Minutes for the Meeting of the City of Dyersburg Municipal-Regional Planning Commission January 10, 2019 10:00 am Municipal Courtroom Commission Members Present: Eddie Burks, Mayor John Holden, Mark Oakes, Sherry Guthrie, Tony Dement, and Brian Ramm. Paul Newbill was absent. Other Staff Others Present: Thomas Mullins, Kevin Joslin, Codes Enforcement, Scott Ball, Storm Water and Construction Inspector, Will Radford, City Planner, Tiffany Heard, City Engineer, Carmen Cupples. IT. Chairman Burks called the meeting to order and declared that a quorum was present. Chairman Burks noted that this meeting was the first meeting for 2019 and the Commission must reelect officers to the Commission. Chairman Burks recused himself from chairmanship while differing to Mayor Holden to proceed with Commission officer’s election. Mayor Holden welcomed new Aldermen Vanedda Webb, Edward Burks, and Ricky Hammond to the meeting. He also acknowledged and congratulated the reappointment of Commissioners Eddie Burks, Paul Newbill, and Sherry Guthrie to a new three-year appointment on the Commission. Mayor Holden recommended the Commissioners reelect the officers from 2018 for the 2019 period. Included were Eddie Burks as Chairman, Paul Newbill as Vice Chairman, Tony Dement as Secretary, and Sherry Guthrie as Assistant Secretary. Commissioner Brian Ramm seconded the recommendation and the officers were unanimously reelected for 2019. Chairman Burks returned to the Chairman’s seat and the meeting resumed with a motion to approve the minutes from the December 13, 2018 meeting. Commissioner Tony Dement motioned to approve the minutes. The motion was seconded by Commissioner Brian Ramm and approved by the Commission. Old Business: Chairman Burks called for any old business. None was presented. New Business: A. Shock Hill Lodge Alley Closure Request Background A request was submitted to close an un-used alley-way off of Troy Avenue near its intersection with W. Tickle Street. Ordinance #BB665 requires that the Planning Commission “determine the current or future usefulness to the City of the alley or unopened right of way”. Analysis Staff stated that this alley has not been developed and is not be used for access. Staff opined that the City does not need the right of way today nor in the future and support’s the applicant’s request to close the alley. Staff noted this action is the first step in the process for final approval by the Board of Mayor and Aldermen. Recommendation Staff recommended the Planning Commission to recommend the abandonment of the ally to the Board of Mayor and Aldermen. Chairman Burks called for a motion to approve the staff recommendation. Commissioner Brian Ramm motioned for approval of the recommendation for the abandonment of the ally to the Board of Mayor and Aldermen. Commissioner Sherry Guthrie seconded the motion. The motion was approved by the Commission. B. Text Amendment – Amending Indoor Shooting Range Regulations. Background/Analysis The Planning Commission recently recommended the approval of an Ordinance to adopt regulations for indoor shooting ranges. This Ordinance was adopted and approved by the Dyersburg Board of Mayor and Aldermen. Last week, the BZA reviewed a request that claimed the below provision was impossible to be complied with for an indoor shooting range. The BZA agreed that “no noise from firearms shall be audible” is unenforceable and that “no noise” is unpreventable for a shooting range. “5. All facilities shall comply with the Anti-Noise Regulations found in the City of Dyersburg Municipal Ordinance Number 11-302, and specifically no noise from firearms shall be audible at the property lines during business hours.” The BZA agreed that a noise controlling measure is necessary. Staff is proposed the following new language to replace #5 above: “5. All facilities shall comply with the Anti-Noise Regulations found in the City of Dyersburg Municipal Ordinance Number 11-302, and specifically no noise louder than 90 decibels from firearms shall be audible at the property lines during business hours.” Recommendation Staff recommended the Planning Commission send a positive recommendation on the text amendment to the Board of Mayor and Aldermen. Chairman Burks called for a motion to approve the staff recommendation. Commissioner Mark Oakes motioned for approval of the recommendation to send a positive recommendation on the text amendment to the Board of Mayor and Aldermen. Mayor Holden seconded the motion. The motion was approved by the Commission. C. Any other new business that may be accepted by the Planning Commission. None presented. D. Other Business/Reports: Will Radford brought to attention that the commissioners should complete their statement-of-interest forms prior to January 31 2019 for the state. E.
