Minutes Village of East Troy Plan Commission & Architectural Review Board November 13, 2017 1. Call to order – President Seager called the meeting to order at 6:30 pm 2. Verification of open meeting notice - Administrator Suhm verified the meeting had been posted according to open meetings laws. 3. Roll call Present: President Seager, Trustee Renucci, Commissioners Edward Arendt, John Grudnowski, Roger Hayes, Erin Seaverson, Benny Stichmann Excused: Others: Zoning Administrator Tim Schwecke, Building Inspector Scott Johnson and Administrator Suhm Youth in Government Representative – Matt Kisting 4. Approve Plan Commission minutes of October 9, 2017 Motion by Commissioner Arendt, second by Commissioner Stichmann to approve the minutes dated October 9, 2017. Advisory Vote – Motion carried. Plan Commission – Motion carried. 5. Citizen participation None 6. One-lot certified survey map (CSM) for tax parcel RA287200001; Jeff and Vicki McKone, applicant (application 2017-29) Details are available online: https://s.zoninghub.com/P6KZJPB8OH A. Possible recommendation by the Plan Commission to the Village Board Motion by Trustee Renucci, second by President Seager to recommend approval as presented. The Commission clarified the corrections and conditions listed in the staff report must be met. Advisory Vote – Motion carried. Plan Commission – Motion carried. 7. Public hearing (adjourned at the meeting on September 11, 2017 to November 13, 2017) B. Possible recommendation by the Plan Commission to the Village Board Note: The applicant has again asked that the public hearing be adjourned to the next meeting on December 11, 2017 to allow additional time to finalize their plans. Motion by President Seager, second by Trustee Renucci to open the public hearing. Advisory Vote - Motion carried. Plan Commission – Motion carried. Motion by Trustee Renucci, second by President Seager to adjourn the public hearing until the Plan Commission meeting on December 11, 2017. Advisory Vote – Motion carried. Proposed amendments to the Village's zoning code relating to lawn accessories, driveways, and other related matters (application 2017-28) Details are available online: https://s.zoninghub.com/9ZEPBZHNKK A. Public hearing Motion by President Seager, second by Commissioner Seaverson to open the public hearing. Advisory Vote – Motion carried. Plan Commission – Motion carried. Zoning Administrator Schwecke reviewed his memo dated November 8, 2017, along with the draft ordinance. He reminded the Commission the provisions related to storage of vehicles, RVs and boats were removed from the ordinance and will be address as a separate code amendment. It was discussed that flag poles are considered lawn accessories. The amendment was necessary because a prior change to the zoning code did not allow for flag poles. Upon a request to the Village for a flagpole, this was discovered and is being amended so flag poles will be allowed again. The Commission discussed if someone already has an existing gravel surface for their driveway they are grandfathered. The new provisions would pertain to someone making alterations to existing or to new construction. The Commission discussed amending section 510-61B(A) to state “Such surface must be completed within 12 months following occupancy of new construction.” The intent was to clarify if an existing gravel drive was grandfathered it did not need to be a hard surface if the property was sold. The Commission also discussed the provision related to the taper of a driveway and the section which allows for a turnaround on the property if the driveway accesses an arterial street. Possible recommendation by the Plan Commission to the Village Board Motion by President Segar, second by Commissioner Seaverson to recommend approval of Ordinance 2017-15 with the amendment to 510- 91B(A) stating “…following occupancy of new construction,“ based on findings contained in the proposed ordinance. Advisory vote – Motion carried. Plan Commission – Motion carried. 9. Discussion related to potential zoning code amendments relating to definition of building height A. Possible action by the Plan Commission Zoning Administrator Schwecke discussed the issue of clarifying how building height is measured with regard to dormers on the second or third story. The Commission discussed they preferred the simplicity of setting a single maximum roof height, but after further discussion decided using an average roof height would encourage varying aesthetics. Discussed working on the wording to clarify if the measurement would be on one side, two sides or cumulative. Zoning Administrator Schwecke was directed to draft the ordinance and schedule it for public hearing. 10. Discussion related to potential revisions to draft ordinance for short-term rentals A. Possible action by the Plan Commission Zoning Administrator Schwecke reviewed his staff report dated November 8, 2017. He reviewed the history of the Plan Commission working on a draft ordinance and the State enacting legislation afterward that made revisions to the draft ordinance necessary. He reported with the new legislation the Village can regulate short-term rentals six days or less. Rentals from 7-28 days can be regulated in terms of the maximum number of nights per year, but cannot be regulated to be less than 180 total. The Plan Commission had previously considered limiting 27 nights or less to four times per year, but that has now changed to apply to only six days or less. For the rental period of 7-28 nights, Zoning Administrator Schwecke explained the first time somebody rents their home for a number of nights from 7-28 that would set the timeframe for the 180 nights from the first rental date. Discussed the requirement for obtaining a permit. The Village Attorney will be asked to review the ordinance and should advise whether the Village can require a permit and impose a fee for rentals from 7-28 nights. The draft ordinance was written so it mirrors state statute. Motion by President Seager, second by Commissioner Arendt to forward the draft ordinance to the Village Attorney for a recommendation to the Board. Advisory Vote – Motion carried. Continue discussion related to accessory buildings in residential districts B. Continue discussion related to storage of boats, trailers, and other vehicles in residential districts – Discussed these two items are still being worked on and will be brought back to a future meeting C.
