3. Adjustments to the Agenda
Commissioner Miller made a motion at 7:54 pm to excuse Commissioner Whitley and seconded by
Commissioner Buzby.
No adjustments were made to the agenda. The public hearings were advertised as required by law.
4. Approval of the Minutes from June 10, 2014
Motion: Approval (Miller, Buzby 2nd)

5. Public Hearings: Plan Amendment with Concurrent Zoning Map Change Request
A. Erwin Terrace at LaSalle (A1300010 & Z1300031)
Plan Amendment Request: Erwin Terrace Limited Partnership, LLC requests 19.64 acres
changed on the future land use map from Urban to Compact Neighborhood Tier at intersection
of Erwin Road and South LaSalle Street.
Zoning Map Change Request (MU(D))/Urban Tier to (MU(D))/Compact Neighborhood Tier.
Staff Report: No new information was presented.
Public Hearing: Chair Harris opened the public hearing. Five people signed up to speak; two
people spoke in support and three people spoke in opposition. Chair Harris closed the public
hearing.
Commission Discussion: Commissioners commended the developers for returning. It was
stated it was a good project and would increase jobs and tax revenue in the City of Durham.
Motion: Approval of Erwin Road at LaSalle Street A1300010 (Davis/ Whitley 2nd)
Action: Motion carried, 9-1 (Miller voting No)
Motion: Approval of Erwin Road at LaSalle Street Z1300031 (Davis/ Whitley 2nd).
Action: Motion carried, 10-0
Findings: The Planning Commission finds that the ordinance request is not consistent with the
adopted Comprehensive Plan. However, should the plan amendment be approved, the request
would be consistent with the Comprehensive Plan. The Commission believes the request is
reasonable and in the public interest and recommends approval based on comments received at
the public hearing and the information in the staff report.
6. Public Hearing: Zoning Map Change Requests
A. Grandin Trace Z1300035
Staff Report: Ms. Wolff presented the staff report.
Zoning Map Change Request Residential Rural (RR) to Planned Development Residential 3.322
(PDR 3.322) and Residential Rural with a development plan (RR(D)).
Public Hearing: Chair Harris opened the public hearing. Four people signed up to speak, two
people spoke in support and two people spoke in opposition. Chair Harris closed the public
hearing.
Commission Discussion: Commissioners had a few concerns regarding the right of way and left
turn lane. Some concerns were expressed with the developer adding sewer service and
boundary buffer to Mr. McKissick’s property without it being in the original plans.
Motion: Approval of Grandin Trace (Z1300035). (Padgett, Gibbs 2nd)
Action: Motion carried, 10-0
Findings: The Planning Commission finds that the ordinance request is consistent with the
adopted Comprehensive Plan. The Commission believes the request is reasonable and in the
public interest and recommends approval based on comments received at the public hearing
and the information in the staff report.

B. Waffle House – NC 55 Z1400019
Staff Report: Ms. Wolff presented the staff report.
Zoning Map Change Request Office Institutional (OI) to Commercial Neighborhood (CN).
Public Hearing: Chair Harris opened the public hearing. No one signed up to speak no one
spoke for support or in opposition. Chair Harris closed the public hearing.
Commission Discussion: The commissioners didn’t understand the reason for building another
Waffle House so close to the old location. Concerns were expressed the site to close to the
railroad.
Motion: Approval of Waffle House – NC 55 (Z1400019) (Miller, Padgett 2nd).
Action: Motion carried, 10-0
Findings: The Planning Commission finds that the ordinance request is consistent with the
adopted Comprehensive Plan. The Commission believes the request is reasonable and in the
public interest and recommends approval based on comments received at the public hearing
and the information in the staff report.
7. Public Hearings: Text Amendments to the Unified Development Ordinance
A. Unipole TC1400004
Staff Report: Mr. Stock presented the staff report.
Zoning Map Change Request RR & RS-20 – County Jurisdiction to RR - City Jurisdiction.
Public Hearing: Chair Harris opened the public hearing. Two people signed up to speak, two
people spoke and no one spoke in opposition. Chair Harris closed the public hearing.
Commission Discussion: Chair Harris read the report from the JCCPC meeting and stated the
guidelines of the Planning Commission Board. He stated it was the role of the commission to
encourage public participation. It was stated it was advertised and this is matter was critical to
Durham Technical Community College.
Motion: Approval of Unipole (TC1400004) (Padgett/Miller 2nd).
Action: Motion carried, 7-2 (Harris and Buzby voting No)
Findings: The Planning Commission finds that the ordinance request is consistent with the
adopted Comprehensive Plan. The Commission believes the request is reasonable and in the
public interest and recommends approval based on comments received at the public hearing
and the information in the staff report.
8. New Business
A. SASI Update was given by Ms. Jacobson. One page was missing which Ms. Jacobson would to
the commissioners.
B. Report from Chair: Chair Harris reported that four documents were sent out to everyone to
look over the guidelines of the Board.
C. Announcement –Durham CAN will be meeting, Tuesday, October 28, going over affordable
housing. Planning Commission members are invited. Chair Harris will send out the
information. It was stated we have one zoning case next month and one update on the Urban
Open Space Plan.
9. Adjournment
The meeting adjourned at 8:05 p.m. The next scheduled meeting is November 11, 2014, 5:30
p.m.
