JOSHUA HOLLINGSWORTH WHEREAS: Mr. Joshua Hollingsworth was a member of the Durham Planning Commission from June 2014 through November 2015 and; WHEREAS: The Durham Planning Commission and the citizens of the City and County of Durham have benefited from the dedicated efforts that he displayed while serving as a member of the Durham Planning Commission, and; WHEREAS: This Commission desires to express its appreciation for the public of a job well done, now therefore; BE IT RESOLVED BY THE DURHAM PLANNING COMMISSION: Section 1: That this Commission does hereby express its sincere appreciation for the service rendered by Mr. Hollingsworth to the citizens of this community. Staff Reports: Mr. Taylor presented case Z1500020. Public Hearing: Chair Harris opened the public hearing. Four citizens spoke in support and Two citizens spoke against this project. Chair Harris closed the public hearing. Commission Discussion: The discussion centered on drainage, access and noise buffers. Planning Commission November 10, 2015 Page 2 of 9 MOTION: To recommend approval, provided that the Development Plan contain Committed Elements that include the chart diversity of housing opportunities (provided below), that the developers provide a committed element concerning noise mitigation along the property boundary with I-85, and that a committed element be added that includes shared common green space with access a significant share of housing units. Public Hearings: UDO Tech Changes A. Omnibus UDO Amendments (TC1500001) Staff Report: Mr. Whiteman presented TC1500001. Text amendment TC1500001: A text amendment consisting of technical revisions and minor policy changes to various sections of the Unified Development Ordinance (UDO), including Article 1, General; Article 2, Review Authority; Article 3, Applications and Permits; Article 4, Zoning Districts; Article 5, Use Regulations; Article 6, District Intensity Standards; Article 7, Design Standards; Article 8, Environmental Protection; Article 9, Landscaping and Buffering; Article 10, Parking and Loading; Article 11, Sign Standards; Article 12, Infrastructure and Public Improvements; Article 15, Enforcement; and Article 16, Definitions. Public Hearing: Chair Harris opened the public hearing. Staff spoke in support and no one spoke in opposition. Chair Harris closed the public hearing. Commission Discussion: The discussion centered on Historic Districts, Neighborhood Meetings and sidewalks. MOTION: To recommend approval of the Omnibus text amendment with the following recommended UDO text language regarding equity and affordability recommended at last month’s meeting be included (Winders, Riley 2nd) Add a Whereas to the beginning of the ordinance to amend. Whereas, the Durham Board of County Commissioners/Durham City Council has adopted the goal to preserve and increase the stock of affordable housing within a half-mile of each of the proposed Durham-Orange rail transit stations and the objective of achieving at least fifteen percent (15%) of housing units within one half-mile of each rail transit station and bus hub be affordable to families with income less than sixty percent (60%) of area median income Planning Commission November 10, 2015 Page 3 of 9 Add the following changes to the text of the UDO: The Compact Neighborhood Tier – That area near planned transit stations, within which development is intended to be transit‐, bicycle‐ and pedestrian‐oriented to enhance the street level experience and provide a mixture of goods and services to be available and useful to residents and visitors of all ages, ethnicities, gender orientations and income levels. Auto‐oriented and low intensity uses shall be discouraged, and affordable housing opportunities are to be encouraged. (UDO 4.1.2.A.4) The Downtown Tier – That area covered by the Downtown Master Plan within which development is intended to be transit‐ and pedestrian‐oriented in order to enhance the street level experience and provide a mixture of goods and services near transit services to be available and useful to residents and visitors of all ages, ethnicities, gender orientations and income levels. Auto-oriented and low intensity uses are discouraged, and affordable housing opportunities are encouraged (UDO 4.1.2.A.5), refining slightly language originating in the Comprehensive Plan. Residential Compact (RC) The RC District is established to promote well‐integrated new residential and civic development close to designated and future regional transit stations. The district is intended to ensure that new development takes advantage of compatible, higher density, transit friendly design opportunities in close proximity to transit systems and that people of all demographic and economic groups will be able enjoy the benefits of the available amenities and convenience. New development in this district requires both pedestrian orientation and human scale in architecture at the street level. The RC District is used to implement the Comprehensive Plan within those areas shown as the Compact Neighborhood tier and the Suburban Transit Areas (as designated in the Comprehensive Plan) within the Suburban Tier.(UDO 4.2.4) Downtown Design (DD) The Downtown Design (DD) District is established to encourage intense development and pedestrian activity through regulations appropriate to the downtown area. It focuses on the form of the private and public realm instead of on use and intensity. The standards encourage a vital downtown economy that enhances Durham's position as a commercial, cultural and entertainment hub of the region while increasing livability and preserving equity and socio- economic diversity. The DD district is intended to work in tandem with the Downtown Durham Master Plan and updates. Downtown Design District Core, Support 1, and Support 2 are the only districts allowed in the Downtown Tier. Therefore the Downtown Tier boundary and the Downtown District boundary are the same. (UDO 4.5.1) Compact Design (CD) The Compact Design (CD) District is intended to encourage development of appropriate urban intensity and pedestrian activity by focusing on the form of development and how it shapes the streetscape. The CD District includes the dense core surrounding the future transit station area as well as adjacent areas that provide a transition from the dense core to less intense, surrounding areas. The goal is to achieve at least fifteen percent affordable housing units within one-half mile of each transit station and bus hub. (UDO 4.5. 2) ACTION: Carried, 10-1, Miller voting no. Impacts all properties within designated local historic districts and local historic landmarks. The City and County, through the Planning Department’s work program, initiated a consolidation of and update to the criteria used by the Historic Preservation Commission (HPC) to review proposed changes to locally-designated historic properties. The Planning Commission will consider seven action items as part of this project. One consideration is regarding the Consolidated Local Review Criteria document itself. The remaining six considerations are required to make recommendations on the Preservation Plans for each of the Local Historic Districts that have been updated to reference the new review criteria. Public Hearing: Chair Harris opened the public hearing. Chair Harris allowed one discussion for all items and separted motions for each item. Staff and one citized support. No one spoke in opposition. Chair Harris closed the public hearing. Commission Discussion: Concerns were raised about the broad language used in three specific instances within the Consolidated Review Criteria document. Concern was raised about reassessing the contributing and non-contributing nature of properties at a five year interval – it was suggested that a longer interval be used – perhaps 10 years. Clarification was requested on how the demolition and relocation standards apply to properties. There was some discussion regarding how the people associated with Durham’s past are taken into consideration and documented with local designations (either districts or landmarks) why the program focuses primarily on historic structures and how the Preservation Durham plaque program works with Durham’s historic preservation program. Some issues surrounding the designation of state- owned properties within local historic districts were also discussed. Brief discussion was had as to how this information will be made to the public and property owners once adopted. MOTION: To send forward to the Council and the BOCC with a favorable recommendation, with a condition that the language is clarified on page 36 and 47 and 61 be clarified. Cleveland Stret and Holloway Street Preseration Plan Update MOTION: To send the Cleveland Street and Holloway Street Preservation Plan update to the City Council with a favorable recommendation on the condition that the language contained in the modified local review criteria be fixed to resolve the ambiguous language identified on pages 36, 47 and 61. (Miller, Buzby, 2nd) ACTION: Carried, 9-2, Miller and Riley voting no. Downtown Durham Preservation Plan Update MOTION: To send the Downtown Durham Preservation Plan update to the City Council with a favorable recommendation on the condition that the language contained in the modified local review criteria be fixed to resolve the ambiguous language identified on pages 36, 47 and 61. (Miller, Riley 2nd) ACTION: Carried, 9-2, Miller and Riley voting no. FINDINGS: The Planning Commission finds that the ordinance request is consistent with the adopted Comprehensive Plan. The Commission believes the request is reasonable and in the public interest and recommends approval based on comments received at the public hearing and the information in the staff report. D. Fayetteville Street Preservation Plan Update MOTION: To send the Fayetteville Street Preservation Plan update to the City Council with a favorable recommendation on the condition that the language contained in the modified local review criteria be fixed to resolve the ambiguous language identified on pages 36, 47 and 61. (Miller, Whitley 2nd) ACTION: Carried, 9-2, Miller and Riley voting no. FINDINGS: The Planning Commission finds that the ordinance request is consistent with the adopted Comprehensive Plan. The Commission believes the request is reasonable and in the public interest and recommends approval based on comments received at the public hearing and the information in the staff report. E. Morehead Hill Preservation Plan Update MOTION: To send the Morehead Hill Preservation Plan update to the City Council with a favorable recommendation on the condition that the language contained in the modified local review criteria be fixed to resolve the ambiguous language identified on pages 36, 47 and 61. (Miller, Hyman 2nd) ACTION: Carried, 9-2, Miller and Riley voting no. FINDINGS: The Planning Commission finds that the ordinance request is consistent with the adopted Comprehensive Plan. (Miller, Hyman 2nd) ACTION: Carried, 9-2, Miller and Riley voting no.
