CITY OF DRIPPING SPRINGS, TEXAS MINUTES OF THE CITY COUNCIL & BOARD OF ADJUSTMENT SPECIAL MEETING OF TUESDAY, DECEMBER 5, 2017 AT 5:30 P.M. A Special Meeting of the City Council of Dripping Springs, Texas was held Tuesday, December 5, 2017 at 5:30 p.m., in the Council Chambers located at City Hall, 511 Mercer Street, Dripping Springs, Texas. City Council Members Present were: Mayor Pro Tem Foulds Council Member Wade King Council Member John Kroll Council Member Taline Manassian Council Member Travis Crow City Council Members Absent were: Mayor Todd Purcell City Staff and Appointed Officials Present were: City Administrator Michelle Fischer Deputy City Administrator Ginger Faught City Secretary Andrea Cunningham Special Counsel David Tuckfield With a super quorum of the City Council present, Mayor Pro Tern Foulds called the Workshop to order at 5 :30 p.m. BUSINESS Consideration and Possible Action 011: A. Resolution No. 2017-77: A Resolution of the City Council of the City of Dripping Springs, Texas, authorizing the submission of a nomination for funding from the Capital Area Metropolitan Planning Organization (CAMPO) 2018-2019 Platinum Planning Study Program; and authorizing the Mayor to act as the City's authorized representative in all matters pertaining to the City's participation in the CAMPO 2018-2019 Platinum Planning Study Program (2018-2019 PPS) Ginger Faught reviewed the grant submission, and updated the City Council on the participation of Hays County. The Commissioner's Court agreed to co-sponsor the application in name only; they may decide to contribute funds towards the project at a later date. Gandolf Burrus with Grant Development Services, reviewed the items the funding will cover: Hwy 290 to Ranch Road 12 to Founders and Pound House, to include pedestrian and bicycle City Council Minutes December 5, 2017 Special Meeting Page I of4  paths along Hwy 290. The City will be responsible for a 20% minimum match of funds, which will be determined by CAMPO. The application will be submitted on December 11, 2017, and funds should be awarded within 90 days. Mr. Burrus discussed how the grant is inter-lockable with Hays County and the Texas Department of Transportation; and, that the studies conducted with the funds would increase the chances of receiving future funding for projects through partnerships with those entities. There is also an opportunity for funding through the Tax Increment Reinvestment Zone No. I & No. 2 Board. A motion was made by Council Member King to approve Resolution No. 2017-77. Council Member Kroll seconded the motion, which carried unanimously 5 to 0. Mayor Pro Tern Foulds opened the floor for citizen comment. Wes Pitts spoke regarding the settlement agreement with LCRA and Austin. Mr. Pitts expressed that he would like to see more transparency with the process. A motion was made by Council Member King to recess into Executive Session. Council Member Kroll seconded the motion, which carried unanimously 5 to 0. EXECUTIVE SESSION The City Council ji>r the City <?/Dripping Springs has the right to adjourn into executive session at any time during the course of this meeting to discuss any matter as authorized by Texas Government Code Sections 551.071 (Consultation with Attorney), 551.072 (Deliberations about Real PropertJ~. 551.073 (Deliberations about Gifts and Donations), 551.074 (Personnel Matters), 551.076 (Deliberations about Security Devices), and 551.086 {Economic Development). The City Council.for the City <!f Dripping Springs may act on any item listed in Executive Session in Open Session or move any item from Executive Session lo Open Session for action. A. Consultation with City Attorney regarding the Proposed Settlement Agreement between the City of Dripping Springs, the City of Austin and other Parties regarding Texas Pollutant Discharge Elimination System Permit No. WQ001448803 (551.071 Consultation with City Attomey) B. Consultation with City Attorney regarding Allocation of Wastewater Capacities and Potential Alternatives and Options to currently planned Wastewater Discharge Permitting Plans, including potential additional area needed to meet wastewater service needs (551.071 Consultation with City Attorney and 551.072 Purchase, Exchange, Lease or Value of Real Properf)~ C. Deliberation regarding Personnel Matters related to hiring, duties, compensation, and benefits of Receptionist, Permit Coordinator, and Permit Technician (551.074 Personnel Matters) The City Council met in Executive Session from 5 :40 p.m. - 6:08 p.m. City Co1111cil Minutes December 5, 2017 Special Meeting Page 2 of4  No vote or action was taken in Executive Session. Mayor Pro Tern Foulds returned the meeting to Open Session at 6:08 p.m. OPEN SESSION A motion was made by Council Member Kroll to authorize City Admini stration to hire and compensate personnel with regards to Receptionist, Permit Coordinator, and Permit Technician within the existing budget. Council Member King seconded the motion, which carried unanimously 5 to 0. A motion was made by Council Member Kroll to authorize the Mayor or Mayor Pro Tern to finalize the terms of a settlement agreement with the City of Austin regarding TPOES application WQ00 14488003, which is currently pending before the Texas Commiss ion on Environmental Quality, and to execute the final agreement based on the terms previously discussed, however any substanti ve changes shall be brought back to City Council for approval. Council Member Manassian seconded the motion, which carried unanimously 5 to 0. A motion was made by Counci l Member Kroll to authorize either the Mayor or Mayor Pro Tern to final ize the terms of a settlement agreement with Alfredalbert, LLC, a Texas limited liability company, regarding TPDES appl ication WQ00 l4488003, which is currently pending before the Texas Commi ssion on Environmental Quality and to execute the final agreement (either jointl y with the City of Austin , or separately) based on the term s previously discussed, however any substantive changes shall be brought back to City Council for approval. Council Member King seconded the motion, wh ich carried unanimously 5 to 0. ADJOURN A motion was made by Council Member Crow to adjourn the meeting.
