1. DISCUSSION ONLY, ORDINANCE 24-09, MORATORIUM
Mayor Pennant asked staff to present information.
Ms. Lorraine Peterson, Development Director, presented a PowerPoint that provided an explanation of the
background resulting in the Town’s need to adopt Ordinance 24-09, Temporary Development Moratorium.
Ms. Peterson noted that, due to the historically high number of projects approved or proposed within the corporate
limits of the Town of Dundee, the Town has reached its daily allocable potable water capacity under the
consumptive water use permit (WUP) issued by the SWFWMD.
Ms. Peterson further explained how the Town is proposing to mitigate its need for and/or expand its public water
supply.

Beginning on the effective date of Ordinance 24-09, the moratorium has a 12-month term, unless terminated by the
Town Commission via ordinance.
Ms. Peterson reviewed which projects and/or type(s) of development not affected by the moratorium and made note
of the Town’s current water sources. Ms. Peterson further stated that one of the reason(s) for the Town’s need to
adopt the moratorium is to provide a reasonable period of time for the Town to construct a potable water
interconnect in accordance with the interlocal agreement between the City of Winter Haven and the Town of Dundee
in order to receive up to 500,000 gallons of potable drinking water per day.
Ms. Peterson also noted that the Town of Dundee is also applying to SWFWMD for transfer(s) of potable water
capacity from agricultural wells in order to accommodate the unprecedented residential growth of the Town.
Discussion ensued about the percentage (%) of the permitted capacity subject to transfer from the agricultural wells.
Mayor Pennant opened the floor for public comment; being none, the floor was closed.
Mayor Pennant stated that the moratorium is trying to secure the water resources for residents today.
