponsorship Application from New Life Lutheran Church for Thirsty Thursdays at Dripping Springs Ranch Park Ranch House (Sponsor: Mayor Purcell)- Councilman Kroll motions to approve. Ordinance No. 7000.11: An Ordinance Amending Article 22.04, Chapter 22 of the Dripping Springs Code of Ordinances; Establishing a Transportation Committee; Providing for the Following: Findings of Fact; Enactment; Repealer; Severability; Codification; Effective Date; and Proper Notice & Meeting (Sponsor: Councilman Kroll)- Councilman Kroll motions to approve. Interlocal Cooperation Agreement between Hays County and the City of Dripping Springs for Subdivision Regulation Within the Extraterritorial Jurisdiction of the City of Dripping Springs (1445 Agreement) (Sponsor: Mayor Purcell) – No action taken. Council authorizes staff to further direct working on the agreement. F. Wastewater Service and Impact Fee Agreement between the City of Dripping Springs and Howard Land & Cattle, Ltd. (Sponsor: Mayor Pro Tem Foulds)- Mayor Pro Tem Foulds motions to approve. Councilman Busbey seconds. Motion passes, 5-0. G. Ordinance No. 6000.11: An Ordinance Amending Chapter 24, Article 24.05 of the Dripping Springs Code of Ordinances; Amending Regulations for Co- Location of Wireless Transmission Facilities on Existing Towers; and Providing for the Following: Findings of Fact; Enactment; Repealer; Severability; Codification; Effective Date; and Proper Notice and Meeting- Mayor Pro Tem Foulds motion to approve with item D.
