City Council & Board of Adjustment Workshop & Regular Meeting Minutes March 13, 2018 at 5:30 p.m. A Workshop and Regular Meeting of the City Council of Dripping Springs, Texas was held Tuesday, February 13, 2018 at 5:30 p.m., in the Council Chambers located at City Hall, 511 Mercer Street, Dripping Springs, Texas. I. WORKSHOP No action to be taken during workshop. Staff Reports regarding Consent, Site Developments, Subdivisions, Zoning, On Site Sewage Facilities, Signs, Variances, Waivers, Special Exceptions, Annexations, Alternate Standards, Business, and Other Agenda Items listed below. The City Council discussed the following Regular Agenda items with staff: 1. Item VIII, F - City Sponsorship of Skate Nights at Dripping Springs Ranch Park 2. Item IX, I - Variance Request to Master Sign Plan for The Commons, Hill Country Bible Church City Council March 13, 2018 Workshop & Regular Meeting Minutes Page 1 of13 Ginger Faught respectively requested that the Mayor and City Council postpone consideration on Business Item B, First Amendment to the Water and Wastewater Utility Agreement between the City of Dripping Springs and Paintbrush 290 GP, LLC (Westwood PID), to the April 10, 2018 Regular Meeting. By unanimous consent, the item was postponed to the Regular City Council meeting of April 10, 2018. A motion was made by Mayor Pro Tern Foulds to recess the meeting into Executive Session under Executive Session Items A - I. Council Member King seconded the motion which carried unanimously 3 to 0. Mayor Purcell read the Executive Session Agenda, and recessed the meeting at 5:55 p.m. XII. EXECUTIVE SESSION The City Council for the City ofDripping Springs has the right to adjourn into executive session at any time during the course of this meeting to discuss any matter as authorized by Texas Government Code Sections 551.071 (Consultation with Attorney), 551.072 (Deliberations about Real Property), 551.073 (Deliberations about Gifts and Donations), 551.074 (Personnel Matters), 551.076 (Deliberations about Security Devices), and 551.086 (Economic Development). Consultation with City Attorney regarding legal issues related to the Westwood Public Improvement District and Disclosure Counsel Agreement (551 .071 Consultation with City Attorney) The City Council met in Executive Session from 5:55 p.m. - 6:30 p.m. Mayor Purcell returned the meeting Open Session and called the meeting to recess at 6:30 p.m. Ill. RECESS The City Council recessed from 6:30 p.m. - 6:40 p.m. IV. RECONVENE AT 6:30 p.m. With a quorum of the City Council present, Mayor Purcell returned the meeting to Open Session, calling the meeting to order at 6:40 p.m. V. PLEDGE OF ALLEGIANCE Mayor Purcell led the Pledge of Allegiance to the Flag. VI. PROCLAMATIONS Consideration and Possible Action On: A. A Proclamation of the City of Dripping Springs proclaiming March 14, 2018 as "Carl Weathersby Day" in the City of Dripping Springs, Texas Sponsor: 1\1ay or Purcell Mayor Purcell read the proclamation and presented it to Carl Weathersby. The City Council approved the proclamation by unanimous consent. VII. PRESENTATION OF CITIZENS Floor open to discussion on any subject. No action may be taken by law. Citizens wishing to speak shall do so after being recognized by the Mayor. The Mayor and City Council establish a time limit of two (2) minutes per speaker, for a total ofthirty (3) minutes. Texas Night Sky Festival to Participate in Star Party at Pedernales Falls State Park on April 7,2018 Michelle Fischer spoke regarding the City' s participation in the Star Party at Pedemales Falls State Park on April 7, 2018. CONSENT ITEMS The following items are anticipated to require little or no individualized discussion due to their nature being clerical, ministerial, mundane or routine. In an effort to enhance the efficiency of City Council meetings, it is intended that these items will be acted upon by the City Council with a single motion because no public hearing or determination is necessary. However, a City Council Member or citizen may request separate deliberation for a specific item, in which event those items will be removed from the consent agenda prior to the City Council voting on the consent agenda as a collective, singular item. Prior to voting on the consent agenda, the City Council may add additional items that are listed elsewhere on the same agenda. A. Approval of City Treasurer's Report for February 2018 B. Amendment to Professional Services Agreement between the City of Dripping Springs and CMA Engineering, Inc. for Engineering Services regarding the East Interceptor Evaluation and Preliminary Design. M. Amendment to Professional Services Agreement between the City of Dripping Springs and CMA Engineering, Inc. regarding wastewater engineering services. Council Member Manassian seconded the motion which carried unanimously 3 to 0. A motion was made by Mayor Pro Tern Foulds to recess the meeting. Council Member King seconded the motion which carried unanimously 3 to 0. The meeting recessed from 7:30 p.m. - 7:44 p.m. With a quorum of the City Council present, Mayor Purcell returned the meeting to Open Session, calling the meeting to order at 7:44 p.m. Hays County Precinct 4 Commissioner Ray Whisenant spoke regarding County jmisdiction and Right of Way with regards to the proposed site development permit for the Mark Black Wedding Venue. IX. SUBDIVISION/SITE DEVELOPMENT/ ZONING/SIGNAGE/CONDITIONAL USE PERMITS/VARIANCES/WAIVERS/SPECIAL EXCEPTIONS Discussion and Possible Action on: A. SD2017-0005 Site Development Permit Application for the Mark Black Wedding Venue located at 130 W. Concord Circle, Driftwood, TX {ETJ). Applicant, Andrew Evans, Kimley Horn and Associates. I . Staff Report Chad Gilpin presented the staff report which is on file. Staff recommends approval of the Site Development Permit. 2. Site Development Permit A motion was made by Council Member King to deny SD2017-0005 Site Development Permit Application for the Mark Black Wedding Venue located at 130 W. Concord Circle, Driftwood, TX. The motion died for a lack of a second. A motion was made by Mayor Pro Tern Foulds to open the item to discussion. Council Member Manassian seconded the motion which carried unanimously 3 to 0. Lauren Ross and Jeff Kessel spoke on behalf of the Friendship Alliance regarding water quality and drainage. Andrew Evans spoke on behalf of Kimley-Horn regarding water quality and drainage. A motion was made by Council Member Manassian to approve site development permit application for the Mark Black Wedding Venue contingent on adding a note to the Water Quality Sheets regarding vegetative filter strips and adding additional cross-sections and details regarding temporary sedimentation ponds to their plans. Mayor Pro Tern Foulds seconded the motion which canied 2 to 1, with Council Member King in opposition. B. Replat of DS Ranch Phase 2, Tracts lC & lD a 35.24 acre tract located at 776 Cattle Trail Drive, Dripping Springs, TX 78620. Council Member Manassian seconded the motion which carried unanimously 3 to 0. Hays County Commissioner Precinct 4 Ray Whisenant spoke regarding a cut-through. E. Preliminary Plat for Headwaters Phases 3, 4 & 5, a 740.24 acre tract located at the intersection of Headwaters Blvd and Hazy Hills Loop.Applicant, Jesse Malone, P.E. , Malone/ Wheeler, Inc. 1. Preliminary Plat A motion was made by Mayor Pro Tern Foulds to approve the Preliminary Plat for Headwaters Phases 3, 4 & 5, a 740.24 acre tract located at the intersection of Headwaters Blvd and Hazy Hills Loop with the emergency access only connection and with the condition that a committee be appointed, including representatives from the City, County and Sunset Canyon, to draft a Roadway Agreement. Council Member King seconded the motion. After some discussion, Mayor Pro Tern Foulds and Council Member King withdrew the motion and second. A motion was made by Council Member Manassian to approve the Preliminary Plat for Headwaters Phases 3, 4 & 5, a 740.24 acre tract located at the intersection of Headwaters Blvd and Hazy Hills Loop, with the connection at Headwaters and Sunset Canyon being emergency access only at the request of Hays County; and, to direct staff to work with Hays County and the Developer to develop a Roadway Agreement regarding triggers for re-evaluating access at this intersection with the understanding that there will be a working group to include representatives of the City of Dripping Springs, representatives of Hays County, representatives of the Developer, and two residents of Sunset Canyon - 1 representative as selected from the Sunset Canyon Land Owners Association (LOA), and 1 representative of Sunset Canyon not a member of the Sunset Canyon LOA of who will be two voices at the table with one vote. Mayor Pro Tern Foulds seconded the motion which carried unanimously 3 to 0. F. An Ordinance Of The City Of Dripping Springs, Texas Amending The Code Of Ordinances, Chapter 30, Article 30.05, Mobile Food Vendors and Amending Chapter 30, Exhibit A, Appendix E: Zoning Use Regulations (Charts); and Providing for the Following: Findings of Fact; Enactment; Repealer; Severability; Codification; Effective Date; and Proper Notice & Meeting. 1. Council Member Manassian seconded the motion which carried unanimously 3 to 0. G. Hanna Survey from Agriculture District (AG) to Commercial Services (CS), and Providing for the Following: Findings of Fact; Enactment; Repealer; Severability; Effective Date; Authorizing the City Administrator to Note the Change on the Official Zoning Map of the City; Proper Notice and Meeting. After some discussion, Council Member Manassian and Mayor Pro Tern Foulds withdrew their motion and second. A motion was made by Mayor Pro Tern Foulds to postpone the item to the March 20, 2018 regular City Council Meeting. Council Member King seconded the motion which carried unanimously 3 to 0. H. PDD-9/Farmstead @ Caliterra: An Ordinance of the City of Dripping Springs, Texas Rezoning a Tract of Land Totaling Approximately 18.532 Acres from Multiple-Family Residential (MF) and Enacting Planned Development District (PDD) # 9, Commonly Known as Farmstead at Caliterra and Located on the Western Side of RR 12 and South of Butler Ranch Rd, and Further Described as: 18.532 Acres of Land out of the PA Smith Survey No. 26, Abstract No. 415, in Hays County, Texas, Being a Portion of that Certain (595.818 Acre) Tract of Land Conveyed to Development Solutions CAT, LLC by Deed Recorded in Vol. 4682, Page 342 of the Official Public Records of Hays County, Texas. Planning and Zoning Commission Report Chair James: Commission recommended approval 5 to 1, and with the following recommendation: the provision for the 50' setback along RR12 is rewritten to make clear that the landscaping will follow the City s landscape requirements (so landscape requirements will not be affected should any portion of the setback be acquired by TxDOT in the future for RR12 widening). 4. PDD - 9 Ordinance A motion was made by Council Member King to deny PDD-9/Farmstead @ Caliterra: An Ordinance of the City of Dripping Springs, Texas Rezoning a Tract of Land Totaling Approximately 18.532 Acres from Multiple-Family Residential (MF) and Enacting Planned Development District (PDD) # 9, Commonly Known as Farmstead at Caliterra and Located on the Western Side of RR 12 and South of Butler Ranch Rd. Council Member Manassian seconded. After some discussion, Council Member King and Council Member Manassian withdrew their motion and second. A motion was made by Council Member King to postpone the item to the March 20, 2018 regular City Council meeting. Council Member Manassian seconded the motion which carried 2 to Oto 1, with Mayor Pro Tern Foulds abstaining. I. Sign Variance Request to Allow A Projecting Sign to Exceed the Maximum Area Allowed by the Master Sign Plan for The Commons for Hill Country Bible Church Dripping Springs, located at 100 Commons, Suite 4, Jason McNutt, Applicant I. Council Member Manassian seconded the motion which carried unanimously 3 to 0. X. BUSINESS Consideration and Possible Action On: A. Founders Memorial Park Pool Hours of Operation and Budget A motion was made by Mayor Pro Tern Foulds to approve the Founders Memorial Park Pool Hours of Operation and Budget. Council Member King seconded the motion which carried unanimously 3 to 0. B. First Amendment to the Water and Wastewater Utility Agreement between the City of Dripping Springs and Paintbrush 290 GP LLC, regarding the Scenic Greens Development (AKA-- Westwood Public Improvement District Development) A motion was made by Council Member Manassian to table the item. Council Member King seconded the motion which carried unanimously 3 to 0. C. Discussion and selection of a firm for Engineering Services regarding the City's Request for Statement of Qualifications: Ranch Park Dam Repair A motion was made by Council Member King to approve the selection of RPS for Engineering Services regarding the City's Request for Statement of Qualifications: Ranch Park Dam Repair, and to authorize the City to draft an agreement for services for City Council consideration.
