CITY OF DUVALL CITY COUNCIL COMMITTEE OF THE WHOLE MINUTES July 21, 2015 – 5:30 p.m. Riverview Educational Service Center – 15510 – 1st Ave NE Mayor Pro Tem Brudnicki called the meeting order at 5:31 p.m. Council present: Jason Walker, Becky Nixon, Amy Ockerlander, Scott Thomas, Dianne Brudnicki, Gary Gill (absent: Leroy Collinwood) Staff present: Matt Morton, Police Chief Carey Hert, Jodi Wycoff, Dean Rohla, Fire Chief David Burke a. Update on Discussion regarding Fireworks Regulations Police Chief Carey Hert said that there was a Public Safety Committee meeting this week at which they reviewed three different ordinances on fireworks. The ordinances were from City of Leavenworth, City of Snoqualmie and Douglas County. Douglas County and City of Leavenworth have provisions for emergency bans, whereas, City of Snoqualmie just recently passed an ordinance only allowing trick and novelty fireworks. Fire Chief David Burke handed out the State codes showing the definitions of “trick and novelty devices” and “consumer fireworks” as well as a handout showing what types of fireworks are considered legal and illegal in Washington State. Councilmember Ockerlander, Chair of the Public Safety Committee, said that the Committee also reviewed a staff report which included five options regarding fireworks. The options were: 1. Leave the Ordinance as is; 2. Modify the Ordinance to provide for an emergency ban as necessary; 3. Ban the sale and discharge of fireworks all-together; 4. Follow suit with City of Snoqualmie, allowing trick and novelty devices only; and 5. Put the decision up to the voters. The Committee prioritized their top three choices which were options 2, 4, and 5. Councilmember Ockerlander said that the Committee is looking for direction on how Council would like to move forward. Council discussed the options and who could be the implementing authority if an emergency ban were needed. Fire Chief David Burke said that in the current Interlocal Agreement between the City and the Fire District, the City retained authority and the District serves as an advisor with the Council being the decision making authority. Chief Burke said he would be comfortable being the authority on emergency fireworks ban if the ordinance was clear on what conditions would need to be met in order to call for an emergency ban. Council discussed the options for an emergency ban, who would be the implementing authority for that ban, as well as the education and enforcement that would need to take place if a ban were ever implemented. There was Council consensus to move forward with researching and drafting an ordinance allowing for an emergency ban based on specific criteria and naming the Fire Chief as the implementing authority for such ban. Committee of the Whole – July 7, 2015 b. Review Council Procedure processes Mayor Ibershof said that the July 7th meeting was the first meeting under the new Council Procedures and he wanted to get Council’s feedback and clarification on a few processes within the procedures. Mayor and Council discussed the “no surprise rule” section of the procedures as well as the flow of Council business with regards to the use of Committees versus Committee of the Whole. c. Good of the Order Councilmember Becky Nixon said she would like to see verbiage about no fireworks on public property be added to the fireworks ordinance. Councilmember Nixon also said that she would like the City to look at doing something with the Class A water from the sewer system as well as research what it would take to get the artisan well back in operation. Councilmember Nixon also reported that she attended Sandblast which was a great event. Lastly, Councilmember Nixon thanked the City for putting up life saving devices at the beach and asked if the sign for the dog water fountain can be put back up. Councilmember Jason Walker reported on the Watershed Forum Tour that took place recently and handed out a data sheet about local river and creek flow and temperatures as well as a document listing frequently asked questions about water conservation that City of North Bend recently sent to its citizens. Councilmember Walker said Duvall should consider sending something similar to our residents. Councilmember Scott Thomas asked about the possibility of getting purple pipe for reclaimed water during the Main Street project. Councilmember Thomas also expressed his concerns about the detour route during the road closure that will take place soon for the culvert replacement project on SR203. Matt Morton, City Administrator, said that there are some investments coming due and asked for Council direction on what they would like to do with the monies – reinvest or keep them liquid. Dean Rohla, Finance Director, answered questions from Council about the specifics. The monies were originally invested for a three year investment but some of the funds were called early. Council said they would like more information about the Main Street funding before they make a decision if they want these monies to be reinvested or not. Mayor Ibershof reported that as a part of the IT upgrade for the City, all Department Heads are also getting Microsoft Surfaces and they will get them early in order to work out any bugs before Council gets their devices. Staff has a goal to go to paperless packets by the end of the year. Mayor Ibershof asked if any Councilmembers wanted to get on stage with him tomorrow night at SummerStage to introduce Austin Jenckes and encouraged everyone to attend the concert tomorrow. Lastly, Mayor Ibershof said that sponsorships for SummerStage are increasing.
