July 23, 2019 at 6:30 p.m.
A Regular Meeting of the Planning & Zoning Commission was held Tuesday, July 23, 2019 beginning at
6:30 p.m. in the City Hall Council Chambers located at 511 Mercer Street, Dripping Springs, Texas.
I. CALL TO ORDER AND ROLL CALL
Commission Members present were:

With a quorum of the Commission present, Chair James called the meeting to order at 6:30 p.m.
The Planning and Zoning Commission honored Commissioner Michael Lavengco thanking him for
his service on the Planning and Zoning Commission.
II. PLEDGE OF ALLEGIANCE
Commissioner Newman led the Pledge Allegiance to the Flag.
III. PRESENTATION OF CITIZENS
Floor open to discussion on any subject. No action may be taken by law. Citizens wishing to speak
shall do so after being recognized by the Chair. The Chair may establish a time limit as necessary.
No one spoke during the Presentation of Citizens.
IV. BUSINESS
A. Discuss and consider approval of the Planning & Zoning Commission Corrected
Regular Meeting Minutes of May 28, 2019, and the Regular Meeting Minutes of June
25, 2019.

A motion was made by Vice Chair Martin to approve the Corrected Regular Meeting
minutes of May 28, 2019. Commissioner McIntosh seconded the motion which carried
unanimously, 7 to 0.
A motion was made by Vice Chair Martin to approve the corrected Regular meeting minutes
of June 25, 2019. Commissioner Strong seconded the motion which carried unanimously, 7
to 0.
B. Discuss and consider approval of the Minutes Format for the recorded minutes of the
Planning & Zoning Commission.
Sponsor: Chair James
A motion was made by Chair James approve the expanded action format for Planning &
Zoning minute’s noting who spoke, the issues they spoke on, and the action taken by the
Commission. Vice Chair Martin seconded that motion which carried unanimously 7 to 0.
The Commission was in agreement with wanting to know if someone does or does not speak.
C. Public hearing, consideration, and recommendation regarding a Zoning Amendment
Ordinance related to ZA2019-0002: to consider a requested zoning change from Single-
Family Residential District – Low Density (SF-1) to Multiple – Family Residential
District (MF) for property located at 26700 Ranch Rd 12, Dripping Springs, Texas
(Legal Description: ABS 415 9-3106-01-15 Philip A Smith Survey 10.00 AC MH- AKA
Western Woods, Hays County, TX).
Applicant: Jon Thompson
1. Presentation
Jon Thompson presented the item. He requested postponement of the item to the August 27,
2019 Planning and Zoning Meeting. His client is awaiting potential funding from the State.
2. Staff Report
No staff report was given. Staff was under the impression that the Applicant wanted to
withdraw their item.
3. Public Hearing
Anton Allen spoke in opposition to the item citing adverse effects to his property and traffic
congestion on Ranch Road 12.
4. Zoning Amendment (application withdrawn, no action required)
A motion was made by Vice Chair Martin to Postpone the Zoning Amendment Ordinance
related to ZA2019-0002: to consider a requested zoning change from Single-Family
Residential District – Low Density (SF-1) to Multiple – Family Residential District (MF)
for property located at 26700 Ranch Rd 12, Dripping Springs, Texas to the August 27, 2019

Regular Planning and Zoning Commission Meeting. Commissioner Garza seconded the
motion which carried unanimously, 7 to 0.
Via Unanimous consent the Commission heard and considered Items D and E concurrently.
D. Public hearing, consideration, and recommendation regarding a Development
Agreement Amendment related to DA2019-0001: to remove an approximate 7.105-
acre tract from the overall 24.69 acres referred to as the "Hall Commercial Tract"
Development Agreement under Section 4.1.3 of the original Development Agreement,
located at the northwest intersection of RR-12 and Whisenant Lane.

E. Public hearing, consideration, and recommendation regarding a Zoning Amendment
Ordinance related to ZA2019-0007: to consider a requested zoning change from
General Retail (GR) to Commercial Services (CS) for an approximate 7.10 acres tract
out of the P. A. Smith Survey, Abstract No. 415, and the G. W. Lindsay Survey,
Abstract No. 289, located at the northwest corner of Ranch Road 12 and Whisenant
Lane, Dripping Springs, Texas, No. 289.

1. Presentation
Jon Thompson presented Items D and E. The Zoning amendment is for the property located
at the intersection of Whisenant Lane and Ranch Road 12 and is approximately 1.25 acres.
He asked if the Planning and Zoning Commission are considering denial on the Zoning
Amendment that they would allow him to postpone it to gather more information for the
Commission.
2. Staff Report
Jason Lutz presented the staff reports to the commission, which are on file.
Based on the fact that only the 7 acre tract would be removed from the Development
Agreement and given that current City regulations are the same or better for the subject area
staff can support the request to remove the 7 acre tract. As for the Zoning Amendment, based
on adjacent zoning and land uses staff recommends denial of the requested zoning change
from GR to CS. If the applicant proposes the zoning change with an accompanying
Conditional Overlay and more specific site plans, staff would re-evaluate the
recommendation.
3. Public Hearing
Oscar Jones, Connie Lanford, Jim Castagneto, Matthew Ordway, V. Chips, Sandra Barber,
Frank Roberts, Doug Thompson and Chuck Hutchinson spoke in opposition to the items
citing adverse effects to property values and quality of life, increased traffic, decreased
motorist and pedestrian safety, noise, zoning not appropriate for area, and the potential for
increased flooding and drainage issues .

4. Development Agreement Amendment & Zoning Amendment
The Commission discussed both the Development Agreement Amendment and the Zoning
Ordinance Amendment concurrently. They had concerns on the access points for the
development. The Commission believed that item D would be more beneficial to the city
but Item E they believed the zoning did not seem compatible.
Via unanimous consent, the Planning & Zoning Chair James adjourned into Executive
Session under Texas Government Code Section 551.071, Consultation with Attorney, and
regarding Business Agenda Items D and E.
The commission met in Executive Session at 8:04 p.m. – 8:14 p.m.
No vote or action was taken during Executive Session. Chair James returned
the meeting Open Session at 8:14 p.m.
A motion was made by Vice Chair Martin to recommend approval of the Development
Agreement Amendment related to DA2019-0001: to remove an approximate 7.105-acre

SURVEY, ACRES 183.793).
Applicant: Carlson, Brigance & Doering, Inc.
1. Presentation
Ryan Harden with CBD, Inc. was present and available for questions from the Commission.
2. Staff Report
Chad Gilpin presented the staff report, which is on file. Staff recommends approval of the
Preliminary Plat.

4. Preliminary Plat
A motion was made by Commissioner McIntosh to recommend approval of SUB2019-0028:
Arrowhead Ranch Phase 4 Preliminary Plat for Arrowhead Ranch Subdivision;
approximately 127.896 acres Located at the end of Arrowhead Ranch Boulevard, Dripping
Springs TX 78620. Vice Chair Martin seconded the motion which carried unanimously, 7
to 0.
G. Presentation and discussion regarding Planning & Development Proposed Projects
and Cost Estimates for the Fiscal Year 2019-2020 Budget.
Jason Lutz presented the staff report which is on file.
V. REPORTS OF STAFF AND AGENCIES
No action to be taken.
A. Presentation and discussion regarding State Law Changes regarding House Bill 3167
and its effect on City Subdivision, Site Development, and Parkland Dedication
Ordinances.
Laura Mueller presented her staff report which is on file.
B. Presentation regarding the City of Dripping Springs award of Platinum Level Scenic
City Certification.
Jason Lutz presented the presentation to the Commission.
VI. EXECUTIVE SESSION
The Planning and Zoning Commission for the City of Dripping Springs has the right to adjourn into
executive session at any time during the course of this meeting to discuss any matter as authorized by
Texas Government Code Sections 551.071 (Consultation with Attorney), 551.072 (Deliberations
about Real Property), 551.073 (Deliberations about Gifts and Donations), 551.074 (Personnel
Matters), 551.076 (Deliberations about Security Devices), and 551.086 (Economic Development). The
Planning and Zoning Commission for the City of Dripping Springs may act on any item listed in
Executive Session in Open Session or move any item from Executive Session to Open Session for
action.
The Planning & Zoning Commission met in Executive Session earlier in the Agenda.
