CITY OF DRIPPING SPRINGS PLANNING AND ZONING COMMISSION Regular Meeting Minutes February 26,2013 7:00 p.m. 511 Mercer Street, Dripping Springs,Texas Thisfacility is wheelchair accessible. Accessible parking spaces are available. Requestsfor auxiliary aids and services must be made 48 hours prior to this meeting by calling (512)858-4725. I. CALL TO ORDER AND ROLL CALL Commission Members Larry McClimg - Chair Mim James Josef Martin Vacancy Danny Hubbard- Vice Chair Whit Smith Erik Burgeson City Staff/Appointed Officials City Administrator Michelle Fischer Planning Director Jon Thompson City Secretary Jo Ann Touchstone City Attorney Alan Bojorquez City Engineer Rick Coneway Commissioner McClung calls the meeting to order at 7:00 p.m. All present except Rick Coneway and Alan Bojorquez. II. PLEDGE OF ALLEGIANCE- Commissioner Burgeson leads the pledge. III. PRESENTATIONS BY CITIZENS Floor open to discussion on any subject. No action may be taken by law. Citizens wishing to speak shall do so after being recognized by the Chairman. The Chairman and Commission may establish a time limit as necessary. No one speaks. IV. MINUTES A. Approval of Regular Meeting Minutes, January 22,2013- Commissioner Hubbard motions to approve. Commissioner James seconds. Commissioner McClung states correction to Linwood motion to include two abstentions for Commissioner McClung and Commissioner Burgeson. Commissioner James and Hubbard accept friendly amendment. Motion passes, 6-0. V. SITE DEVELOPMENTS/SUBDIVISIONS/ZONING/ON SITE SEWAGE FACILITIES/SIGNSA^ARIANCESAVAIVERS/ALTERNATE STANDARDS/DEVELOPMENT AGREEMENTS Consideration and Possible Action on: A. Ordinance No. 1220.82 - An Ordinance of the City of Dripping Springs, Texas ("City"), Amending the Zoning Classifications of Certain Real Property in the City Limits of a Portion of the Property Known as Arrowhead Ranch, and Represented in Exhibits A and B, Upon Request of the Property Owners; Designating a Certain Portion of the Property as GUI (Govemment/Utility/Institutional) and Designating a Certain Portion of the Property as GR(General Retail), Amending the Official Zoning Map to Reflect Changes of the Zoning Classifications of Certain Properties, Providing For Severability, and Providing an Effective Date, Barrett Allison, P.E 1.Presentation - None. 2.Planning Director's Report- Planning Director Jon Thompson,report on file. 3.Public Hearing - No one speaks. 4.Ordinance No. 1220.82- Commissioner Hubbard motions to approve staff recommendations. Commissioner McClung seconds. Motion passes, 6-0. B. Ordinance No. 1220.83 - An Ordinance of the City of Dripping Springs, Texas ("City"), Altering the Zoning Classifications of Certain Real Property in the City Limits by Creating and Applying a Conditional Overlay Upon Certain Portions of the Development Known as Arrowhead Ranch, Particularly the Property Referenced in Exhibit A, Upon Request of the Property Owners; Creating Conditional Overlays on Two Portions of the Subject Property to Expressly Incorporate by Reference the Terms and Conditions of a Certain Amended Development Agreement; Amending the Official Zoning Map to Reflect Changes of the Zoning Classification of Certain Properties, Providing for Severability, and Providing an Effective Date 1. Subdivision Concept Plan - Linwood Tract, located on the east side of Ranch Road 12, approximately 2,149 feet south of Dripping Springs Elementary School, A0415 Philip A. Smith Survey, +/-103 acres, John Doucet, P.E., Doucet & Associates 1. Presentation - Agenda item pulled by applicant 2. Planning Director's Report-Planning Director Jon Thompson states to accept request to table. 3. Public Hearing-No one speaks. 4. Subdivision Concept Plan - Commissioner Martin motions to table per staff recommendations. Commissioner Smith seconds. Motion passes, 4-0-2. Commissioners McClung and Burgeson abstain. D. Replat- Ruby Ranch,Phase 7, Lots 7 & 8, Block A,located at the addresses of 560 and 588 West Bartlett Drive, Allen W. Hickman, Jr., Applicant 1. Presentation - Mr. Hickman states this request is being brought back a second time as the original request was not recorded when approved. 2. Planning Director's Report- Planning Director Jon Thompson,report on file. Staff recommends approval. 3. Public Hearing-No one speaks. 4. Replat- Commissioner James motions to approve. Commissioner Smith seconds. Motion passes, 6-0. E. Replat - The Commons,Lot 1 A,located at 100 Commons, Greg Porter, Applicant 1. Presentation - Agenda item pulled by applicant 2. Planning Director's Report - None. 3. Public Hearing - No one speaks. 4. Replat- Commissioner McClung motions to table. Commissioner Burgeson seconds. Motion passes, 6-0. P. Replat-200 Bluff Street, of a portion ofthe W.T. Chapman,Third Addition to the Town of Dripping Springs,Joan Croswell, Applicant 1. Presentation - Mr. Jim Polkinghom is available for questions. 2. Planning Director's Report - Planning Director Jon Thompson, report on file. Staff recommends approval with addition of shared access driveway for lots 4 and 5 and a note for compliance with the zoning ordinance for setbacks. 3. Public Hearing -No one speaks. 4. Replat- Commissioner Hubbard motions to approve with recommended notations on the plat. Commissioner James seconds. Commissioner McClung allows Mr. Polkinghom to speak regarding driveways. Mr. Polkinghom states he does not want to do a shared driveway as it is more problematic for residents to get in and out. Commissioner McClung makes friendly amendment to remove plat note for shared driveway for lots 4 and 5. Commissioner James accepts friendly amendment. Commissioner Hubbard accepts friendly amendment. Motion passes, 6-0. G. Sign Variance Request - Creek Road Cafe, 301 Highway 290 W., Carl Shroyer, General Manager and Owner 1. Presentation - Mr. Shroyer states request to install a monument sign and is available for questions. 2. Sign Administrator's Report- City Administrator Michelle Fischer, report on file. Staffrecommends approval with recommendation that lighting on building be brought into compliance within 90 days ofissuance of sign permit. 3. Public Hearing - No one speaks. 4. Sign Variance Request to erect a Monument Sign within the Setback from Right-of-Way (Section 26.06.004)- Commissioner James motions to approve with staff recommendations, including compliance with lighting ordinance for building lights. Commissioner Martin seconds. Commissioner McClung inquires whether the recommendation for compliance would put an imdue financial hardship on the applicant. Commissioner Martin retracts second. Commissioner James retracts motion. Commission discusses whether or not applicant installed lighting and there is a violation and what hardship would be to bring lighting into compliance. Commissioner James motions to approve sign variance as proposed and request staff to investigate whether there is an issue with lighting. Commissioner Martin seconds. Motion passes, 6-0. VI. EXECUTIVE SESSION The Planning & Zoning Commission for the City of Dripping Springs reserves the right to adjourn into executive session at any time during the course ofthis meeting to discuss any ofthe matters listed above, as authorized by Texas Government Code Sections 551.071 (Consultation with Attorney), 551.072(Deliberations about Real Property), 551.073 (Deliberations about Gifts and Donations), 551.074(Personnel Matters), 551.076(Deliberations about Security Devices), and 551.086(Economic Development) VII.
