Minutes Village of East Troy Plan Commission & Architectural Review Board July 11, 2016 1. Call to order – President Timms called the meeting to order at 6:30 pm 2. Verification of open meeting notice - Administrator Suhm verified the meeting had been posted according to open meetings laws. 3. Roll call Present: President Timms, Trustee Seager, Commissioners Edward Arendt, John Grudnowski, Linda Kaplan, Anna Mack, Kirk Nelson Excused: Others: Zoning Administrator Tim Schwecke and Administrator Suhm 4. Approve Plan Commission minutes of June 13, 2016 Motion by Trustee Seager, second by Commissioner Arendt to approve the minutes dated June 13, 2016. Motion carried. 5. Approve Plan Commission minutes of June 20, 2016 (special meeting) Motion by Trustee Seager, second by Commissioner Arendt to approve the minutes dated June 20, 2016. Motion carried. 6. Citizen participation No Comments. President Timms took item 13 out of order. 13. New wall sign for building located at 2886 Main Street; Justin Rohrer, applicant, (application 2016-28) A. Possible decision by the Plan Commission Motion by Commissioner Arendt, second by Commissioner Kaplan to approve the sign based on the four above criteria listed in the staff report dated July 6, 2016, provided sign does not exceed 20 square feet. Commissioner Nelson questioned if the color needed to be approved. Zoning Administrator Schwecke explained color is a factor and the background is neutral. Based on track record of the applicant he stated he cannot imagine they would select an inappropriate color for the font. Vote on the motion carried. Rezone property located at 2019 Beulah Avenue (RA454000001) from Light Industrial (LI) to Multi-Family Residential (MR-10); ABCS Investments LLC, applicant (application 2016-22) A. Public hearing President Timms opened the public hearing at 6:37 p.m. and asked if there was anybody to speak in favor of the item. There were no responses. He then asked if there was anybody opposed:  Rodney Baerbock, 3034 Chafin, stated he never thought the zoning would change. He also stated he did not understand why a property would be changed from zoning it is surrounded by, which is light industrial, to multifamily zoning. He stated he was concerned the change will impact the value of nearby single family residential properties. He and his wife are opposed.  Terry Bemis 3008 Chafin Avenue, stated he is opposed for the same reasons previously discussed. He purchased a home in the area about three years ago and was not planning for this type of change.  Elizabeth Scot, 2096 Townline Road, questioned if they know how many buildings they want to build and how many units would be within the building. President Timms responded this would be addressed after public comments were received.  Barb Olson, 3028 Chafin, stated she usually would not look at a house if there is an apartment building nearby. She stated she is adamantly opposed to having an apartment building so close to their backyard.  Rachel Fox, 2029 Beulah Avenue, stated she is agreement with others who spoke. She stated she would be opposed to having multifamily housing so close to her home.  Garret Luppino, 3017 Chafin Avenue, stated he moved to East Troy a year and a half ago with his wife from Chicago. He was concerned adding apartments could add a lot of traffic. He stated there are a lot of young kids on that street so having it quiet and not having multifamily homes is nice.  Eric Anderson, 2029 Beulah Avenue, stated he moved to East Troy recently from Racine due to peacefulness and it being a quiet area. He stated he is also against rezoning.  Ron Nacker, 3002 Chafin Avenue, stated the property is just about in his backyard. He is concerned about kids trespassing from his property to go around and get to the apartments. Zoning Administrator Schwecke reviewed his staff report dated June 20, 2016. He stated the Village’s comprehensive plan is the controlling factor in the Plan Commission’s decision. If a property owner moves forward and requests a rezone that is consistent with the comprehensive plan the Plan Commission is obligated to approve it. He pointed out the draft ordinance is to rezone with conditions. The conditions were Plan Commission Minutes July 11, 2016 Page 3 of 5 listed on the second page of the ordinance under section two. They included the property owner submitting a development plan for the property as allowed in the MR-1- district and obtaining approval, the storage buildings currently on the subject property shall be removed consistent with a timeframe established by the Village Board’s approval of a development plan and the property owner is allowed to use the current buildings for storage, without expansion in the interim and no other buildings may be constructed on the subject property and no other area may be used for outside storage of any nature. Zoning Administrator Schwecke also explained the property owner has four years to comply with conditions. If conditions are not met or if he asks to revert back to industrial zoning the ordinance is null and void. He further explained the property owner’s intent is to look for development options for property. The current consideration is a nursing home or assisted living. President Timms stated the Village does not have the ability to deny the request for rezoning. He reminded the audience the approval for rezoning does not necessarily mean something is going in. He also stated any development plans would require approval by the Village. To clarify an audience member’s question, Zoning Administrator Schwecke stated multifamily is allowed with the zoning but the property owner would still need to go through the site plan approval process so the Village would still approve the layout, placement of buildings, etc. President Timms closed the public hearing at 6:53 p.m. B. Possible recommendation by the Plan Commission to the Village Board Motion by Commissioner Arendt, second by Commissioner Mack to recommend to the Village Board the conditional rezoning of the subject property as set forth in the ordinance dated June 20, 2016. Motion carried 6-1 with Commissioner Grudnowski voting no. 8. Establish zoning classification for a property annexed into the Village of East Troy (Town of East Troy Parcel: PA287200001); Jeff McKone and Vicki McKone, applicant (application 2016-26) A. Public hearing Zoning Administrator Schwecke reviewed his staff report dated July 6, 2016. He explained this is a property recently annexed into the Village. As part of the annexation there was a temporary zoning assigned to it. The permanent zoning proposed is the same as the temporary zoning, highway business. He reviewed the draft ordinance dated July 5, 2016. President Timms closed the public hearing at 6:57 p.m. B. Possible recommendation by the Plan Commission to the Village Board Motion by Trustee Seager, second by Commissioner Kaplan to approve the ordinance as set forth dated July 5, 2016. Motion carried. Plan Commission Minutes July 11, 2016 Page 4 of 5 9. Amendment of the Village's zoning code relating to the signage regulations (application 2016-23) A. Public hearing Zoning Administrator Schwecke reviewed his staff report dated June 20, 2016. President Timms closed the public hearing at 6:58 p.m. B. Possible recommendation by the Plan Commission to the Village Board Motion by Commissioner Nelson, second by Commissioner Arendt to recommend to the Village Board approval of the proposed ordinance based on the findings contained in the proposed ordinance. Motion carried. 10. Amendment of the Village's zoning code relating to the Institutional Residential land use category (application 2016-24) A. Public hearing Zoning Administrator Schwecke reviewed the draft ordinance. He pointed out they redefined the institutional residential category into two types, 1-12 residents and 13 and more. The zoning districts where this land use could occur were also identified. B. Possible recommendation by the Plan Commission to the Village Board Motion by Commissioner Kaplan, second by Commissioner Mack to recommend to the Village Board approval the proposed ordinance based on the findings contained in the proposed ordinance. Motion carried. 11. Conditional use application to establish an Institutional Residential use at 1995 Beulah Avenue (St. Peter's property), which is located in the Suburban Residential (SR-4) zoning district; Gerard's Embrace, Inc. as operator, applicant (application 2016-27) A. Public hearing Suzanne Kasper, N8809 Hwy N in Troy Center, stated she was present with another officer of the Board of Gerard’s Embrace. The purpose is to help unwed mothers and their children have a future. In addition, she stated this will help renovate and put the vacant home to use. Zoning Administrator Schwecke reviewed his staff report dated July 7, 2016. He reminded the Commission the approval is predicated on the Village Board approving the text amendment ordinance. He reviewed the six criteria from his staff report that the Commission needs to consider. Zoning Administrator Schwecke also read into the record a public comment submitted by Ted Zess stating he fully supported this item, it is a great use of the property and a great thing for the church to be doing. Suzanne Kasper acknowledged she had read the conditional use order and was in agreement with no questions. Plan Commission Minutes July 11, 2016 Page 5 of 5 B. Possible recommendation by the Plan Commission to the Village Board Motion by Trustee Seager, second by Commissioner Kaplan to recommend to the Village Board approval of the conditional use subject to the terms in the draft conditional use order dated July 7, 2016, provided the Village Board approves the text amendment. Motion carried. 12. Site plan/plan of operation for an Institutional Residential Use at 1995 Beulah Avenue (St. Peter's property); Gerard's Embrace Inc, applicant (application 2016-29) A. Possible decision by the Plan Commission Motion by Commissioner Kaplan, second by Trustee Seager to approve the site plan/plan of operation for the proposed institutional residential use (1- 12 residents) at 1995 Beulah Avenue consisting of the existing residence and detached garage, driveway access off of Beulah Avenue, and parking area provided the Village Board approves the conditional use for the proposed use. Motion carried. 14. Recommendations for future agendas No recommendations were made. Motion by Commissioner Kaplan, second by Commissioner Arendt to adjourn at 7:07 p.m. Motion carried.
