CITY OF DUVALL CITY COUNCIL COMMITTEE OF THE WHOLE MINUTES June 7, 2016 – 5:30 p.m. Riverview Educational Service Center – 15510 – 1st Ave NE Mayor Pro Tem Brudnicki called the meeting to order at 5:31 p.m. Council present: Becky Nixon, Gary Gill, Jason Walker, Dianne Brudnicki, Leroy Collinwood, Scott Thomas (absent: Amy Ockerlander) Staff present: Matthew Morton, Boyd Benson, Chief Carey Hert, Dean Rohla, Lara Thomas, Troy Davis, Jodi Wycoff a. Public Defense Contract & Ordinance Matthew Morton, City Administrator, gave a history of Supreme Court decisions and rules directing cities to provide indigent public defense including a case in 2011 which resulted in a new benchmark amount for the new per-case cost. Mr. Morton explained that the current amount the City pays per case is $145 and the new benchmark is $300 per case. Mr. Morton negotiated with our current public defender to tier the cost increase over a three-year period. Mr. Morton also explained that current Duvall Municipal Code does not address public defense and that it needs to. The ordinance and new code chapter that is being proposed will address that issue. b. Police Department Report Carey Hert, Police Chief, handed out and reviewed a report detailing work that has been done since his return in March. Chief Hert explained that he was given priorities to address upon his return and reviewed each priority, what work was done on it and the current status. Chief Hert also reviewed statistics for the past two months and the community outreach that the Department has been doing recently. Lastly, Chief Hert answered questions from Council. c. Draft Ordinance – Impact Fees Troy Davis, Senior Planner, gave a presentation explaining the history and the need for this new piece of legislation. Mr. Davis explained that the State has mandated, via ESB 5923, that local jurisdictions provide developers with at least one of three options with regards to when impact fees are paid. The three options are: at time of final inspection, time of Certificate of Occupancy, and time of closing. Mr. Davis said that the mandate states that jurisdictions must offer one of the options for no less than the first 20 applications a developer submits in each calendar year. Mr. Davis said that jurisdictions must go with the option that the local school district prefers or submit an explanation to the District on justifying why they are deviating from the district’s choice. Mr. Davis reviewed where they are in the process for this ordinance and explained that this item will be brought back for the Public Hearing and action after Department of Commerce review. Mr. Davis explained that this item must be adopted by September 1st. Mr. Davis, Lara Thomas, Planning Director, and Boyd Benson, Interim Public Works Director then answered questions from Council. Staff requested Council direction on which of the three options they would like to offer. There was general Council consensus to offer the option of at time of final inspection and for a maximum of 20 applications consistent with the School District’s request. Committee of the Whole 06-07-16 d. Draft Ordinance – Food Trucks Troy Davis, Senior Planner, gave a presentation explaining that Duvall Municipal Code does not currently address Mobile Food Units (Food Trucks) and the City currently only allows them when associated with a special community event. Mr. Davis reviewed what is and what is not considered a Mobile Food Unit. Mr. Davis also reviewed some of the details within the ordinance and explained that Department of Commerce is currently reviewing this item. The Public Hearings and action can occur after their review and will likely happen in July and August. Mr. Davis then answered questions from Council. e. Good of the Order There were no items for Good of the Order.
