City Council Workshop & Regular Meeting Minutes October 8, 2019 at 6:00 p.m. A Workshop & Regular Meeting of the City Council of Dripping Springs, Texas was held Tuesday, October 8, 2019 beginning at 6:00 p.m. in the City Hall Council Chambers located at 51 1 Mercer Street, Dripping Springs, Texas. I. WORKSHOP No action will be taken during the Workshop. The City Council discussed Business Agenda Item A during the Workshop. A motion was made by Mayor Pro Tern Foulds to adjourn into Executive Session under Texas Government Code Sections 551.071, Consultation with City Attorney, and 551.074 Personnel Matters, and regarding Executive Session Agenda Items A - D. Council Member Kroll seconded the motion which carried unanimously 5 to 0. Executive Session Agenda A. Consultation with City Attorney regarding legal issues related to the South Regional Water Reclamation Expansion Project Easement Acquisition. Consultation with City Attorney, 551.071 Council Member Crow recused from this item and left the Executive Session. C. Consultation with City Attorney regarding legal issues related to the Mark Black Wedding Venue located in the City's Extraterritorial Jurisdiction. Consultation with City Attorney, 551.071 D. Deliberation of Personnel Matters regarding the job descriptions, compensation, benefits, and employment of the Records Management Clerk, Accounts Receivable Clerk, Code Enforcement Inspector, Special Events and Programs Specialist, WWTP Maintenance Worker, Geographic Information Systems Analyst/Planner, and Public Works Coordinator. Consultation with City Attorney, 551.071 The City Council met in Executive Session from 6:08 p.m. - 6:30 p.m. Council Member Crow recused from Executive Session Agenda Item B. No action or vote was taken during Executive Session. Mayor Purcell returned the meeting to Open Session at 6:30 p.m. III. RECESS The City Council recessed from 6:30 p.m. - 6:35 p.m. IV. RECONVENE AT 6:30 P.M. Mayor Purcell reconvened the meeting at 6:35 p.m. V. PLEDGE OF ALLEGIANCE Council Member Kroll led the Pledge of Allegiance to the Flag. VI. PROCLAMATIONS & PRESENTATIONS No action to be taken on proclamations and presentations. The City Council may choose to discuss and take public comment on these items as necessary. A. Presentation of Awards for Recognition of Service as Volunteers on City Boards, Commissions and Committees. Founders Day Commission alum Stephanie Holtzendorf was present to accept her award. B. Proclamation proclaiming October 2019 as "National Domestic Violence Awareness Month" in the City of Dripping Springs. Sponsor: Council Member King Council Member King read the proclamation and presented it to representatives from the Hays-Caldwell Women's Center. C. Presentation Recognizing the Dripping Springs Farmers Market for being named #1 in the Southwest by the American Farmland Trust. Parks & Community Services Director, Mariana Espinoza Mariana Espinoza, Laurel Robertson, and Chair Gouri Johannsen and Vice Chair Marianne Simmons with the Dripping Springs Farmers Market Association Board gave the presentation. VII. PRESENTATION OF CITIZENS A member of the public who desires to address the City Council regarding any item on an agenda for an open meeting may do so at presentation of citizens before an item or at a public hearing for an item during the City Council's consideration of that item. Citizens wishing to discuss matters not contained within the current agenda may do so, but only during the time allotted for presentation of citizens. Speakers are allowed two (2) minutes to speak during presentation ofcitizens or during each public hearing. Speakers may not cede or pool time. Members ofthe public requiring the assistance ofa translator will be given twice the amount of time as a member of the public who does not require the assistance of a translator to address the City Council. It is the request of the City Council that members of the public wishing to speak on item(s) on the agenda with a noticed Public Hearing hold their comments until the item(s) are presentedfor consideration. Speakers are encouraged to sign in. Anyone may request a copy of the City's policy on presentation of citizens from the city secretary. By law no action may be taken during Presentations of Citizens. Katherine Romans spoke during Presentation of Citizens regarding her support for the Hill Country Alliance Hotel Occupancy Grant Funding Agreement. A. Presentation by the Dripping Springs Running Club for donation to Sports and Recreation Park. Dripping Springs Running Club President, Steve Mallett Steve Mallett, Chuck Lemmond and Chris Heinchon with the Dripping Springs Running Club presented the donation to the City Council which will be used for improvements to the trails at the Sports and Recreation Park. B. Presentation of Wild Birds Unlimited Donation to Charro Ranch Park and Dripping Springs Ranch Park Bird Viewing Stations. Manuel Pena and Amanda Bustillos City Council October 8, 2019 Workshop & Regular Meeting Minutes Pagel o/9  Owners Wild Birds Unlimited, Manuel Pena, Anna Pena and Amanda Pena Bustillos presented the donation to the City Council which will be used for Parks activities and for the Bird Blind located in Charro Park. VIII. CONSENT AGENDA The following items are anticipated to require little or no individualized discussion due to their nature being clerical, ministerial, mundane or routine. In an effort to enhance the efficiency of City Council meetings, it is intended that these items will be acted upon by the City Council with a single motion because no public hearing or determination is necessary. However, a City Council Member or citizen may request separate deliberation for a specific item, in which event those items will be removed from the consent agenda prior to the City Council voting on the consent agenda as a collective, singular item. Prior to voting on the consent agenda, the City Council may add additional items that are listed elsewhere on the same agenda. A. Approval of the City Council & Board of Adjustment Workshop and Regular Meeting Minutes of September 10, 2019 and the City Council Regular Meeting Minutes of September 17, 2019. B. Approval of an Agreement between the City of Dripping Springs and the Dripping Springs Songwriters Festival for Hotel Occupancy Tax Grant Funding for Fiscal Year 2019-2020. C. Approval of an Agreement between the City of Dripping Springs and the Dr. Pound Historical Farmstead for Hotel Occupancy Tax Grant Funding for Fiscal Year 2019- 2020. D. Approval of an Agreement between the City of Dripping Springs and Hill Country Alliance for Hotel Occupancy Tax Grant Funding for Fiscal Year 2019-2020. E. Approval of an Agreement between the City of Dripping Springs and the Dripping Springs Visitors Bureau for Hotel Occupancy Tax Grant Funding for Fiscal Year 2019-2020. F. Approval of the Appointment of Dan O'Brien to the Emergency Management Commission as an Emergency Response Representative from Emergency Services District No. 1, and for a term ending January 1, 2021. G. Approval of a Fee Waiver Request from the Dripping Springs Mountain Bike Team for use of the Dripping Springs Ranch Park and Event Center Vendor Hall. Sponsor: Wade King H. Approval of a Co-Sponsorship Agreement between the City of Dripping Springs and Vintage Market Days of Greater Austin regarding the Vintage Market Days Event to be held November 8 - 10, 2019 at the Dripping Springs Ranch Park and Event Center. Public hearing and consideration of approval of SUB2019-0046: regarding a proposed plat vacation for property located at 13701 FM 1826, AUSTIN, TX 78737 (Legal Description: CAMPBELL ADDITION, Lot 1, ACRES 7.198 Hays County, TX). The applicant is proposing to vacate Lot 1, a 7.198 acres platted lot, located in the City's extraterritorial jurisdiction. Applicant: Matt Elledge, My Real Life Church 1. Presentation - No presentation was given. 2. Staff Report Jason Lutz presented the staff report which is on file. Staff recommends approval of the plat vacation with the condition that any other property owners in the subdivision (cell tower) sign the required documents to vacate the plat prior to recording. 3. Planning & Zoning Commission Report Chair James: Commission recommended approval with staff conditions 6 to 0 4. Public Hearing - No one spoke during the Public Hearing. 5. Discuss and consider approval of a Resolution Designating an Official Newspaper for Fiscal Year 2019-2020, and an Agreement between the City of Dripping Springs and Designated Newspaper regarding the Official Newspaper. Andrea Cunningham presented the staff report which is on file. Staff recommends the City designate the News-Dispatch as the Official Newspaper. Mayor Purcell opened the floor to a Public Hearing. Dalton Sweat and John Pacheco spoke in favor of designating the Dripping Springs Century News as the Official Newspaper. A motion was made by council Member Crow to designate the Dripping Springs Century News as the Official Newspaper for Fiscal Year 20 19-2020 and to approve an Agreement between the City of Dripping Springs and the Dripping Springs Century News regarding the Official Newspaper. Council Member King seconded the motion which carried 4 to 1, with Mayor Pro Tern Foulds opposed. Filed as Resolution No. 2019-R36 <The C ity Council took a short break from 7: 16 p.m. - 7:20 p.m.> C. Discuss and consider approval of an Appeal of administrative decision to charge professional and consultant fees as determined by ordinance as it related to the SD2017-0005 and SD2019-0021 for the Mark Black Wedding Venue and Mark Black Wedding Venue Amendment. Kenneth Chaiken, attorney representing the Mark Black Wedding Venue, spoke in favor of the C ity Council granting the appeal. Laura Mueller presented the staff report which is on file. A motion was made by Mayor Pro Tern Foulds to postpone the item to the November 12, 2019 City Council & Board of Adjustment Workshop and Regular Meeting. Council Member King seconded the motion which carried unanimously 5 to 0. D. Discuss and consider approval of a Professional Services Agreement between the City of Dripping Springs and Travis Cox Plumbing Company, LLC regarding Plumbing Upgrades at the Dripping Springs Ranch Park and Event Center and Authorization for the City Administrator to execute the Agreement. Sponsor: Wade King Lynne Dickinson presented the staff report which is on file. Staff recommends approval of the Professional Services Agreement with Travis Cox P lumbing. A motion was made by Council Member King to approve a Professional Services Agreement between the City of Dripping Springs and Travis Cox Plumbing Company, LLC regarding Plumbing Upgrades at the Dripping Springs Ranch Park and Event Center and Authorization for the City Administrator to execute the Agreement. Council Member Kroll seconded the motion which carried unanimously 5 to 0. E. Discuss and consider approval of job description for part-time Records Management Clerk and authorization for Mayor/City Administrator to hire for the position. F. Discuss and consider approval of job description for Accounts Receivable Clerk and authorization for Mayor/City Administrator to hire for the position.
