Durham Planning Commission M I N U T E S July 14, 2015, 5:30 p.m. City Council Chambers – 1st Floor 101 City Hall 1. Call to Order Chair Harris called the meeting to order at 5:35 p.m. 2. Adjustments to the Agenda Chair Harris moved Item 6A, Resolution Presentation, to take place after the roll call. MOTION: Accept changes to the Agenda. (Mr. Whitley, Mr. Miller 2nd) ACTION: Motion carried, 11-1. 6A. New Business Chair Harris presented resolutions to Frederick Davis and Rickey D. Padgett acknowledging their service and time serve don Planning Commission. The resolutions read as follows: Planning Commission Minutes July 14, 2015 Page 1 of 4  RESOLUTION IN APPRECIATION OF MR. FREDERICK DAVIS WHEREAS: Mr. Frederick Davis was a member of the Durham Planning Commission from May 2009 through June 2015 and; WHEREAS: The Durham Planning Commission and the citizens of the City and County of Durham have benefited from the dedicated efforts that he displayed while serving as a member of the Durham Planning Commission, and; WHEREAS: This Commission desires to express its appreciation for the public of a job well done, now therefore; BE IT RESOLVED BY THE DURHAM PLANNING COMMISSION: Section 1: That this Commission does hereby express its sincere appreciation for the service rendered by Mr. Davis to the citizens of this community. Section 2: That the Clerk for the Commission is hereby directed to spread this resolution in its entirety upon the official minutes of this Commission and this resolution is hereby presented to Mr. Davis as a token of the high esteem held for him. Approval of the Minutes from June 9, 2015 Motion: Approval with Mr. Buzby’s correction to written comments (Mr. Buzby, Mr. Miller 2nd). Action: Carried, 11-0. 5. Public Hearings: Plan Amendment with Concurrent Zoning Map Change Request A. Cornwallis Road Property (A1400011 & Z1400040) Plan Amendment Change Request: From Commercial and Low Density Residential (LDR, 4DU/Ac.) to Medium Density Residential (MDR, 6-12 DU/ Ac.) Zoning Map Change Request: From Residential Surburban-20 (RS-20) (39.14 sc.), Commercial General (CG) (1.81 ac.) to Planned Development Residential 7.907 (PDR 7.907) Staff Report: Ms. Rosenberg presented A1400011 and Ms. Wolff presented Z1400040. Public Hearing: Chair Harris opened the public hearing. Three citizens spoke in support and seven in opposition. Chair Harris closed the public hearing. Commission Discussion: Discussion centered on traffic concerns, density, flooding, buffers and impervious surface along with the plan not being compatible. MOTION: Extend each side to 20 minutes of speaking time. (Mr. Miller, Ms. Hyman 2nd) ACTION: Carried, 11-0. MOTION: Extend each side 5 additional minutes. (Ms. Miller, Ms. Hyman 2nd) ACTION: Carried, 11-0. MOTION: To approve A1400011. (Mr. Miller, Mr. Whitley 2nd) ACTION: Failed, 1-10, with Ghosh voting yes. MOTION: To approve Z1400040. (Mr. Miller, Mr. Whitley 2nd) ACTION: Failed, 1-10, with Ghosh voting yes. FINDINGS: The Planning Commission finds that the ordinance request is not consistent with the adopted Comprehensive Plan. The Planning Commission believes the request is not reasonable nor in the public interest and recommends denial based on comments received at the public hearing, information in the staff report, problems with traffic congestion, inadequate transportation infrastructure, impacts on the environment and opposition from the community. 6B. Election of Vice Chair (County) Chair Harris noted that this appointment would be from now until September 2015, filling the remainder of the vacant term. MOTION: Appoint Ms. Huff. (Ms. Freeman.
