Plan Commission & Architectural Review Board
April 10, 2017
1. Call to order – President Timms called the meeting to order at 6:30 pm
2. Verification of open meeting notice - Administrator Suhm verified the meeting
had been posted according to open meetings laws.
3. Roll call
Present: President Timms (left after agenda item 6), Trustee Seager,
Commissioners Edward Arendt, John Grudnowski, Linda Kaplan,
Anna Mack, Kirk Nelson
Others: Zoning Administrator Tim Schwecke and Administrator Suhm
4. Approve Plan Commission minutes of March 13, 2017
Motion by Trustee Seager, second by Commissioner Grudnowski to approve the
minutes dated March 13, 2017. Motion carried.
5. Citizen participation
Nick Boden, 2090 North Shore Drive, presented his Eagle Scout project for the
pavilion at the archery range.
Steve Harmeyer, 4203 Highway 20, spoke in favor of the archery range. He
shared that archery is one of the safest sports - three times safer than golf. He
stated no other sport can have a five-year-old and 70-year-old stand side by
side and enjoy the sport.
Houston Wydener, presented his Eagle Scout project for a split rail fence at the
archery range for safety.
6. Site plan/plan of operation for an outdoor archery range located off of Energy
Drive (Parcel RA137200002); Village of East Troy, applicant; Jason Equitz, DPW,
agent (application 2017-05)
A question was posed regarding the location being in the flood plain. The DNR
has verbally explained that because there is no permanent structure and no one
is living or working there, that they had no concerns about this use at this
location.

Note: This application was initially reviewed at the Plan Commission
meeting on March 13, 2017, and was tabled to this meeting.
Motion by President Timms, second by Commissioner Mack to approve the
archery range site plan as submitted. Motion carried.
President Timms then excused himself and left the meeting.
Administrator Suhm asked for a motion to appoint a chairperson.
Motion by Commissioner Kaplan, second by Commissioner Arendt to appoint
Trustee Seager as the chairperson for the remainder of the meeting. Motion
carried.
7. Condo plat for 3001 and 3003 Graydon Avenue; Millennium Dream Homes LLC
(Jesse Dropik, agent) applicant (application 2017- 09)
Jesse Dropik, Agent for Millennium Dream Homes, asked that the condo plats be
approved. The plats consist of two units each and comply with Village guidelines
for a condominium plat. Zoning Administrator Schwecke explained that
although the condo declarations were not included the declarations will need to
comply with state statute for condo plats and is a document that will be drawn
up and recorded with the plat. Zoning Administrator Schwecke explained that
the units, as constructed, are compliant buildings and doing a condo plat will
allow each of the units to be sold individually.
A. Possible recommendation by the Plan Commission to the Village Board
Motion by Trustee Seager, second by Commission Grudnowski to
recommend to the Village Board the approval of the condominium plat for
Graydon Avenue East condominiums as proposed, subject to conditions
listed below, 1-2. Motion carried.
8. Condo plat for 3005 and 3007 Graydon Avenue; Millennium Dream Homes LLC
(Jesse Dropik, agent) applicant (application 2017-10)
A. Possible recommendation by the Plan Commission to the Village Board
Motion by Trustee Seager, second by Commissioner Kaplan to recommend to the
Village Board the approval of the condominium plat for Graydon Avenue West
condominiums as proposed, subject to conditions listed below, 1-2. Motion
carried.
9. Amendments of the zoning code (Chapter 510 of the municipal code) with
regard to free-standing murals and penalties (application 2017-08)

Zoning Administrator Schwecke reviewed the proposed amendment and
history. Without this change free-standing murals would not be permitted.
The ordinance changes allow for placement, a time frame of four months,
address other development standards such as size, placement and number
on property. This will be handled administratively by the Zoning
Administrator.
The penalties provision in the zoning code was due to a staff
recommendation to conform with the rest of the code. Because this section
is part of the floodplain regulations, the DNR has review authority and they
stated we had to include a provision that the penalty cannot exceed $50 per
occurrence.
There were no additional comments.
Trustee Seager closed the public hearing.
B. Possible recommendation by the Plan Commission to the Village Board
Motion by Commissioner Kaplan, second by Commissioner Mack to
recommend to Village Board the approval of the proposed ordinance with
the revision to Section 2 to address the DNR’s comments, and based on
findings contained in the proposed ordinance Motion carried.
10. Discussion related to potential amendment of zoning code regarding
telecommunication facilities and other revisions
A. Possible action by the Plan Commission to direct staff to set a public
hearing date for the potential amendment
Zoning Administrator Schwecke explained that this change is required
because of a change in state statutes limiting the extent to which the Village
can regulate telecommunication towers. Trustee Seager confirmed that part
of this statute is still in litigation, and asked if is this something we would
need to address again in the future if it does change. Zoning Administrator
Schwecke explained that any potential modification would be to give a little
more authority to a municipality if the location were in a residential area and
is unrelated to if the proposed location in the public right-of-way. Zoning
Administrator Schwecke reviewed the amendments creating three different
classes of facilities, colocation class 1, class 2 and a brand-new tower. Class 2
would be permitted by right with only administrative review. Class 1 and
new towers would allow the municipality a small amount of authority
however not to regulate brand new towers in terms of setbacks. There could
be regulation in terms of fall zone – that is if tower were to fail will fall on the
property but a fall zone is much smaller than the height of the tower because
these types of towers would collapse rather that tip over. The steps would
be similar those of a CU process.

Commissioner Nelson confirmed that the only real potential controversial
thing is the location of a new tower. Zoning Administrator Schwecke clarified
colocation can be put on any structure, such as a tall building, and if it is not
modifying the building the Village does not have authority on the location.
Motion by Trustee Seager, second by Commissioner Nelson to direct staff to
set a Public Hearing date for the potential amendment. Motion carried.
11. Discussion related to potential beautification efforts (e.g. signage
(welcome/Village of East Troy, directional, etc), landscaping and flowers in
public areas and benches potentially sponsored by businesses)
Discussion occurred on Village entrance signage and possible addition of
banners. The Commission discussed the monument sign design is attractive but
there are few options for placement. The south side of the Village on Hwy. 120
would be the best location available to the Village. If sign placement is on a
County or State road those entities will need to be involved. Maps of the Village
entrance ways were reviewed for possible locations.
The Commission is working to define best possible locations and then to meet
with vendors to view samples for possible signage. They decided they will
review the entrances to the Village and come back to the May meeting prepared
to discuss potential locations.
A. Possible action by the Plan Commission
The Commission will review the Village entrance ways and staff will contact
the State for their guidance on signs that may be placed in the public right-
of-way for consideration at the next meeting.
12. Discussion related to short-term rentals (no written report)
Zoning Administrator Schwecke discussed Commissioner Arendt’s request for an
update on this topic however, he had not received the information he wanted
to present to the Commission and asked that this topic be postponed to the
next meeting.
