3. Approval of the Minutes from July 14, 2015
Motion: Approved. (Buzby, Miller 2nd)
Action: Motion carried, 12-0.
4. Adjustments to the Agenda
Mr. Young requested that cases for A150007, TC140006, Z1500018 be heard together but voted on
separately.

ACTION: Carried, 12-0, with Hyman and Freeman not yet present.
Mr. Young certified that all notifications were provided as required by law.
5. Public Hearing: Plan Amendments with Concurrent Zoning Map Change Requests
A. Garrett Ridge Multi Family Phases 3 (A1500006 and Z1500013)
Plan Amendment Request: From Medium Density Residential (6-12 DU/Ac.) to Medium-High
Density Residential (8-20) DU Ac.)
Zoning Map Change Request: From Residential Suburban – 20(RS-20) and Residential Suburban
– Multifamily with a development plan (RS-M(D)) to Residential Suburban – Multifamily with a
development plan (RS-M(D))
Staff Report: Laura Woods presented the Plan Amendment and Amy Wolff presented the
Zoning Map Change.
Public Hearing: Chair Harris opened the public hearing. One person spoke in support and no
one spoke in opposition. Chair Harris closed the public hearing.
Commission Discussion: Discussion centered on the history of the site and the number of
parcels.
MOTION: Recommend approval of A1500006. (Miller, Huff 2nd)
ACTION: Carried, 14-0.
MOTION: Recommend approval of Z1500013. (Miller, Huff 2nd)
ACTION: Carried, 14-0.
Findings: The Planning Commission finds that the ordinance request is not consistent with the
adopted Comprehensive Plan. However, should the plan amendment be approved, the request
would be consistent with the Comprehensive Plan. The Commission believes the request is
reasonable and in the public interest and recommends approval based on comments received at
the public hearing and the information in the staff report.
6. Public Hearings: Zoning Map Changes Requests
A. Southwest Durham Drive at 15-501 (Z1400030)
Staff Report: Amy Wolff presented the staff report.
Request: Residential Suburban – 20 (RS-20) to Commercial General with a development plan
(CG(D))
Public Hearing: Chair Harris opened the public hearing. Two individuals spoke in support. No
one spoke in opposition. Chair Harris closed the public hearing.
MOTION: To allow additional time for speakers to continue. (Miller, Whitley 2nd)
ACTION: Carried, 14-0.
Commission Discussion: Discussion centered on NCDOT review comments, funding, proposed
light rail (DOLRT) location and traffic concerns.

ACTION: Carried, 8-6. (Hollingsworth, Vann, Whitley, Harris, Miller and Freeman voting no).
Findings: The Planning Commission finds that the ordinance request is not consistent with the
adopted Comprehensive Plan. However, the Commission believes the request is reasonable and
in the public interest and recommends approval based on comments received at the public
hearing and the information in the staff report.
B. Hanover Pointe Sub Area A (Z1500011)
Staff Report: Amy Wolff presented the staff report.
Request: Planned Development Residential 4.760 (PDR 4.760) to Planned Development
Residential 6.038 (PDR 6.038)
Public Hearing: Chair Harris opened the public hearing. One individual spoke in support and
three individuals had questions. Chair Harris closed the public hearing.
Commission Discussion: Discussion centered on sidewalks and traffic calming measures.
MOTION: Recommend approval of Z1500011. (Miller, Buzby 2nd)
ACTION: Motion carried, 13-0. (Ghosh recused himself)
Findings: The Planning Commission finds that the ordinance request is consistent with the
adopted Comprehensive Plan. The Commission believes the request is reasonable and in the
public interest and recommends approval based on comments received at the public hearing
and the information in the staff report.
C. Davis Park West revisions (Z1500015)
Staff Report: Amy Wolff presented the staff report.
Request: From Commercial General with a Development Plan (CG(D)) to Commercial General
with a Development Plan (CG(D))
Public Hearing: Chair Harris opened the public hearing. No one spoke in support or opposition.
Chair Harris closed the public hearing.
Commission Discussion: Discussion centered on Design change and heights.
MOTION: Recommend Approval of Z1500015.
ACTION: Motion carried, 12-2. (Miller and Huff voting no)
Findings: The Planning Commission finds that the ordinance request is consistent with the
adopted Comprehensive Plan. The Commission believes the request is reasonable and in the
public interest and recommends approval based on comments received at the public hearing
and the information in the staff report.
7A. RTP Comp Plan Text Amendment (A1500007)
Staff Report: Michael Stock presented the staff reports for case A150007.
Request: This is a privately-initiated application submitted by the Research Triangle Foundation
to amend the text of the Durham Comprehensive Plan.
Discussion: The discussion centered on the new zoning district and impacts on RTP and Durham
as a whole.

Public Hearing: Chair Harris opened the public hearing on A1500007, TC1400006 and
Z1500018. Two persons spoke in support. No one spoke in opposition. Chair Harris closed the
public hearing.
MOTION: Forward to Council with a favorable recommendation. (Miller, Hollingsworth 2nd).
ACTION: Carried, 8-6. (Miller, Kenchen, Winders, Huff, Freeman and Riley coting no.
7B. SRP-C (TC1400006)
Staff Report: Michael Stock presented the staff report for case TC1400006.
Request: This is a privately-initiated application submitted by the Research Triangle Foundation
to amend the text of the Unified Development Ordinance for a new zoning district.
MOTION: To continue TC1400006 for 60 days. (Miller, Huff, 2nd).
ACTION: Failed, 5-9 (Hollingsworth, Vann, Whitley, Ghosh, Winders, Harris, Buzby, Gibbs, Hyman
voting no).
MOTION: Recommend approval of TC1400006. (Miller, Huff 2nd )
ACTION: Carried 8-6 (Kenchen, Huff, Winders Miller, Freeman, and Riley voting no)
Findings: The Planning Commission finds that the ordinance request is not consistent with the
adopted Comprehensive Plan. However, should the plan amendment be approved, the request
would be consistent with the Comprehensive Plan. The Commission believes the request is
reasonable and in the public interest and recommends approval based on comments received at

7C. Park Center (Z1500018)
Staff Report: Michael Stock presented the staff report for case Z1500018.
Request: Commercial Center (CG), Science Research Park (SRP) to Science Research Park-Center
(SRP-C)
MOTION: Recommend approval of Z1500018. (Miller, Gibbs 2nd)
ACTION: Carried, 8-6. (Kenchen, Winders, Huff, Miller, Freeman and Riley voting no)
Findings: The Planning Commission finds that the ordinance request is not consistent with the
adopted Comprehensive Plan. However, should the plan amendment be approved, the request
would be consistent with the Comprehensive Plan. The Commission believes the request is
reasonable and in the public interest and recommends approval based on comments received at
the public hearing and the information in the staff report
7D. Home Occupations (TC1500005)
Staff Report: Michael Stock presented the staff report for case TC1500005.
Request: This is a privately-initiated text amendment to Section 5.4, Accessory Uses and
Structures, of the Unified Development Ordinance (UDO) to modify where accessory structures

can be located on property zoned Residential Suburban-20 (RS-20), and to explicitly allow
accessory structures to be used for home occupations on property not zoned Rural Residential.
MOTION: Recommend Approval of TC1500005. (Miller, Buzby 2nd)
ACTION: Carried, 14-0.
Findings: The Planning Commission finds that the ordinance request is consistent with the
adopted Comprehensive Plan. The Commission believes the request is reasonable and in the
public interest and recommends approval based on comments received at the public hearing
and the information in the staff report.
9A. Compact Neighborhood planning Update - Hannah Jacobson gave an update to the
Commission.
9B. Recommended change to the September, 2015 PC meeting date.
MOTION: Move the September meeting to September 10, 2015. Those not able to attend will
have an excused absence.
ACTION: Carried, 13-1. (Hyman voting no)
10. Adjournment
The meeting adjourned at 9:35 p.m. The next scheduled meeting is September 10, 2015 at 5:30
p.m.
