Planning & Zoning Commission Regular Meeting Minutes December 18, 2019 at 6:30 p.m. A Regular Meeting of the Planning & Zoning Commission was held Wednesday, December 18, 2019 beginning at 6:30 p.m. in in the City Hall Council Chambers located at 511 Mercer Street, Dripping Springs, Texas. I. CALL TO ORDER AND ROLL CALL Commission Members present were: Mim James, Chair Martin Garza Christian Bourguignon Roger Newman John McIntosh Commission Members absent were: James Martin, Vice Chair Evelyn Strong City Staff/Appointed Officials present were: Jason Lutz, Planning Director Amanda Padilla, City Planner II Laura Mueller, Assistant City Attorney With a quorum of the Commission present, Chair James called the meeting to order at 6:30 p.m. II. PLEDGE OF ALLEGIANCE Commissioner McIntosh led the Pledge of Allegiance to the Flag. III. PRESENTATION OF CITIZENS A member of the public who desires to address the Commission regarding any item on an agenda for an open meeting may do so at presentation of citizens before an item or at a public hearing for an item during the Commission’s consideration of that item. Citizens wishing to discuss matters not contained within the current agenda may do so, but only during the time allotted for presentation of citizens. Speakers are allowed two (2) minutes to speak during presentation of citizens or during each public hearing. Speakers may not cede or pool time. Members of the public requiring the assistance of a translator will be given twice the amount of time as a member of the public who does not require the assistance of a translator to address the Commission. It is the request of the Commission that members of the public wishing to speak on item(s) on the agenda with a noticed Public Hearing hold their comments until the item(s) are presented for consideration. Speakers are encouraged to sign in. Anyone may request a copy of the City’s policy on presentation of citizens from the city secretary. By law no action may be taken during Presentations of Citizens. Discuss and consider approval of the November 20, 2019 Planning & Zoning Commission Regular Meeting Minutes. A motion was made by Commissioner Newman to approve the November 20, 2019 Planning & Zoning Commission Regular Meeting Minutes. Commissioner Garza seconded the motion which carried unanimously 5 to 0. B. Public hearing and consideration of approval regarding SUB2019-0055: to consider a replat for property located southeast of the Belterra Dr. and U.S. Hwy 290 intersection, Dripping Springs (Legal Description: Block A, Lot 1B-1 and Lot 1G of the North Belterra Commercial Subdivision, Hays County, TX). The proposed replat would combine two existing lots. Applicant: Harrsion M. Hudson, PE 1. Presentation No presentation was given. 2. Staff Report Jason Lutz presented the Staff report to the commission, which is on file. Staff recommends approval of the replat. 3. Public Hearing No one spoke during the Public Hearing. 4. SUB2019-0055 A motion was made by Commissioner McIntosh to approve SUB2019-0055: a replat for property located southeast of the Belterra Dr. and U.S. Hwy 290 intersection, Dripping Springs (Legal Description: Block A, Lot 1B-1 and Lot 1G of the North Belterra Commercial Subdivision, Hays County, TX). Commissioner Garza seconded the motion which carried unanimously, 5 to 0. C. Public hearing and consideration of approval regarding SUB2019-0056: to consider a replat for property located on the east side of Thurman Roberts Way, Dripping Springs (Legal Description: Block A, Lots 13, 14, and 15, Driftwood Subdivision, Phase I, Section 2, Hays County, TX). The proposed replat would subdivide 3 existing lots into 5 lots. Applicant: George Murfee 1. Presentation No presentation was given. Staff recommends approval of the replat. 3. Public Hearing No one spoke during the Public Hearing. 4. SUB2019-0056 A motion was made by Commissioner Garza to approve SUB2019-0056: to consider a replat for property located on the east side of Thurman Roberts Way, Dripping Springs (Legal Description: Block A, Lots 13, 14, and 15, Driftwood Subdivision, Phase I, Section 2, Hays County, TX). Commissioner Newman seconded the motion which carried unanimously, 5 to 0. D. Public hearing and consideration of approval regarding SUB2019-0057: to consider a preliminary plat establishing Phase 3 of the Arrowhead Ranch Subdivision, located east of the Red Granite Dr. and Pink Granite Blvd. intersection, Dripping Springs (Legal Description: Approximate 27.718 Acres out of the Benjamin F. Hanna Survey, Abstract No. 222, Hays County, TX). The proposed preliminary plat would establish 67 residential lots of Phase 3 of the Arrowhead Ranch Subdivision. Applicant: Christine M. Methvin 1. Presentation No presentation was given but Ryan Harden with CBD Engineering was available for any questions. 2. Staff Report Jason Lutz presented the staff report to the commission, which is on file. He stated that there was a change to the Staff report which was the recommendation. The applicant addressed their comments prior to the meeting. Staff recommends approval of the Preliminary Plat. 3. Public Hearing No one spoke during the Public Hearing. 4. SUB2019-0057 A motion was made by Commissioner McIntosh to approve SUB2019-0057: to consider a preliminary plat establishing Phase 3 of the Arrowhead Ranch Subdivision, located east of the Red Granite Dr. and Pink Granite Blvd. intersection, Dripping Springs (Legal Description: Approximate 27.718 Acres out of the Benjamin F. Hanna Survey, Abstract No. 222, Hays County, TX). Commissioner Bourguignon seconded the motion which carried unanimously, 5 to 0. Public hearing, consideration, and recommendation regarding VAR2019-0014: to consider variances to Chapter 30, Section 5.6. Parking Based on Use and 5.7.6 Rules for Computing Places, regarding how mixed use structures calculate required parking and required parking for the property located at 330 Mercer St, Dripping Springs, TX 78620, (Legal Description: W T CHAPMAN #1, BLOCK 1, LOT 1-2 & 10, ACRES 0.3644 and W T CHAPMAN #1 LOTS 6-7-8-9 BLK 1 GEO#90403754 Hays County, Texas). Applicant: Dean Erickson 1. Presentation Jon Thompson presented the item to the commission. He stated that this building is an existing building where the old dance hall was. If the City limits parking at this location it will limit the use that will be allowed in the building. The applicant is proposing 61 parking spaces, shown on the Parking Plan Exhibit. 2. Staff Report Jason Lutz presented the staff report to the commission, which is on file. Staff recommends approval with the following conditions: 1. That the applicant construct/improve existing areas to provide additional parking spaces within a specified timeframe. 2. That the applicant pull a site development permit prior to paving the proposed spaces in order to review water quality and drainage. 3. Public Hearing No one spoke during the public hearing. 4. VAR2019-0014 A motion was made by Commissioner Bourguignon to approve the Variance to the Code of Ordinance Chapter 30, 5.7.6 Rules for Computing Places. Commissioner Garza seconded the Motion which carried unanimously, 5 to 0. A motion was made by Chair James to approve the Variance to the Code of Ordinances Chapter 30, Section 5.6. Parking Based on Use with the Following conditions: 1. Parking Spaces are no less than what is shown on Parking Plan Exhibit: A,B,C 2. The additional parking spaces be constructed within 12 months. 3. That a site development application/permit be received prior to paving of any additional spaces. Commissioner Garza seconded the motion which carried unanimously, 5 to 0. F. Public hearing, consideration, and recommendation regarding PDD2019-0001: to consider a Planned Development District to allow General Retail & Multi-Family land uses, up to 4 stories, an excess of 40’ feet in height, and reduced parking ratios for Planning & Zoning Commission December 18, 2019 Regular Meeting Minutes Page 4 of 7 property located 27110 Ranch Road 12 (Terry’s Mobile Home Park), Dripping Springs, TX (Legal Description: A0415 PHILIP A SMITH SURVEY, ACRES 5.34, Hays County, TX) and a portion of property located at 230 Sport Park Road (Legal Description: A0415 PHILIP A SMITH SURVEY, ACRES 4.27, Hays County, TX). Applicant: CRTX Development LLC (Phil Roesel) 1. Presentation No presentation was given but Phil Roesel was available for any questions. 2. Staff Report No staff report was given. Jason Lutz stated that the applicant has requested to table the item. Staff recommends tabling the item. 3. Public Hearing No one spoke during the Public Hearing. 4. PDD2019-0001 A motion was made by Commissioner Newman to Table PDD2019-0001: to consider a Planned Development District to allow General Retail & Multi-Family land uses, up to 4 stories, an excess of 40’ feet in height, and reduced parking ratios for property located 27110 Ranch Road 12 (Terry’s Mobile Home Park), Dripping Springs, TX (Legal Description: A0415 PHILIP A SMITH SURVEY, ACRES 5.34, Hays County, TX) and a portion of property located at 230 Sport Park Road (Legal Description: A0415 PHILIP A SMITH SURVEY, ACRES 4.27, Hays County, TX). Commissioner McIntosh seconded the motion which carried unanimously, 5 to 0. G. Public hearing, consideration, and recommendation regarding ZA2019-0010: to consider amendments to the Zoning Ordinance, Chapter 30, Exhibit A, Section 3.16 and the Appendix E Zoning Use Regulations (Charts) to allow “Park Accessory Uses”. Park Accessory Uses shall include, but not limited to, Community Centers, Senior Centers, Nature Centers, Dog Off Leash Areas, Parks & Community Services Admin Offices, Playgrounds, Camp sites, Hike and Bike trails, Observatory, Park Maintenance Workshop & Storage Facilities, Community Gardens, and other uses as approved by the City. Applicant: City Staff 1. Staff Report Jason Lutz presented the staff report to the commission, which is on file. Staff recommends approval of the amendment to the Zoning Ordinance. 2. ZA2019-0010 Chair James asked if the Parks and Recreation Commission has reviewed this item. Jason Lutz stated that this item will be on the January Agenda for the Parks and Recreation Commission. Chair James asked that staff review all the Overlays that are on current Park zones. His concern is that this change could affect in overlay. A motion was made by Chair James to recommend approval of ZA2019-0010: to consider amendments to the Zoning Ordinance, Chapter 30, Exhibit A, Section 3.16 and the Appendix E Zoning Use Regulations (Charts) to allow “Park Accessory Uses”. Park Accessory Uses shall include, but not limited to, Community Centers, Senior Centers, Nature Centers, Dog Off Leash Areas, Parks & Community Services Admin Offices, Playgrounds, Camp sites, Hike and Bike trails, Observatory, Park Maintenance Workshop & Storage Facilities, Community Gardens, and other uses as approved by the City. Commissioner Bourguignon seconded the motion which carried unanimously, 5 to 0. H. Public hearing, discussion, and recommendation regarding ZA2019-0011: an ordinance amending Article 6.04: Alcohol Sales of the Dripping Springs Code of Ordinances, Striking Section 6.04.002: Proximity to Schools, Churches, and Hospitals, and Amending Chapter 30: Zoning, Article 3.17: Conditional Use Permits to Create Section 3.17.18. Applicant: City Staff 1. Staff Report Laura Mueller presented the staff report to the Commission, which is on file. 2. Public Hearing No one spoke during the public hearing. 3. ZA2019-0011 A motion was made by Commissioner Garza to postpone ZA2019-0011: an ordinance amending Article 6.04: Alcohol Sales of the Dripping Springs Code of Ordinances, Striking Section 6.04.002: Proximity to Schools, Churches, and Hospitals, and Amending Chapter 30: Zoning, Article 3.17: Conditional Use Permits to Create Section 3.17.18. Commissioner Newman seconded the motion which carried unanimously, 5 to 0. The Commission would like for staff to look at every CUP for alcohol that has come in and see how this new change would affect those. V. REPORTS OF STAFF AND AGENCIES No action to be taken. EXECUTIVE SESSION The Planning and Zoning Commission for the City of Dripping Springs has the right to adjourn into executive session at any time during the course of this meeting to discuss any matter as authorized by Texas Government Code Sections 551.071 (Consultation with Attorney), 551.072 (Deliberations about Real Property), 551.073 (Deliberations about Gifts and Donations), 551.074 (Personnel Matters), 551.076 (Deliberations about Security Devices), and 551.086 (Economic Development). The Planning and Zoning Commission for the City of Dripping Springs may act on any item listed in Executive Session in Open Session or move any item from Executive Session to Open Session for action. The Commission did not meet in Executive Session. VII. UPCOMING MEETINGS A.
