I. WORKSHOP No action will be taken during the Workshop. A. Presentation on Legislative changes to Budget Calendar and terms. Presentation on TIRZ Town Center Project related to the feasibility and financing of the proposed Interlocal Agreement with the Dripping Springs Independent School District, Dripping Springs Community Library, and Hays County. Keenan Smith and Darin Smith gave a presentation on the TIRZ Town Center Project which is on file. Chris Lane presented financial data related to the TIRZ Town Center Project which is also on file. III. RECESS - The City Council did not recess. IV. RECONVENE AT 6:30 P.M. V. PLEDGE OF ALLEGIANCE Mayor Purcell led the Pledge of Allegiance to the Flag. VI. PROCLAMATIONS & PRESENTATIONS No action to be taken on proclamations and presentations. The City Council may choose to discuss and take public comment on these items as necessary. A. Proclamation proclaiming March 21, 2020 as "Down Syndrome Association of Texas Day". Sponsor: Council Member King Council Member King read and presented the proclamation to Down Syndrome Association of Central Texas Executive Director Jennifer Edwards, Board Member Tracey Cantu, and members of the Cantu family. VII. PRESENTATION OF CITIZENS A member of the public who desires to address the City Council regarding any item on an agenda for an open meeting may do so at presentation of citizens before an item or at a public hearing for an item during the City Council's consideration of that item. Citizens wishing to discuss matters not contained within the current agenda may do so, but only during the time allotted for presentation of citizens. Speakers are allowed two (2) minutes to speak during presentation of citizens or during each public hearing. Speakers may not cede or pool time. Members ofthe public requiring the assistance of a translator will be given twice the amount of time as a member of the public who does not require the assistance of a translator to address the City Council. It is the request of the City Council that members of the public wishing to speak on item(s) on the agenda with a noticed Public Hearing hold their comments until the item(s) are presented for consideration. Speakers are encouraged to sign in. Anyone may request a copy of the City's policy on presentation of citizens from the city secretary. By law no action may be taken during Presentations of Citizens. North Hays County Fire Rescue (ESD No. 6) Fire Chief Scott Collard presented the results from the Insurance Services Offices (ISO) rating. The City classification improved to a rating of Public Protection Class 02 which could result in reduced insurance costs. Mark Key spoke thanking Mayor Purcell for his service to the community. CONSENT AGENDA The following items are anticipated to require little or no individualized discussion due to their nature being clerical, ministerial, mundane or routine. In an effort to enhance the efficiency of City Council meetings, it is intended that these items will be acted upon by the City Council with a single motion because no public hearing or determination is necessary. However, a City Council Member or citizen may request separate deliberation for a specific item, in which event those items will be removedfi·om the consent agenda prior to the City Council voting on the consent agenda as a collective, singular item. Prior to voting on the consent agenda, the City Council may add additional items that are listed elsewhere on the same agenda. A. Approval of the form of the Liability and Maintenance Agreement between the City of Dripping Springs and certain Mercer Street property owners and regarding parking for the 2020 Founders Day Event to be held April 24 - 26, 2020 and authorization for staff to execute the agreement. Sponsor: Council Member Manassian F. Approval of the Job Description for Swim Aide and authorization for the City Administrator to hire as approved in the Parks & Community Services Budget. Approval of a Partial Assignment of Wastewater Service and Fee Agreement between related to the Assignment of 9.961 acres from Jim Karban to Steven and Kathleen Shubin. Sponsor: Mayor Pro Tern Foulds A motion was made by Mayor Pro Tern Foulds to approve Consent Agenda Items A - F, and to pull Item G for individual consideration. Council Member King seconded the motion which carried unanimously 5 to 0. Approval of a Partial Assignment of Wastewater Service and Fee Agreement between related to the Assignment of 9.961 acres from Jim Karban to Steven and Kathleen Shubin. Sponsor: Mayor Pro Tern Foulds A motion was made by Mayor Pro Tern Foulds to approve a Partial Assignment of Wastewater Service and Fee Agreement between related to the Assignment of9.961 acres from Jim Karhan to Steven and Kathleen Shubin. Council Member King seconded the motion which carried 4 to 1, with Council Member Kroll recused. IX. BOARD OF ADJUSTMENT The Board of Adjustment will consider items related to appeals of administrative land use determinations, requests for variances and special exceptions related to land use projects, and other items as provided for in the Dripping Springs Code of Ordinances. Board of Adjustment Members Present: Chair Todd Purcell, Travis Crow, Wade King, John Kroll, Taline Manassian, and Alternate Member Joe Volpe. With a quorum of the Board of Adjustment present, the Board considered the following items. A. Public hearing and consideration of approval regarding a Sign Variance Request for an additional wall sign for The Home Depot's Rental Center, located at 260 E. Highway 290, Dripping Springs, TX. Applicant: Rosalyn Holderfied, ID Associates, on behalf of The Home Depot 1. Presentation No presentation given. A letter from the representative of absence due to travel restrictions is on file. 2. Sign Administrator's Report Michelle Fischer presented the Sign Administrator's Report which is on file. Approval with the following conditions is recommended: • Noncompliant flag lights be brought into compliance, • Outdoor storage be brought into compliance; and • Should staff determine any other lighting is noncompliant, that it be brought into compliance. 3. Variance Request to Allow an Additional Wall Sign A motion was made by Board Member Foulds to postpone the item to the April 14, 2014 Board of Adjustment meeting. Board Member King seconded the motion which carried unanimously 6 to 0. Board Member Foulds directed staff to address parking behind the building. B. Public hearing and consideration of approval regarding VAR2020-0001: an Application for Special Exception to Chapter 30 Zoning, Exhibit A Zoning Ordinance, Section 5 Development Standards, Subsection B 5.10.1 Screening of Non-residential & Multiple-Family for property located at the southwest intersection of Hwy 290 and Bunker Ranch Rd., Dripping Springs, TX (Legal Description: Lot lA & lB, Phase 1, Block 2 of the Bunker Ranch Subdivision) Applicant: Mario Castillo, KBGE, a Part of Civil & Environmental Consultants, Inc 1. Presentation No presentation given. 2. Staff Report Amanda Padilla presented the staff report which is on file. Staff recommends approval with conditions that the new fence along US Highway 290 be reviewed and approved by staff prior to approval of the site development permit, and the fence be constructed of a masonry material. 3. Public Hearing and consideration of approval regarding ZA2019-0011: an Ordinance to Amend the City of Dripping Springs Code of Ordinances Chapter 6: Business Regulations, Article 6.04: Alcoholic Beverages, and Chapter 30: Zoning, Exhibit A: Zoning Ordinance, Section 1.6: Definitions and Section 3.17: Conditional Use Permit (CUP). 1. Staff Report Laura Mueller presented the staff report which is on file. Staff is requesting postponement of the item. 2. Planning & Zoning Commission Report Chair James: Commission recommend approval of Option B by a vote of 3 -1 -1-1, with Commissioner Strong opposed, Commissioner Newman abstained, and Commissioner McIntosh recused. 3. Public Hearing No one spoke during the Public Hearing. 4. Zoning Ordinance A motion was made by Council Member Kroll to postpone the item to the April 14, 2020 City Council Regular Meeting. Mayor Pro Tern Foulds seconded the motion which carried unanimously 5 to 0. B. Public Hearing regarding ZA2020-0002: Application for Zoning Amendment from Agricultural (AG) to Commercial Services (CS) for an approximately 8.546 acre tract of land situated in the Benjamin F. Hanna Survey, Abstract No. 222, Section No. 28, Hays County, Texas. The property is generally located north of U.S. Hwy 290, and west of Bell Springs Road. Applicant has requested postponement based on Planning and Zoning Commission direction. Applicant: Rusty Staudt 1. Staff Report Amanda Padilla presented the staff report which is on file. Public Hearing and consideration of approval regarding SD2020-0002: Application for a Site Development Permit for property located on Hwy 290, between Ledgestone Drive and Four Star Boulevard, Dripping Springs, TX 78620 (Legal Description: A0245 William S Holton Survey, Acres 3.07). The Site Development application is for a Firestone Service Center. Applicant: Felix Manka, P.E., CMA Engineering, INC 1. Presentation Felix Manka was available for questions from the City Council. 2. Staff Report Amanda Padilla presented the staff report which is on file. Staff recommends approval with the condition that the applicant address all remaining comments prior to receiving Signatures for City approval. 3. Sponsor: Mayor Pro Tern Foulds Kelly Schmidt presented the staff report which is on file. Staff recommends approval of the resolution and policy. A motion was made by Mayor Pro Tern Foulds to approve Resolution approving Employee Discount Policy for Discounts for Park Programs with the condition that the policy reflects City Council & Board ofAdjustment March I 0, 2020 Workshop & Regular Meeting Minutes Page 7 of13  personal use only with regards to rental facilities. Council Member Crow seconded the motion which cauied tmanimously 5 to 0. Filed as Resolution No. 2020-R07 E. Discuss and consider approval of plan for additional recreational vehicle (RV) hookups at the Dripping Springs Ranch Park. Sponsor: Council Member King Lynne Dickinson presented the staff report which is on file. Staff recommends approval of the additional hookups. A motion was made by Council Member King to approve a plan for additional recreational vehicle (RV) hookups at the Dripping Springs Ranch Park. Council Member Kroll seconded the motion which carried unanimously 5 to 0. F. Discuss and consider approval of an Agreement between the City of Dripping Springs and Varnell Electric for the installation of RV Slot Electrical Boxes and other electrical improvements at Dripping Springs Ranch Park. Sponsor: Council Member King Lynne Dickinson presented the staff report which is on file. Staff reconm1ends approval of the agreement. A motion was made by Council Member King to approve an Agreement between the City of Dripping Springs and Varnell Electric for the installation of RV Slot Electrical Boxes and other electrical improvements at Dripping Springs Ranch Park. Discuss and consider approval of a Resolution Authorizing the City Administrator to Negotiate an Amendment to the Mutual Maintenance Agreement with TXDOT to include Wayfinding Signs and other updates. A motion was made by Mayor Pro Tern Foulds to approve a Resolution Authorizing the City Administrator to Negotiate an Amendment to the Mutual Maintenance Agreement with TXDOT to include Wayfinding Signs and other updates . Laura Mueller presented the item and notified the City Council that the TIRZ No. 1 & No . 2 Board requested an extension of their budget recommendation deadline to May 15, 2020. Council Member Kroll seconded the motion which carried 4 to 1, with Mayor Pro Tern Foulds opposed. I. Discuss and consider approval of Selection of Bid regarding Ranch Park Dam Repairs & Improvements and authorization for the City Administrator to negotiate the agreement. Chad Gilpin presented the item and bid tabulation which is on file. Staff recommends the selection of DigDug Construction, LLC. A motion was made by Council Member King to select DigDug Construction, LLC for Ranch Park Darn Repairs & Improvements and to authorize the City Administrator to negotiate the agreement. Council Member Kroll seconded the motion which carried unanimously 5 to 0. J. Discuss and consider approval of a Ninety (90) Day Extension of the Solid Waste Franchise Agreement between the City of Dripping Springs and Progressive Waste Solutions of Tx, Inc. d/b/a/ WC of Texas regarding Solid Waste Services. Sponsor: Mayor Pro Tern Foulds Ginger Faught presented the staff report which is on file. Staff recommends approval of the extension. Discuss and consider approval of an Interlocal Agreement, by and between the City of Dripping Springs, a general law city in Hays County, Texas; Dripping Springs Independent School District; Dripping Springs Community Library District; Hays County; and Tax Increment Reinvestment Zone #1 and Tax Increment Reinvestment Zone #2, Dripping Springs, Texas in connection with the development and construction of the Town Center Project. Discuss and consider approval of an Amendment to the Interlocal Agreement, by and between the City of Dripping Springs, a general law city in Hays County, Texas; Dripping Springs Independent School District; Dripping Springs Community Library District; Hays County; and Tax Increment Reinvestment Zone #1 and Tax Increment Reinvestment Zone #2, Dripping Springs, Texas in connection with the development and construction of the Town Center Project. Discuss and consider approval of an Amendment to the Interlocal Agreement between the City of Dripping Springs and Hays County regarding Dripping Springs Tax Increment Reinvestment Zone Number One and Tax Increment Reinvestment Zone Number Two and related approved documents. Sponsor: Council Member Manassian A motion was made by Council Member Kroll to approve an Amendment to the Interlocal Agreement between the City of Dripping Springs and Hays County regarding Dripping Springs Tax Increment Reinvestment Zone Number One and Tax Increment Reinvestment Zone Number Two and related approved documents. Council Member Manassian seconded the motion which carried unanimously 5 to 0. A motion was made by Council Member Kroll to pull Executive Session Agenda Items F and G into Open Session for action. Council Member King seconded the motion which carried unanimously 5 to 0. F. Deliberation of Personnel Matters regarding Ranch Hand Joseph Schorp and related to employee compensation and benefits. A motion was made by Council Member King to approve the salary adjustment as recommended by the DSRP Event Center Manager. Council Member Crow seconded the motion which carried unanimously 5 to 0. G. Deliberation of Personnel Matters regarding Job Duties and Employment related to the Planning Intern A motion was made by Council Member Manassian to authorize retention of the Planning Intern through the fiscal year as a Records Management Intern and to authorize Michelle Fischer to approve the job description for the Records Management Intern.
