CITY OF DUVALL CITY COUNCIL COMMITTEE OF THE WHOLE MINUTES November 25, 2014 – 5:30 p.m. Duvall Visitor Center – 15619 Main Street NE Mayor Pro Tem Walker called the meeting order at 5:34 p.m. Council present: Dianne Brudnicki, Scott Thomas, Jason Walker, Gary Gill, Amy Ockerlander, Becky Nixon, Leroy Collinwood Staff present: Steve Leniszewski, Jodi Lee Wycoff, Lara Thomas, Jill Long Development Agreement Vesting of Policies and Fees for Duvall Village Lara Thomas, Planning Manager, said that the Land Use Committee had a meeting recently to discuss an approach to development agreements and vesting. She asked Councilmember Scott Thomas to lead this discussion. Councilmember Thomas reviewed a vesting matrix for the Duvall Village development. He also reviewed a list of results from a discussion regarding significant benefits of vesting the Duvall Village project and a staff memo from Public Works regarding the vesting options and impacts of vesting a project. Councilmember Thomas went over what the developer is asking for and asked Council to direct staff on the direction they want to go so they can write the final draft of the development agreement with Duvall Village. There are options of 5 years vesting or 10 years vesting. Council discussed the options and whether to allow different timelines for commercial versus residential. For policy vesting, there was Council consensus to allow 10 years vesting for the commercial portion of the development agreement with Duvall Village. Next, Council discussed the vesting of fees. Councilmember Thomas explained that the Land Use Committee feels there is a lot of public benefit to vesting fees for Duvall Village. They looked at options for 5 year or 10 year vesting and whether to vest at the 2014 fee rate or 2015 fee rate. Council expressed their concerns that this will set a precedent but feels that this is a rare situation and agreed that each development agreement that comes before Council in the future would be looked at separately. They asked staff to keep a file or log whenever vesting is offered and include a history of the process and why it was allowed. Councilmember Thomas said that the Land Use Committee is comfortable with vesting for 5 years at the 2015 fee rate. Council discussed the options and there was consensus to allow 5 year vesting on residential and 10 year vesting on the commercial; both at the 2015 rates. Committee of the Whole – November 25, 2014 General Policy Discussion Mayor Pro Tem Walker asked Council for suggestions on policies they would like to see worked on. The following is a list of policies discussed: Out of Class Pay Policy; FMLA Policy; Council Procedures; Personnel Policy (include more details for grievances, etc.); Formal Re-Class Process; Social Media Policy; City-owned Alley Policy. Council also would like to see the Nuisance Code updated and an ordinance regarding abandoned buildings. Council also would like to look at having a full wage equity study done and look at the step increases. Council’s top two priorities out of the policies listed above are the Out of Class Pay Policy and the FMLA Policy. Executive Session: 30 minutes – Labor Negotiations RCW 42.30.140(4)(a) 6:30 p.m. The Council Chambers were cleared for a 30-minute Executive Session regarding Labor Negotiations. 7:00 p.m. The Regular Committee of the Whole Meeting Resumed Written Reports – There were no written reports in the COW packet for 11/25/14.
