Adjustments to the Agenda Mr. Young requested moving Item 7A to the first item. Chair Harris asked to add an item under New Business- Item 7B. MOTION: Accept the modified agenda. Chair Harris presented Charles Gibbs with a certificate of appreciation from the County Commissioners for serving on an advisory board. A. Approval of the Minutes from August 11, 2015 Motion: To approve. (Buzby, Winders 2nd) Action: Carried, 12-0. 5. Public Hearings: Plan Amendment without Concurrent Zoning Map Change Request B. Family Fare – Highway 55 (A1400012 & Z1400041) Plan Amendment Change Request: From Residential and Open Space to Commercial, located at PIN: 0738-01-18-9681 (partial). Zoning Map Change Request: From Office Institutional (OI) to Commercial General with a development plan (CG(D)) PIN: 0738-01-18-9681 (partial) Staff Reports: Ms. Rosenberg presented case A1400012 and Ms. Wolff presented case Z1400041. Public Hearing: Chair Harris opened the public hearing. One person spoke in support and one person spoke in opposition. Chair Harris closed the public hearing. Commission Discussion: The discussion centered on stormwater drainage and flooding. MOTION: Recommend approval of A1400012. (Miller, Whitley 2nd) ACTION: Carried, 9-3. (Buzby, Gibbs and Hollingsworth voting no) MOTION: Recommend approval of Z1400041 with two conditions 1) 35 foot maximum height, and 2) Expand the development plane to include entire site. (Miller, Freeman 2nd ) ACTION: Failed 5-7. (Buzby, Freeman, Ghosh, Kenchen, Whitley, Vann, Hollingsworth voting no). MOTION: To amend the Motion by deleting the conditions. (Whitley, Winders 2nd ) ACTION: Failed, 5-7. (Gibbs, Buzby, Freeman, Ghosh, Whitley, Vann, Hollingsworth voting no) MOTION: To reconsider and approve Z140041. (Miller, Ghosh 2nd) ACTION: Carried, 7-5. (Buzby, Freeman, Gibbs, Hollingsworth, Vann voting no.) FINDINGS: The Planning Commission finds that the ordinance request is not consistent with the adopted Comprehensive Plan. However, should the plan amendment be approved, the request would be consistent with the Comprehensive Plan. The Commission believes the request is reasonable and in the public interest and recommends approval based on comments received at the public hearing and the information in the staff report. Leesville/Andrews Residential (Z150001) Staff Report: Amy Wolff presented the staff report. Request: Residential Rural (RR) to Planned Development Residential 3.291 (PDR 3.291) PINs: 0769-02-55-0505, -3281, -04-64-4709, -1210, -3142, -1516, 5426 Public Hearing: Chair Harris opened the public hearing. One spoke is support and one spoke in position that was satisfied after discussion. Chair Harris closed the public hearing. Commission Discussion: The discussion centered on stormwater drainage and the two small wetlands present on site. MOTION: Recommend approval of Z1500041. (Buzby, Miller 2nd ) ACTION: Carried, 10-0. FINDINGS: The Planning Commission finds that the ordinance request is consistent with the adopted Comprehensive Plan. The Commission believes the request is reasonable and in the public interest and recommends approval based on comments received at the public hearing and the information in the staff report. B. TROSA Roxboro Outdoor Display (Z150004) Staff Report: Amy Wolff presented the staff report. Request: Commercial Center with a development plan (CC(D)) to Commercial Center with a development plan (CC(D)) PIN: 0833-13-12-8759 Public Hearing: Chair Harris opened the public hearing. One person spoke in support and no one spoke in opposition. Commission Discussion: No discussion. MOTION: Recommend approval of Z1500004. (Buzby, Miller 2nd) ACTION: Carried, 10-0. FINDINGS: The Planning Commission finds that the ordinance request is consistent with the adopted Comprehensive Plan. The Commission believes the request is reasonable and in the public interest and recommends approval based on comments received at the public hearing and the information in the staff report. 7.
