City Council & Board of Adjustment Regular Meeting May 15, 2018 at 6:00 p.m. A Regular Meeting of the City Council of Dripping Springs, Texas was held Tuesday, May 15, 2018 at 6:00 p.m., in the Council Chambers located at City Hall, 511 Mercer Street, Dripping Springs, Texas. I. CALL TO ORDER AND ROLL CALL - 6:00 P.M. Council Members present were: Council Member Travis Crow Council Member Wade King Council Member John Kroll Council Members absent were: Mayor Todd Purcell Mayor Pro Tern Foulds Council Member Manassian City Staff/Appointed Officials City Administrator Michelle Fischer City Secretary Andrea Cunningham Parks & Community Services Director Mariana Espinoza City Treasurer Gina Gillis Assistant City Attorney Laura Mueller In the absence of the Mayor and Mayor Pro Tern, Council Member Kroll presided over the meeting and called the meeting to order at 6:02 p.m. II. PLEDGE OF ALLEGIANCE Caroline Welton with the American Heritage Girls organization led the Pledge of Allegiance to the Flag. III. PROCLAMATIONS A. Proclamation of the City of Dripping Springs Honoring Caroline Welton for Earning the American Heritage Girls Stars and Stripes Award (Sponsor: Council Member Taline Manassian) Council Member Kroll read the proclamation honoring the achievement of Caroline Welton as a recipient of the American Heritage Girls Stars and Stripes award. A motion was made by council Crow to approve the Proclamation honoring Caroline Welton for earning the American Heritage Girls Stars and Stripes Award. PRESENTATION OF CITIZENS Floor open to discussion on any subject. No action may be taken by law. Citizens wishing to speak shall do so after being recognized by the Mayor. The Mayor and City Council may establish a time limit as necessary. A. Eagle Scout Project commemorating the opening of Sycamore Springs Elementary School and Middle School, Luke Medina, Eagle Scout Luke Median spoke regarding his Eagle Scout Project to place time capsules at Sycamore Springs Elementary School and Middle School. V. ELECTIONS Consideration and Possible Action On: A motion was made by Council Member King to postpone Election Items A and B to the June 12, 2018 Regular City Council meeting. Council Member Crow seconded the motion which carried 3 to 0. The City Secretary was directed to administer oath and statement of officer forms to the Mayor Elect and Council Members Elect prior to the June 12, 2018 Regular City Council Meeting to meet statutory deadlines regarding the administration of such documents. A. Statement of Officer and Administration of Oaths of Office to newly elected Mayor and Council Members, Judge Marilyn Miller, City ofDripping Springs Municipal Court Judge 1. Mayor Elect Todd Purcell 2. Council Member Elect Wade King 3. Council Member Elect John Kroll B. Discussion and possible action to elect a Mayor Pro Tern to serve a term of one year VI. CONSENT ITEMS The following items are anticipated to require little or no individualized discussion due to their nature being clerical, ministerial, mundane or routine. In an effort to enhance the efficiency of City Council meetings, it is intended that these items will be acted upon by the City Council with a single motion because no public hearing or determination is necessary. However, a City Council Member or citizen may request separate deliberation for a specific item, in which event those items will be removed from the consent agenda prior to the City Council voting on the consent agenda as a collective, singular item. Prior to voting on the consent agenda, the City Council may add additional items that are listed elsewhere on the same agenda. A. Approval of City Treasurer's Report for April 2018 B. Approval of a Resolution approving and accepting a Fiscal Bond for Founders Ridge Subdivision ("Founders Ridge"), providing for effective date; and proper notice and meeting C. Approval of Co-Sponsorship Agreement between the City of Dripping Springs and the American Cancer Society for Chiggerfest Music Festival June 8-10, 2018 (Co-Sponsor: Council Member Travis Crow) A motion was made by Council Member Crow to approve Consent Agenda Items A - C. BUSINESS Discussion and Possible Action On: A. An Ordinance amending the current 2017-2018 Fiscal Year Budget; finding municipal purposes; authorizing expenditures; providing for a severability clause; and providing for an effective date 1. StaffReport Gina Gillis presented the staff report which is on file. Staff recommends approval of the ordinance. 2. Public Hearing No one spoke during the Public Hearing. 3. Ordinance A motion was made by Council Member Crow to approve An Ordinance amending the current 2017-2018 Fiscal Year Budget; finding municipal purposes; authorizing expenditures; providing for a severability clause; and providing for an effective date. Council Member King seconded the motion which carried unanimously 3 to 0. B. A Professional Services Agreement between the City of Dripping Springs and CMA Engineering, Inc. for engineering services related to the Wastewater Capital Improvement Plan C. Amendment to Agreement for Engineering Services between HDR Engineering, Inc and the City of Dripping Springs to Raise the Cap on Total Compensation for Task Orders from $350,000 to $450,000 The City Council took Business Items Band C together. Laura Mueller discussed the item and recommended approval. A motion was made by Council Member Crow to approve A Professional Services Agreement between the City of Dripping Springs and CMA Engineering, Inc. for engineering services related to the Wastewater Capital Improvement Plan and an Amendment to Agreement for Engineering Services between HDR Engineering, Inc and the City of Dripping Springs to Raise the Cap on Total Compensation for Task Orders from $350,000 to $450,000. Council Member King seconded the motion which canied unanimously 3 to 0. D. A Resolution of the City of Dripping Springs, Texas Approving Revisions to Exhibit E, Waiver of the Agricultural Use Valuation and Exhibit G, the Acquisition and Reimbursement Agreement of the "Heritage Public Improvement Financing Agreement." Council Member Kroll recused himself from this item and stepped down from the dais. Kevin Pierce with Metcalfe Wolff Stuart & Williams, LLP, presented the item. Council Member Crow seconded the motion which carried unanimously 2 to Oto 1, with Council Member Kroll recused. Council Member Kroll returned to the dais. E. Approval of Full-Time Parks Maintenance Worker Job Position; Approval of Job Description; Authorization for Deputy City Administrator to Hire Position F. Approval of Part-Time Dripping Springs Ranch Park Facility Attendant Position; Approval of Job Description; Authorization for Dripping Springs Ranch Park Manager to Hire Position G. Approval of Revised Job Description for Full-Time Maintenance Director and Authorization for Deputy City Administrator to Hire Position H. Approve Terms for Swim Instructor Agreements Providing for an Alternate Pay Structure for Swim Lessons and to Authorize the City Attorney's Office and the Parks and Community Services Director to Finalize Agreements with Instructors. The City Council took Business Items E - H together. Michelle Fischer discussed Item F regarding the DSRP Part-Time Facility Attendant, and Laura Mueller discussed Item H regarding the Swim Instructor Agreements. A motion was made by Council Member King to approve the following items: E) Approval of Full- Time Parks Maintenance Worker Job Position; Approval of Job Description; Authorization for Deputy City Administrator to Hire Position; F) Approval of Part-Time Dripping Springs Ranch Park Facility Attendant Position; Approval of Job Description; Authorization for Dripping Springs Ranch Park Manager to Hire Position; G) Approval of Revised Job Description for Full-Time Maintenance Director and Authorization for Deputy City Administrator to Hire Position; and H) Approve Terms for Swim Instructor Agreements Providing for an Alternate Pay Structure for Swim Lessons and to Authorize the City Attorney's Office and the Parks and Community Services Director to Finalize Agreements with Instructors. Council Member Crow seconded the motion which carried unanimously 3 to 0. I. Consideration of a Fee Waiver in Exchange for Services at Dripping Springs Ranch Park for an RV Site. A motion was made by Council Member Crow to postpone the item to the June 12, 2018 Regular City Council meeting. Council Member King seconded the motion which carried unanimously 3 to 0. A motion was made by Council Member Kroll to recess into Executive Session to discuss Executive Session Agenda Items A - H, and under Texas Government Code Sections 551.071, 551.072, 551.073, 551.074, 551 .076 and 551 .086. (551 .071 Consultation with City Attorney). The City Council met in Executive Session from 6:27 p.m. - 6:36 p.m. No vote or action was taken during Executive Session.
