COMMITTEE OF THE WHOLE MINUTES
April 10, 2014 – 5:30 p.m.

Mayor Pro Tem Walker called the meeting order at 5:35 p.m.
Council present: Dianne Brudnicki, Leroy Collinwood, Scott Thomas, Becky Nixon,
Gary Gill, Amy Ockerlander, Jason Walker
Staff present: Steve Leniszewski, Jill Long, Lara Thomas, Jodi Wycoff
Development Update – S. Leniszewski
Public Works Director, Steve Leniszewski, reviewed a PowerPoint presentation regarding
current and pending development, both public and private within the city limits. He gave a brief
overview of each project and where it is in the development process. Steve then reviewed two
spreadsheets regarding the costs and funding sources for the planned public projects. One
spreadsheet showed the costs of project funding through 2014 and how the ending fund balance
if affected. The other showed the costs for project funding through 2015 if they receive all of the
grant funding they are requesting. Steve explained that staff is always looking and applying for
grant funding for public projects. Lastly, Steve announced that Earth Day will be celebrated on
April 26th with an event at Depot and McCormick Parks.
(AB14-27) Civil Service Ordinance – Mayor Ibershof
Mayor Ibershof explained that the current code calls for the Civil Service to appoint the Chief of
Police. This ordinance would change that so that the Mayor appoints the Chief with the
Council’s confirmation.
(AB14-29) Police Chief Job Description & Salary Scale Ordinance – Mayor Ibershof
Mayor Ibershof said that they have reviewed the job description for Police Chief and removed
items pertaining to administrative duties outside of the Police Department. He handed out a pay
scale comparison for Police Chiefs in the area.
(AB14-30) Ordinance amending DMC Chapter 4 – Personnel - J. Long
Finance Director Jill Long explained that this is a “housecleaning” ordinance to clarify items in
the medical coverage and vacation sections of the Personnel code. It adds wording for non-
represented commissioned police officers including the Police Chief.
(AB14-31) CDBG Grant – ADA Ramp Installation – S. Leniszewski
Steve Leniszewski, Public Works Director, explained that this is a grant to continue with the
ADA Ramp Installation Project. He reviewed a map of the ramps to be retrofitted. He said that
they currently have a $60,000 grant that they will be working against to start retrofitting curbs to
be ADA compliant but those funds will likely only pay for four ramps. Steve explained that the

design is already complete for all of the ramps on the project list and staff would like to apply for
$200,000 in the upcoming grant round with a $25,000 match which could include staff time.
Comprehensive Emergency Management Plan Update - Public Works
Shaun Tozer, Project Manager, reviewed a PowerPoint presentation about the Comprehensive
Emergency Management Plan (CEMP) update. He explained that the State of Washington
requires cities to prepare and maintain a CEMP and the last formally updated plan was done in
May 2004. The draft plan has to be submitted to the Department of Military by the end of April.
He said there are no major process changes, but a lot of text changes. Shaun said that King
County is currently updating their Regional Hazard Mitigation Plan which is great timing for
Duvall doing their CEMP Update. He reviewed Duvall’s Hazard Risk Ranking which showed
Duvall at most risk or highest impact from earthquakes, floods, and dam failure. Shaun then
reviewed the work plan which includes finishing the draft CEMP update, creating standard
operating procedures, continue to work with other agencies such as Fire and Police, and continue
education and training for staff and elected officials. He would also like the City to participate in
more tabletop exercises that relate to potential emergencies that could affect Duvall.
Development Agreement Code Updates – L. Thomas
Planning Manager, Lara Thomas, said that based on direction from the city attorney, staff is
proposing to remove development agreements from Chapter 14.08 (permit process) in its
entirety. She said that a development agreement is a contract, not a permit. Staff is proposing a
new section of the Duvall Municipal Code called Development Agreements. The code does have
some standards but also allows for some flexibility outside of a standard agreement if warranted.
One example would be vesting a project because circumstances change over time. Lara said they
would need to decide what the term limit would be and what they would vest to such as zoning
or storm water. A draft of the new code was included in the packet and has been reviewed by the
Planning Commission, Land Use Committee, and city attorney.
Good of the Order - Council
Mayor Pro Tem Walker asked Project Manager Shaun Tozer to give a report on his recent trip to
the mudslide disaster in Oso. Shaun said that as a certified Public Information Officer, he was
deployed to the mudslide site this past weekend. He was there Friday through Sunday on both
sides of the slide. He showed PowerPoint slides of the disaster area and the areas that he worked
in while there. He worked mostly on the Darrington side in their Information Center and was in
direct contact with people affected by the slide. Shaun said that a few of the things he learned
from the experience is that we need to continue our training, we need to plan and practice
standard operating procedures, we need to plan for volunteers, and technology is key for
emergency management and response.
