City Council Meeting Minutes
A regular meeting of the City of Dripping Springs City Council was held Tuesday, September 24, 2015,
beginning at 6:00 PM at City Hall, 511 Mercer Street, Dripping Springs, Texas.
I. CALL TO ORDER AND ROLL CALL - 6:00 p.m.

Mayor Todd Purcell called the meeting to order at 6:00pm. All present except Mayor Pro Tem Bill
Foulds and City Administrator Michelle Fischer. Also present are City Engineer Rick Coneway,
former Planning and Zoning Commission Chair Larry McClung, current Planning and Zoning
Commission Chair Mim James, and Consultant Keenan Smith.
II. EXECUTIVE SESSION
The City Council for the City of Dripping Springs has the right to adjourn into executive session at
any time during the course of this meeting to discuss any matter as authorized by Texas
Government Code Sections 551.071 (Consultation with Attorney), 551.072 (Deliberations about
Real Property), 551.073 (Deliberations about Gifts and Donations), 551.074 (Personnel Matters),
551.076 (Deliberations about Security Devices), and 551.086 (Economic Development). None
III. PLEDGE OF ALLEGIANCE – Mayor Todd Purcell leads the Pledge of Allegiance.
IV. PRESENTATION OF CITIZENS
Floor open to discussion on any subject. No action may be taken by law. Citizens wishing to
speak shall do so after being recognized by the Mayor. The Mayor and City Council may
establish a time limit as necessary. – Mayor Todd Purcell recognizes outgoing Planning and
Zoning Commission Chair Larry McClung for his eight years of service on the Commission.
V. ZONING/SITE DEVELOPMENT/SUBDIVISION
A. Conditional Use Permit Application Resubmittal to Allow for a Mobile Food Vendor Court
and Associated Improvements, Located at 310 Old Fitzhugh Road, Tasha Nikora and Alysia
Ferrer, Applicants
1. Presentation – Tasha Nikora, Applicant
2. Planning Director's Report – Planning Director Jon Thompson, report on file. Staff
recommends approval of the Conditional Use Permit with the conditions stated in the
report. Planning and Zoning Commission members Larry McClung and Mim James

provide a report stating that the Commission voted 6-1 in favor of approval with conditions.
3. Public Hearing – No one speaks.
4. Conditional Use Permit – Food Trailers – Council Member John Kroll motions to approve
the Conditional Use Permit according to staff’s and Planning and Zoning Commission’s
recommendations, with the condition that the plan for the Roberts House must be submitted
within 90 days of this meeting or the Conditional Use Permit will be revoked. Council
Member Santos Alba seconds. Mayor Todd Purcell states that he would like the motion to
include removal of the blue tarp and giving them more than 30 days to paint and/or restore
the bus. Council Member John Kroll amends his motion to include the condition that
progress on the bus must be made within 90 days, and that Council is directing staff to
allow the property owner to remove the tarp. Council Member Santos Alba agrees to
second the amended motion. Council discusses the mobile food vendor ordinance, the
Roberts House, the status of the bus restoration, ADA accessibility, removal of the tarp
covering the bus, and the fees that have been billed to but not paid by the applicant to date.
VOTE: 3-1 in favor, Council Member Charlie Busbey votes Nay, motion passes.
VI. BUSINESS
Consideration and Possible Action On:
A. Ordinance No. 1110.13: An Ordinance of the City Council of the City of Dripping Springs,
Texas, Setting and Approving the 2015-2016 Ad Valorem Tax Rate and Levy of Seventeen
Hundredths Cents ($0.1700) Per One Hundred Dollars ($100.00) of Assessed Valuation of All
Taxable Property Within the Corporate Limits of the City; Providing for Penalties and Interest,
and Providing for the following: Findings of Fact; Severability; Savings Clause; and
Publication.
1. Adoption of Ordinance No. 1110.13 – Council Member Charles Busbey motions to approve
Ordinance No. 1110.13 and that the property tax rate be increased by the adoption of a tax
rate of seventeen hundredths cents ($0.1700) per one hundred dollars of assessed value,
which is effectively an 8.42% increase in the tax rate. Council Member Santos Alba
seconds. VOTE: 4-0 in favor, motion passes.
B. Amendment to the Professional Services Agreement between the City of Dripping Springs and
HDR Engineering, Inc. for Traffic Engineering Study (Sponsor: Council Member Charles Busbey)
1. Staff Report – City Engineer Rick Coneway, report on file.
2. Amended Agreement - Council Member Charles Busbey motions to approve the Amended
Agreement. Council Member John Kroll seconds. VOTE: 4-0 in favor, motion passes.
Council Member John Kroll leaves the meeting at 6:36pm.
VII. WORKSHOP
No action to be taken. Discussion regarding:
A. Presentation of Traffic Engineering Study by HDR Engineering
VIII. ANNOUNCEMENTS
A. Regular City Council Meeting, October 13, 2015 at 7:00pm
IX. ADJOURN - Council Member Charlie Busbey motions to adjourn the meeting. Council Member
Wade King seconds. VOTE: 3-0 in favor, motion passes. Meeting adjourns at 7:11pm.
