Durham Planning Commission M I N U T E S February 10, 2015, 5:30 p.m. City Council Chambers – 1st Floor 101 City Hall 1. Call to Order Chair Harris called the meeting to order at 5:30 p.m. 2. Adjustments to the Agenda Move item 5C to beginning of the public hearings. MOTION: Approve requested agenda change. (Miller, Buzby, 2nd ) ACTION: Motion carried, 11-0 Mr. Harris not yet present. The public hearings were advertised as required by law. 4. Approval of the Minutes from January 12, 2015 Motion: Approval (Miller, Hyman 2nd). Highway 54 Residential (A1400005 & Z1400018) Plan Amendment Request: Hopper Communities is requesting 21.72 acres of the future land use designation be changed (from Office to Medium-High Density Residential) along the north side of NC Highway 54 at intersection with Revere Road. PINS: 0728-04-54-7507, -9591, -64- 2401, -6426. Zoning Map Change Request: 21.72 acres located at 1413-1501 NC 54 Highway, north side of NC 54 Highway between Barbee Road and Waterford Valley Drive and opposite Revere Road. Request: Residential Suburban - 20 (RS-20) – 15.02 acres, Office Institutional (OI) – 3.7 acres, and Office Institutional with a development plan (OI(D)) – 3.0 acres to Residential Suburban – Multifamily with a development plan (RS-M(D)) PINS: 0728-04-64-6426, -2401, -54-9591, -7507 Staff Report: Ms. Rosenberg and Ms. Wolff presented the staff reports. Public Hearing: Chair Harris opened the public hearing. One person spoke in favor. Chair Harris closed the public hearing. Commission Discussion: Discussion centered on transit access and affordability. Motion: To approve A1400005. (Mr. Miller, Mr. Padgett 2nd) Action: Motion carried, 12-0. Motion: Approve Z1400018. (Mr. Miller, Ms. Freeman 2nd) Action: Motion carried, 12-0. Findings: The Planning Commission finds that the ordinance request is not consistent with the adopted Comprehensive Plan. However, should the plan amendment be approved, the request would be consistent with the Comprehensive Plan. The Commission believes the request is reasonable and in the public interest and recommends approval based on comments received at the public hearing and the information in the staff report. B. Hamilton Center II (A1400006 & Z1400021) Plan Amendment Request: Horvath Associates is requesting 5.02 acres of the future land use designation be changed (from Office to Commercial) at 7010 NC Highway 751, in the southwest quadrant of intersection with NC Highway 54. PIN: 0718-01-18-1780 Zoning Map Change Request: 5.02 acres located at 7010 NC 751 Highway, in the southwest corner of the NC 751 Highway and NC 54 Highway intersection Request: Office Institutional (OI) to Commercial General with a development plan (CG(D)) PIN: 0718-01-18-1780 Staff Report: Ms. Rosenberg and Ms. Wolff presented the staff report. Public Hearing: Chair Harris opened the public hearing. Chair Harris closed the public hearing. Commission Discussion: Discussion centered on buffering. Motion: Approve A1400006. (Ms. Buzby, Mr. Miller) Action: Motion approved, 12-0. Motion: Approve Z1400021. (Mr. Buzby, Mr. Miller 2nd) Action: Motion carried, 12-0. However, should the plan amendment be approved, the request would be consistent with the Comprehensive Plan. The Commission believes the request is reasonable and in the public interest and recommends approval based on comments received at the public hearing and the information in the staff report. C. Guglhupf Parking Expansion (A1400007 & Z1400027) Plan Amendment Request: The applicant, Howard A. Partner R.L.A., is proposing a change to the Future Land Use Map (FLUM) from Medium Density Residential (6-12 Units/Acre) to Commercial of 0.4 acres generally located north of Durham-Chapel Hill Boulevard, east of Chapel Hill Road, west of James Street, south of Francis Street. PIN: 0810-08-99-9569 (in part). Zoning Map Change Request: .40 acres located at 2706 Durham Chapel Hill Boulevard, rear portion of lot fronting on Francis Street between Sarah Avenue and Lexington Street. Request: Residential Suburban – 8 (RS-8) to Commercial General with a development plan (CG(D)) PIN: 0810-08-99-9569 Staff Report: Ms. Rosenberg and Ms. Wolff presented the staff report. Public Hearing: Vice Chair Davis opened the public hearing. Commission Discussion: None MOTION: Continue to March meeting. (Mr. Miller, Ms. Huff 2nd) ACTION: Motion carried, 12-0. D. Magnolia Grill (A1400008 & Z1400024) Plan Amendment Request: Horvath Associates is requesting 0.165 acres of the future land use designation be changed (from Medium Density Residential to Commercial) on the east side of Ninth Street, between Englewood Avenue and West Knox Street. PIN: 0822-14-34-2042 Zoning Map Change Request: 0.482 acres located at 1000, 1002, and 1004 Ninth Street, in the northeast quadrant of Ninth Street and West Knox Street. Request: Commercial Neighborhood (CN), Residential Urban – 5(2) (RU-5(2)) to Commercial Neighborhood with a development plan (CN(D)) PINS: 0822-14-33-2932, -2937, -34-2042 Staff Report: Ms. Rosenberg and Ms. Wolff presented the staff report. Public Hearing: Chair Harris opened the public hearing. One citizen spoke in favor and one against. Chair Harris closed the public hearing. Commission Discussion: Discussion centered on the closing time of 10PM. Motion: Approve A1400008. (Mr. Miller, Mr. Buzby 2nd) Action: Motion carried, 12-0. Motion: Approve Z1400024 with a closing time of 10PM. (Mr. Miller, Mr. Buzby 2nd) Action: Motion carried, 12-0. Zoning Map Change Request: 6.23 acres located at 7520 NC 751 Highway at the northwest corner at the intersection of Interstate – 40 and opposite Southpoint Auto Park Boulevard Request: Commercial Neighborhood with a development plan (CN(D)) to Commercial General with a development plan (CG(D)) PINS: 0718-01-15-5265, -03-14-3464 Public Hearing: Chair Harris opened the public hearing. One person spoke in favor. Chair Harris closed the public hearing. Commission Discussion: Discussion centered for a buffer reduction. Motion: To approve. (Mr. Miller, Ms. Freeman 2nd ) Action: Motion carried, 12-0. Findings: The Planning Commission finds that the ordinance request is consistent with the adopted Comprehensive Plan. The Commission believes the request is reasonable and in the public interest and recommends approval based on comments received at the public hearing and the information in the staff report. B. Request: Office Institutional (OI) to Mixed Use with a development plan (MU(D)) PIN 0729-03-00-7100 Public Hearing: Chair Harris opened the public hearing. Chair Harris closed the public hearing. Commission Discussion: Discussion centered on the proffered bike improvements. Motion: To approve. (Mr. Buzby, Ms. Huff 2nd) Action: Motion carried, 12-0. Findings: The Planning Commission finds that the ordinance request is consistent with the adopted Comprehensive Plan. The Commission believes the request is reasonable and in the public interest and recommends approval based on comments received at the public hearing and the information in the staff report.
